I. In order to Compensate for unavoidable impacts to moderate and high
value wetlandg ih the upper portion of the lake basin, the pe:rmittaa will

authorized excavation. Planting will be accomplished within the first growing
season following project completion.

LAKE, AN IMPOUNDMENT ON LONG CREEK WEST. OF,,ALBEMARLE, Stanly.County, North

The following description of the work is taken from data provided by the
applicant and from observations made during:an onsite visit by a
-representative of the U.S. Army Corps of Engineers. Plans submitted with the
application show the proposed excavation of approximately 134,400 cubic yards
of silt material from the bed of Long Lake. Long Lake was drained in 1986 to
facilitate repairs to the dam. Extensive siltation over much of the lake
bottom was revealed when the water level was lowered, and the applicant
determined that sediment removal would be necessary before the lake could be
refilled. Excavation is to be accomplished by land-based equipment such as
pan scrapers, bulldozers and backhoes with the excavated material placed and
retained on the applicant's 70-acre property immediately adjacent to the lake.
An average of 5 feet of silt would be removed.over the 79-acre rea occupied
by the lake. Due to limited outflow, the lake basin still ex rien s partial
and temporary impoundment following heavy rains. Approximatell.y 50 acres of
the lake bottom is presently occupied by jurisdictional wetlands consisting
primarily of emergent marsh (smartweed, sedges, rushes, panic grass, wool
grass, cattail) with some scrub shrub (alder, willow, hibiscus). All these
wetlands would be cleared, grubbed and excavated.by the proposed work. Plans
also show the construction of a 580-foot-long, 12-foot-wide and-4-foot-high
gabion basket weir across the upper one-fourth of the lake basin. The purpose
of the weir is to create.a subimpoundment that would function as a permanent,
maintainable sediment basin and biofilter. This biofilter would have a
surface area of approximately 17 acres. It is proposed to create a shallow
littoral zone around the biofilter of approximately 2.25 acres in size for
wetland development. Approximately 600 linear feet of the applicant's
shoreline property, where a public park facility is planned, would be

THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public taws. 92-500 and 95-217 of the
United States and subject to the North.Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Cityk of Albemarle pursuant to an application filed on the
15th day of April, 1993.to dredge Long Lake and install a
sediment reterition basin (biofilter) andd stabilze ending
shoreline.
The Application provides adequate assurance that the
discharge of fill material into wetlands adjacent to the waters
of Long Creek in conjunction with the proposed dredging in
Stanley County will not result:in <a violationiof applicable Water
.Quality Standards and discharge"guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions
hereinafter set forth.
Condition (s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in.the stream is 25 NTU's or less are not
considered significant).
2. Mitigation with the biofilter must be done
following COE guidelines. Reports on the
mitigation must be done annually and two , Water
Quality Planning in Raleigh.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

In keeping with your request, this office has circulated to interested state review agencies
U. S. Army Corps of Engineers Pulbic Notice Action ID. 199300728 dated April 15, 1993
which describes a project proposal by the City of Albemarle. The project, involving wetland
excavation to rclaim a small lake, is located at Long Lake and Long Creek, west of Albemarle,
in Stanly County.
Based on a coordinated agency review, the state interposes no objection to the project.
The state does, however, offer important management conditions which were submitted by key
agencies. The recommendations of the agency submitting each follow:
Division of Land Resources - having reviewed the Notice and having had other contact
with the City made the following observations: 1) a detailed erosion and sedimentation
control plan is required for the project, 2) more details on the gabion are required
because Land Resources was only aware of a riprap weir, 3) part of the spoil area
crosses a ridge line with steep grade and should be deleted from the spoil site, 4) disposal
area contours are needed as well as size and source of cobble stones for shoreline
protection;
Wildlife Resources Commission - will not object to project provided following
recommendations are included. The Commission did, however, express concern over
upland habitat loss from the spoil area. This is reflected in the recommendations:
1) Measures to control downstream turbidity in Long Creek should be installed prior
to dredging and maintained until completion of all mechanized work within the
lake bed.
2) The spoil disposal area should not involve removal of upland hardwood forest
habitat. Retention of forested areas has become increasingly important due to the
widespread loss of such habitat within the Piedmont region.

