On July 20, 2005, the Division of Water Quality received your modified application for the proposed
stream impact at the .subject site. As conveyed to your employee, 'Mr. Brian North, Manager, Engineering
Services, in order for this office to issue the 401 Water Quality Certification, a mitigation plan (usually a stream
restoration plan) or payment into the Ecosystem Enhancement Program (EEP) is required.
Be advised that stream impacts are based on the actual stream length to be impacted and not the
length of culvert (length must be measured following the channel of the :stream flow).
Please 'be .advised that this .project will be placed on hold, pursuant to 15A NCAC 2H .0507(h), until
acceptance by the EEP or a formal stream restoration plan has been submitted. In addition, this office is
requesting that the.Army Corps of Engineers withhold processing the 404 permit until the requested
.information isprovided. Failure to provide the requested information by September 30, 2005 will result the
removal of your application for consideration. If you have any questions, please contact Mr. Alan Johnson at
