The term "this office" refers to the appropriate district or division office of the Corps of Engineers having jurisdiction over the permitted activity or the appropriate official of that office acting under the authority of the commanding officer. You are authorized to perform work in accordance with the terms and conditions specified below. Project Description : To place fill materials into the waters of Catheys Creek to construct a 41-acre flood control impoundment west of Union Mills, in accordance with enclosed plan. Project Location: Rutherford County, North Carolina. Permit Conditions: General Conditions: 1. The time limit for completing the work authorized ends on December 310 1996 . If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached. 2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and condi- tions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area. 3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordina- tion required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places. If you sell the property associated with this permit, you must obtain the signature of the new owner in the space provided and forward a copy of the permit to this office to validate the 'transfer of this authorization. 6. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it con- tains such conditions. - 6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit. Special Conditions: See enclosed sheets. Further Information: 1. Congressional Authorities: You have been authorized to undertake the activity described above pursuant to: () Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403). Section 404 of the Clean Water Act (33 U.S.C. 1344). () Section 103 of the Marine Protection, Research and Sanctuaries Act of 1972 (33 U.S.C. 1413). 2. Limits of this authorization. L This permit does not obviate the need to obtain other Federal, state, or local authorizations required by law. b. This permit does not grant any property rights or exclusive privileges. C. This permit does not authorize any injury to the property or rights of others. d. This permit does not authorize interference with any existing or proposed Federal project. 3. Limits of Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following: a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. b. Damages to the permitted project or uses thereof as a result of current or future activities undertaken by or on behalf - of the United States in the public interest. c. Damages to persons, property, or to ' other permitted or unpermitted activities or structures caused by the activity authorized by this permit. d. Design or construction deficiencies associated with the permitted work. 2 e. Damage claims associated with any future modification, suspension, or revocation of this permit. 4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public interest was made in reliance on the information you provided. 5. Reevaluation of Permit Decision. This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following: a. You fail to comply with the terms and conditions of this permit. b. The Information provided by you in support of your permit application proves to have been false, incomplete, or inaccurate (See 4 above). c. Significant new information surfaces which this office did not consider in reaching the original public interest decision. Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The referenced enforcement procedures provide for the issuance of an administrative order requiring you to comply with the terms and conditions of your permit and for the initiation of legal action where appropriate. You will be required to pay for any corrective measures ordered by this office, and if you fail to comply with such directive, this office may in certain situations (such as those specified in 33 CFR 209.170) accomplish the corrective measures by contract or otherwise and bill you for the cost. 6. Extensions. General condition 1 establishes a time limit for the completion of the activity authorized by this permit. Unless there are circumstances requiring either a prompt completion of the authorized activity or a reevaluation of the public interest decision, the Corps will normally give favorable consideration to a request for an extension of this time limit. Your signature below, as permittee, indicates that you accept and agree to comply with the terms and conditions of this permit. A minimun flow equal to the 7Q10 should be released below the dam into Catheys Creek to maintain aquatic habitat in the stream. 2. In order to compensate for unavoidable wetlands impacts, the permi.ttee will create viable wooded wetlands of at least 4.8 acres in size on property adjacent the authorized impoundment. A minimum of 1.6 acres will be at one location on the northern arm of the lake with the remaining acreage at various locations along the shoreline. To be considered viable the mitigation areas must meet the following success criteria for wetland vegetation and hydrology: a. The wetland vegetation success criterion will be met when at least 600 planted trees per acre survive for three consecutive years. b. Wetland hydrology will be established when the mitigation areas exceed the 1987 Wetland Manual criterion for hydrology (i.e. be saturated within 12 inches of the surface, ponded or flooded for at least 25 consecutive days of the growing season). Construction of the mitigation areas (i.e. site preparation and grading) will be concurrent with dam construction. 