3) Strict erosion control measures should be installed around the spoil disposal area
to prevent reintroduction of silt and associated agricultural chemical residues into
aquatic systems.
4) Mechanized work within the lake bed should be strictly limited to the
activities described in the permit application. Removal of woody cover
around the lake margin should be minimized, and stream channelization should
be avoided. Ditching and "snagging" operations are frequently performed
spontaneously by contractors, and such activities should be explicitly proscribed
in the permit.
5) The proposed wetland development area (approx. 2.25 acres) around the margin
of the biofilter subimpoundment should be planted with native vegetation types
of high value to wildlife. Such qualitative improvement of restored habitat areas
will help to offset the quantitative loss of wetlands associated with the project.
Specific recommendations for wildlife plantings may be obtained from Ken
Knight, District Wildlife Biologist, at (704) 982-1600.

Certification No. 2831 on June 9, 1993.
Should you require additional input from the state on this matter, do not hesitate to

Dear Mr. Allen:
Reference your application for Department of the Army (DA) authorization
to remove accumulated sediment, construct a weir and a permanent sediment
retention basin and stabilize a portion of shoreline on Long Lake, an
impoundment of Long Creek, west of Albemarle,v;;:Stanly County, North Carolina.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidpi inga, This MnA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives to the work for which you have applied,.such as refilling the
lake in its present condition, and provide justification that your selected
plan is the least damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts. Such steps could
include the partial removal of sediments to reduce losses to existing wetlands
or the incorporation of some of the existing, upper-basin wetlands into the
proposed biofilter.

c. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Your plans call for
establishing 2.25 acres of wetland within the proposed 17-acre biofilter.
Plese address the practicability of increasing the amount of wetland
mitigation.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by May 24, 1993. Also, a copy of
this information must be sent to the North Carolina Division of Environmental
Management to enable them to adequately evaluate your application for a Water
Quality Certification pursuant to Section 401 of the Clean Water Act.

SPECIAL CONDITIONS
1. In order to compensate for unavoidable impacts to modarate and high
valua watlanda in the upper portion of the lake basin, the permittee will
create 4.S acres of viable, herbaceous marsh wetland at two to four locations
along chto ohdrelins of Long Lake. To be cona.iderad viable the mitigation
areas must meet the following auecaaa criteria for wetland vegetation and
.hydrology:
a) The wetland vegetation auccosa criterion will be meet when at laast
.70W ground cover in achieved.
b) Wetland hydrology will be establiahad when the mitigation areas

PUBLIC NOTICE
MR. RAYMOND I. ALLEN, MANAGER, CITY OF ALBEMARLE, Post Office Box 190,
Albemarle, North Carolina 28002, has applied for a Department of the Army
(DA) permit TO EXCAVATE ACCUMULATED SEDIMENT, CONSTRUCT A WIER AND PERMANENT
SEDIMENT RETENTION BASIN (BIOFILTER), AND STABIILIZE ERODING SHORELINE AT LONG
LAKE, AN IMPOUNDMENT ON LONG CREEK WEST OF ALBEMARLE, Stanly County, North
Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the U.S. Army Corps of Engineers. Plans submitted with the
application show the proposed excavation of approximately 134,400 cubic yards
of silt material from the bed of Long Lake. Long Lake was drained in 1986 to
facilitate repairs to the dam. Extensive siltation over much of the lake
bottom was revealed when the water level was lowered, and the applicant
determined that sediment removal would be necessary before the lake could be
refilled. Excavation is to be accomplished by land-based equipment such as
pan scrapers, bulldozers and backhoes with the excavated material placed and
retained on the applicant's 70-acre property immediately adjacent to the lake.
An average of 5 feet of silt would be removed over the 79-acre acrea`occupied
by the lake. Due to limited outflow, the lake basin still ex? rien s partial
and temporary impoundment following heavy rains. Approximately rc of
the lake bottom is presently occupied by jurisdictional wetlands consisting
primarily of emergent marsh (smartweed, sedges, rushes, panic grass, wool
grass, cattail) with some scrub shrub (alder, willow, hibiscus). All these
wetlands would be cleared, grubbed and excavated by the proposed work. Plans
also show the construction of a 580-foot-long, 12-foot-wide and 4-foot-high
gabion basket weir across the upper one-fourth of the lake basin. The purpose
of the weir is to create.a subimpoundment that would function as a permanent,
maintainable sediment basin and biofilter. This biofilter would have a
surface area of approximately 17 acres. It is proposed to create a shallow
littoral zone around the biofilter of approximately 2.25 acres in size for
wetland development. Approximately 600 linear feet of the applicant's
shoreline property, where a public park facility is planned, would be

