G. Stormwater
1. Provide a description of how diffuse flow will be maintained through the protected riparian buffers (e.g., re-
planting vegetation or enhancement of existing vegetation, gutter splash pads, level spreader to control of
runoff from impervious surfaces, etc.).*
The project is within the City of Raleigh's jurisdiction and will obtain an approved stormwater management plan that
complies with NPDES Phase 2 requirements as well as Neuse River NWS requirements. The conceptual plan calls for
two underground sandfilter/detention devices in the approximate locations shown on the attached plans. The
applicant asks for a conditional approval such that the stormwater management plan details (BMP Supplement Form
& O&M Form, etc.) are provided pending the Major Variance approval and at the time of the 401 Water Quality
Certification application.

H. Demonstration of Need for a Variance
The variance provision of the riparian buffer rules allows the Division or the Environrrental Ivtanagerrent Conrrission to grant a variance when there are practical difficulties or
unnecessary hardships that prevent cor pliance with the strict letter of riparian buffer protection.
1. Explain how complying with the provisions of the applicable rule would prevent you from securing a
reasonable return from or make reasonable use of your property. Merely proving that the variance would permit
a greater profit from the property shall not be considered adequate justification for a variance. The Division will
consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule
that shall make reasonable use of the property possible.*
The applicant is under contract with the owners to purchase and develope this property. The applicant does not
believe the property is developable for commercial purposes without a variance. This property is unique as the
property is currently separated in half by a culvert stream that is subject to a 50' buffer which has been determined to
be low quality in nature and it appears that most of the runoff can reasonably be attributed to runoff from the Wake
Med's campus. The stream starts at the culvert at Galahad Drive and stops at the culvert at Luther Road. Because of
the bisection, in order to develop the property in its current condition, you would have to construct a medical office
building with under grade parking on one side of the stream while the other side would be designated as patient or
employee parking with a pedestrian bridge/cross walk connecting the two areas. The cost of subgrade parking is cost
prohibitive to get any return and more importantly it's not an ideal condition to have patients crossing an exposed
bridge/cross walk if they are seeking medical treatment. Distance to the entrance is becoming increasingly important
as the age of patients seeking medical care is increasing due to the baby boomer generation. Other developers
have walked from this site due to the costs associated to develop it. The cost of the proposed development plan also
produces a return below what is typical or desired for similar development projects, but it is acceptable to the
applicant, even after factoring in the anticipated $310k+ of buffer mitigation. If this proposed development plan isn't
approved, then we too will need to walk from this site.
2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors
such as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc).*
A stream and associated buffers bisects the project site, leaving no practicable or safe way to develop the properties
for their intended use without impacting the buffer.
3. Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable
Buffer Rule.*
No violations of the buffer rule have occurred on the project site.
4. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography,
which is different form that of neighboring property. *
The stream bisects the project site and its associated buffers do not leave enough building land outside of the
buffers to practicably develop the properties for their intended use. The stream is piped just above and below for
parking lots and decks. This is the last remaining section and it's quality is low due to the uncontrolled stormwater
runoff into it and surrounding development.
5. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that
are widespread.*
This project site is surrounded by the existing WakeMed campus with parking above and below it. It's the last
remaining such developable land immediately adjacent to the hospital and suitable for a medical office building.
There are no other properties like this in the area. However, there just happens to be a stream and associated
buffers on the property between two sections piped many years ago.
For Neuse, Tar -Pamlico, Jordan Lake and Goose Creek only:
6. Did the applicant purchase the property after the effective date of the applicable Buffer Rule and then request
a variance?*
The applicant has not yet purchased the property. One of the three lots was purchased prior to the effective date of
the rule. The other two were purchased in 2011. However, the lots have been recorded in their current configuration
since 1979 as depicted on the recorded map.
