Nice catch Robert — the NCDOT hydro consultant has updated the outlet velocities for the dissipater
basins for R-223313B. The Revised SMP with an updated sheet 3 is attached.

Thanks for adding those pages. Can you verify the exit velocities shown for the dissipater basins?
They are really high and will cause erosion. I'm thinking the entrance velocities were mistakenly
inserted instead of the exit velocities.

Thanks for the response. I still have some additional requests/clarification.
#1 Impacts for Site #4 are 766 linear feet. If the intermittent reach SM is 68 feet that would make
the impacts for SL 698 linear feet; therefore, 698 feet of mitigation. Is that correct?
Also for item #2, the dry basin and dissipater basins need to be included in the Stormwater
Management Plan (SMP) and maintained. Please add these to the SMP as requested.
Pursuant to Title 15A NCAC 02H .0502 (c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not
received within 30 calendar days, of receipt of this email, the Division will be unable to approve the
application and it will be returned. The return of this project will necessitate reapplication to the
Division for approval, including a complete application package and the appropriate fee.

Hope you are well. Can you provide the following additional information for the Rutherfordton
Bypass Individual Permit?
On March 13, 2020, the Division of Water Resources (Division) received your application dated
March 13, 2020, requesting a 401 Water Quality Certification from the Division for the subject
project. Please provide the following information so that the Division can continue our review.
1. Site 4 includes 766 linear feet of stream impact for SL and an intermittent stream SM. Table 2
of the application includes the intermittent segment as part of the required mitigation for
DWR. DWR does not require mitigation for intermittent streams. Please include the length of
intermittent stream (SM) so that the Division can account for this. [15A NCAC 02H .0502(c)]

Robert, SM is approximately 68' long therefore on Table 2, Permit Site 4, the mitigable
impacts for DWR are 758'.
2. Please provide the following items from the Stormwater Management Plan (SMP): a. Provide
the Best Management Practices (BMP) page of the SMP that has the dry basin information. b.
Provide the BMP page of the SMP that has the energy dissipater basin information. c. Provide
the BMP page of the SMP that has the grass swale information for swales that meet the
treatment swale criteria in the BMP toolbox. [15A NCAC 02H .0502(c)] These items are
noted within the project summary of the SMP because they may provide some treatment
benefit but were not designed specifically for stormwater treatment. These items were
designed to attenuate flow and dissipate energy to avoid adverse impacts to downstream
properties. NCDOT is not committing to maintain these items as stormwater devices as that is
not their intention. That is why they are listed in the narrative and not in separate sheets of
the SMP in accordance with our guidance.