stabilized with stone. The purpose of the proposed work is to restore and
rehabilitate Long Lake for public recreational use. Funding for the proposed
work would be through the U.S. Environmental Protection Agency's Clean Lakes
Program. Plans showing the proposed work are included with this public
notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
DA permit will be issued until the coordinated State viewpoint on the proposal
has been received and reviewed by this agency, nor will a DA permit be issued
until the North Carolina Division of Environmental Management (DEM) has
determined the applicability of a Water Quality Certificate as required by
PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably maybe expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which

it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this DA permit will not be made
until the DEM issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the DApermit
serve as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, DEM,
Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such,
materials will be furnished to any person requesting copies upon payment of
reproduction costs.
The DEM plans to take final action in the issuance of the Clean Water Act
certification on or after May 8, 1993.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the DEM, Post
Office Box 27687, Raleigh, North Carolina 27611-7687, on or before may 3,
1993, Attention: Mr. John Dorney.

THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Cityk of Albemarle pursuant to an application filed on the
15th day of April, 1993 to dredge Long Lake and install a
sediment reterition basin (biofilter) andd stabilze ending
shoreline.
The Application provides adequate assurance that the
discharge of fill material into wetlands adjacent to the waters
of Long Creek in conjunction with the proposed dredging in
Stanley County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions
hereinafter set forth.
Condition (s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in.the stream is 25 NTU's or less are not
considered significant).
2. Mitigation with the biofilter must be done
following COE guidelines. Reports on the
mitigation must be done annually and two , Water
Quality Planning in Raleigh.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

Corps of Engineers (COE) stating that your project qualified for a Nationwide Permit.
Please be advised that the Nationwide Permit is not valid until a 401 Water Quality
Certification has been issued by the Division. General Certifications have been issue
by the Division for most of the Nationwide Permits, however, several of the General
Certifications require written concurrence from the Division before the Nationwide
Permit is valid.
If you are utilizing Nationwide Permit # 26 and your fill activity is equal to or
less than one-third (1/3) of an acre you are not required to obtain written concurrence.

Dear Mr. Jensen:
On November 19, 1992 you met with Mr. Steven Lund of my Asheville staff at
the site of the former Long Lake (aka City Lake) on Long Creek south of
N.C. Highway 73 at Albemarle, Stanly County, North Carolina. The lake has
been drained since 1986. The purpose of this meeting was to determine
Department of the Army (DA) permit requirements for the City's proposed lake
rehabilitation project.
It was found that approximately 2/3 of the original lake bed consists of
jurisdictional wetlands that fall within our regulatory authority. We believe
that this can be attributed to the fine, silty materials that comprise the
soils and the fact that much of the lake bottom is still periodically flooded
following heavy rains. The wetlands range from recently developed,
non-persistent, emergent marsh dominated by smartweed in the lower end of the
reservoir near the dam to a shrub swamp/persistent emergent marsh complex in
the upper ends near Highway 73 that has developed over a longer period of
time. It was also found that the large channel island as well as some of the
old stream levees that are higher in elevation and are vegetated primarily
with black willow, would not be considered wetlands because the water table
has dropped below 24 inches.
It is our understanding from information you provided, as well as the
feasibility study for lake rehabilitation prepared by Coastal Environmental
Services, Inc. in October 1992, that the City plans to remove accumulated
sediments over virtually the entire 80-acre lake bottom using land-based
equipment such as backhoes, bulldozers, and earth-moving pans. This activity
constitutes a discharge of fill in wetlands and requires a DA permit. It is
also proposed to construct a wier across the channel of Long Creek near the
upper end of the reservoir to form a permanent, maintainable sediment trap and
bio-filter. This too would require DA permit authorization.
Enclosed is a pamphlet designed as a guide for applicants that explains,
in general terms, why a permit is required, when a permit is needed, and how

to submit a permit application. Engineer Form 4345 shown on pages 11 and 12
of the pamphlet should be used for projects in your area. Clear and accurate
information, including drawings, must be provided. Supplemental pages may be
used. A complete application package should be furnished to us in Wilmington.
To facilitate our review of your application we recommend that you include
information on alternatives to the proposed work that would reduce or
eliminate impacts to existing wetlands. Such alternatives may include
refilling the lake in its present state, partial removal of sediments to
reduce wetland losses, incorporation of some of the existing upper-basin
wetlands into the proposed bio-filter, and mitigation for unavoidable wetland
losses. Also include information on the public benefits that are expected to
accrue from lake rehabilitation.

On 24 April 1993, I visited the proposed dredging site at
Long Lake near Albemarle. The lake has been drained since 1986.
The lake bottom near the dam is covered with Polygonum sp.
(Smartweeds). The bottom itself is covered with a fine clay with
numerous small drains across it to the stream channel. The area
was rated at 27.5% (not significant). The upper end of the lake
is covered with widely scattered young (< 6 " dbh) willows,
sycamore, river birch and ash. There is much evidence of scour
through this area. A few old remnant stream scars provide some
aquatic life habitat. This ares rated as 30.5% (also
nonsignificant but with some, limited wildlife habitat value).
According to the Public Notice, there may be little
jurisdictional wetland here since the stream channel is incised
by three or more feet.
I believe that there should be no problem obtaining the
Individual Permit with the proposed biofilter if the agencies
have any sense (large presumption). There will be a large
acreage of "wetlands" impacted (the smartweed fields). This may
be the best example yet of the need to regulate "wetlands" based
on function/value. If the agencies squawk, I suggest that Jay
Sauber and the City push the biofilter and its creation of highly
functional freshwater marsh. A "preemptive" strike by Jay and
the City may be useful. I suggest that Jay and the City schedule
an agency meeting ASAP on site to discuss the biofilter and lake
dredging plan. This should enable them to "fend off" any weird
comments from the agencies which would take forever to address.

Enclosed is the application of Raymond Allen, Manager, City of Albemarle,
for Department of the Army authorization and a State Water Quality
Certification to remove accuulated sediment, construct a permanent sediment
retention basin (biofilter), and stabilize eroding shoreline at Long Lake, an
impoundment of Long Creek, west of Albemarle, Stanly County, North Carolina.
Your receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by June 15, 1993, the District Engineer will deem that
waiver has occurred.

SEDIMENT RETENTION BASIN (BIOPZLTER), AND STABIILIZE ERODING SHORELINE AT LONG
LAKE, AN IMPOUNDMENT ON LONG CREEK WEST OF ALBEMARLE, Stanly County, North
Carolina.
The following description of the cork is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the U.S. Army Corps of Engineers. Plans submitted with the
application show the proposed excavation of approximately 134,400 cubic yards
of silt material from the bed of Long Lake. Long Lake was drained in 1986 to
facilitate repairs to the dam. Extensive siltation over much of the lake
bottom was revealed when the water level was lowered, and the applicant
determined that sediment removal would be necessary before.the lake could be
refilled. Excavation is to be accomplished by land-based equipment such as
pan scrapers, bulldozers and backhoeb with the excavated material placed and
retained on the applicant's 70-acre property immediately adjacent to the lake.
An average of 5 feet of silt would be removed over the 79--acre area occupied
by the lake. Due to limited outflow, the lake basin ptill experiences partial
and temporary impoundment following heavy rains. Approximately 50 acres of
the lake bottom is presently occupied by jurisdictional wetlands consisting
primarily of emergent marsh (amartweed, sedgea, rushes, panic grass, wool
grass, cattail) with some scrub shrub (alder, willow, hibiscus). All these
wetlands would be cleared, grubbed and excavated by the proposed work. Plans
also show the construction of a 580-foot-long, 12-foot-wide and 4-foot-high
gabion basket weir across the upper one-fourth of the lake basin. The purpose
of the weir is to create a subimpoundment that would function as a permanent,
maintainable sediment basin and biofilter. This biofilter would have a
surface area of approximately 17 acres. It is proposed to create a shallow
littoral zone around the biofilter of approximately 2.25 acres in size for
wetland development. Approximately 600 linear feet of the applicant's
shoreline property, where a public park facility is planned, would be

stabilized with stone. The purpose of the proposed work is to restore and
rehabilitate Long Lake for public recreational use. Funding for the proposed
work would be through the U.S. Environmental Protection Agency's Clean.Lakes
Program- Plans.showing the proposed work are included with this public
notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required state authorization. No
DA permit will be issued until the coordinated State viewpoint on the proposal
has been received and reviewed by this agency, nor will a DA permit be issued
until the North Carolina Division of Environmental Management (DEM) has
determined the applicability of a Water Quality Certificate as required by
PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.s.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
thie worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which

it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies, 404(b)(1) guidelines. subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this DA permit will not be made
until the DEM issues, denies, or waives state certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the DApermit
serve an application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, DEM,
Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such
materials will be furnished to any person requesting copies upon payment of
reproduction costs.
The DEM plans to take final action in the issuance of the Clean Water Act
certification on or after may 8, 1993.

On November 19, 1992 you met with Mr. Steven Lund of my Asheville staff at
the site of the former Long Lake (aka City Lake) on Long Creek south of
N.C. Highway 73 at Albemarle, Stanly County, North Carolina. The lake has
been drained since 1986. The purpose of this meeting was to determine
Department of the Army (DA) permit requirements for the City's proposed lake
rehabilitation project.
It was found that approximately 2/3 of the original lake bed consists of
jurisdictional wetlands that fall within our regulatory authority. We believe
that this can be attributed to the fine, silty materials that comprise the
soils and the fact that much of the lake bottom is still periodically flooded
following heavy rains. The wetlands range from recently developed,
non-persistent,-emergent marsh dominated by smartweed in the lower end of the
reservoir near the dam to a shrub swamp/persistent emergent marsh complex in
the upper ends near Highway 73 that has developed over a longer period of
time. It was also found that the large channel island as well as some of the
old stream levees that are higher in elevation and are vegetated primarily
with black willow, would not be considered wetlands because the water table
has dropped below 24 inches.
It is our understanding from information you provided, as well as the
feasibility study for lake rehabilitation prepared by Coastal Environmental
Services, Inc. in October 1992, that the City plans to remove accumulated
sediments over virtually the entire 80-acre lake bottom using land-based
equipment such as backhoes, bulldozers, and earth-moving pans. This activity
constitutes a discharge of fill in wetlands and requires a DA permit. It is
also proposed to construct a wier across the channel of Long Creek near the
upper end of the reservoir to form a permanent, maintainable sediment trap and
bio-filter. This too would require DA permit authorization.
Enclosed is a pamphlet designed as a guide for applicants that explains,
in general terms, why a permit is required, when a permit is needed, and how

to submit a permit application. Engineer Form 4345 shown on pages 11 and 12
of the pamphlet should be used for projects in your area. Clear and accurate
information, including drawings, must be provided. Supplemental pages may be
used. A complete application package should be furnished to us in Wilmington.
To facilitate our review of your application we recommend that you include
information on alternatives to the proposed work that would reduce or
eliminate impacts to existing wetlands. Such alternatives may include
refilling the lake in its present state, partial removal of sediments to
reduce wetland losses, incorporation of some of the existing upper-basin
wetlands into the proposed bio-filter, and mitigation for unavoidable wetland
losses. Also include information on the public benefits that are expected to
accrue from lake rehabilitation.

The plans you furnished are inadequate for our processing. Specifically,
your plans must be revised as follows:
a. As plans must be reproduced photographically, shading should not be
used. Plans must show work as dots, hatching, or similar graphic symbols that
will not fade with repeated reproduction.
b. The projected ordinary high water line of the lake should be shown and
clearly identified on both plan and cross-sectional drawings.
C. The extent of the proposed excavation should be shown and clearly
identified on both plan and cross-sectional drawings.
d. The limits of the material retention area should be identified. It
should also be indicated whether this is a permanent or temporary retention
area.
e. The location of all wetlands in the project area (i.e., swamps,
marshes, etc.) must be clearly shown. The plan view that we have received is
already badly faded by reproduction.

Albemarle, North Carolina 28002, has applied for a Department of the Army
(DA) permit TO EXCAVATE ACCUMULATED SEDIMENT, CONSTRUCT A WIER AND PERMANENT
SEDIMENT RETENTION BASIN (BIOFILTER), AND STABIILIZE ERODING SHORELINE AT LONG
LAKE, AN IMPOUNDMENT ON LONG CREEK WEST OF ALBEMARLE, Stanly County, North
Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the U.S. Army Corps of Engineers. Plans submitted with the
application show the proposed excavation of approximately 134,400 cubic yards
of silt material from the bed of Long Lake. Long Lake was drained in 1986 to
facilitate repairs to the dam. Extensive siltation over much of the lake
bottom was revealed when the water level was lowered, and the applicant
determined that sediment removal would be necessary before the lake could be
refilled. Excavation is to be accomplished by land-based equipment such as
pan scrapers, bulldozers and backhoes with the excavated material placed and
retained on the applicant's 70-acre property immediately adjacent to the lake.
An average of 5 feet of silt would be removed over the 79-acre area occupied
by the lake. Due to limited outflow, the lake basin still experiences partial
and temporary impoundment following heavy rains. Approximately 50 acres of
the lake bottom is presently occupied by jurisdictional wetlands consisting
primarily of emergent marsh (smartweed, sedges, rushes, panic grass, wool
grass, cattail) with some scrub shrub (alder, willow, hibiscus). All these
wetlands would be cleared, grubbed and excavated by the proposed work. Plans
also show the construction of a 580-foot-long, 12-foot-wide and 4-foot-high
gabion basket weir across the upper one-fourth of the lake basin. The purpose
of the weir is to create a subimpoundment that would function as a permanent,
maintainable sediment basin and biofilter. This biofilter would have a
surface area of approximately 17 acres. It is proposed to create a shallow
littoral zone around the biofilter of approximately 2.25 acres in size for
wetland development. Approximately 600 linear feet of the applicant's
shoreline property, where a public park facility is planned, would be

stabilized with stone. The purpose of the proposed work is to restore and
rehabilitate Long Lake for public recreational use. Funding for the proposed
work would be through the U.S. Environmental Protection Agency's Clean Lakes
Program. Plans showing the proposed work are included with this public
notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
DA permit will be issued until the coordinated State viewpoint on the proposal
has been received and reviewed by this agency, nor will a DA permit be issued
until the North Carolina Division of Environmental Management (DEM) has
determined the applicability of a Water Quality Certificate as required by
PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which

it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies, 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this DA permit will not be made
until the DEM issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the DApermit
serve as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, DEM,
Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such
materials will be furnished to any person requesting copies upon payment of
reproduction costs.
The DEM plans to take final action in the issuance of the Clean Water Act
certification on or after May 8, 1993.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the DEM, Post
Office Box 27687, Raleigh, North Carolina 27611-7687, on or before May-3,
1993, Attention: Mr. John Dorney.