3. The permittee will provide a suitable growing medium and grade to meet the wetland vegetation and hydrology success criteria. 4. Cale proportions of six of the following acceptable species will be distributed throughout the mitigation areas: green ash, red maple, sycamore, river birch, serviceberny, black willow, alder, swamp dogwood, willow oak, water oak, swamp chestnut oak. 5. The permi.ttee will provide to the U.S. Army Corps of Engineers, Wilmington District, Regulatory Branch (Corps) an "As Built" report and plan of the mitigation areas at the completion of planting. This report will include the precise size of the planted areas, final ground elevations, species composition and distribution, locations of vegetative sampling plots and hydrology monitoring stations, and other pertinent information as may be deemed necessary. 6. The permittee will document seedling survival rates for the mitigation areas by either direct counts of living stems over the entire site or by utilization of permanent and random vegetative sampling plots that adequately represent the site. A n?ini mien of two .05 acre sample plots will be established for the largest 1.6-acre site. The remaining 7 identified mitigation areas will have one .05 acre sample plot per site. The location of all sampling plots will be coordinated with the Corps during initial planting. -2- Monitoring of the vegetative sampling plots will occur during the period 1 August through 30 September of every growing season after initial planting until it is clearly demonstrated that the vegetation success criterion has been met. 7. The permittee will document that the wetland hydrology success criterion has been met for the first full growing season following dam closure and initial planting that demonstrates normal climatic conditions. This may be accomplished through monitoring wells or direct visual observation. If wells are utilized, their frequency and location will be closely tied to the vegetative sampling plots. The locations of the hydrology monitoring stations will be established at the time of planting through coordination with the Corps. The pennittee will take remedial action, as necessary, to meet the wetland hydrology success criterion. 8. No clearing and grubbing, equipment storage, stockpiling of materials or other disturbance of wetlands will occur outside of the authorized permanent pool elevation. 9. All unsuitable materials will be disposed of on uplands. 10. The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NIU's or less are not considered significant. o O Wo E L L j;• ? DEPARTMENT OF THE ARMY Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402 Action ID No. 199101290 June 17, 1993 FINDING OF NO SIGNIFICANT IMPACT AND STATEMENT OF FINDINGS This permit action is being taken under authority delegated to the Wilmington District Engineer by the Secretary of the Army and the Chief of Engineers by Title 33, Code of Federal Regulations, Part 325.8, pursuant to: Section 10 of the Rivers and Harbors Act of.1899. _X Section 404 of the Clean Water Act. Section 103 of the Marine Protection, Research and Sanctuaries Act. Section 4(e) of the Outer Continental Shelf Lands Act of 1953. _X-Section 401 of the Clean Water Act. Water Quality Certification issued by the North Carolina Division of Environmental Management. Section 402 of the Clean Water Act. National Pollutant Discharge Elimination System (NPDES) permit issued by the North Carolina Division of Enviromental Management. Section 307 of the Coastal Zone Management Act. Consistency concurred and CAMA permit issued by North Carolina Division of Coastal Management. _X-Conforms to the Section 404(b)(1) Guidelines, (40 CFR 230, FR 24 DEC 80). Conforms to the Ocean Dumping Criteria (40 CFR 220-229, FR 11 JAN 77). I have reviewed the application and plans furnished by the applicant and the Supplemental Watershed Plan/Environmental Assessment dated May 1992 prepared for this project by the U.S. Department of Agriculture, Soil Conservation Service. I am aware that the project would inundate approximately 4.5 acres of wetlands and impound approximately 7,000 linear feet of free-flowing stream. However, I do not consider these impacts significant as the project would provide flood protection for roads, bridges and agricultural lands and the wetland impacts would be fully compensated for through mitigation. -2- The proposed project has had extensive review through our normal public notice process, and there are no substantive objections to the project as of the writing of this statement. The U.S. Environmental Protection Agency and the National Marine Fisheries Service have reviewed this application and have no unresolved concerns. The U.S. Fish and Wildlife Service and the N.C. Wildlife Resources Commission recommended conditions that have been incorporated into the permit. The N.C. Department of Environment, Health and Natural Resources has issued a water quality certification for this project. Pursuant to Section 102(2)(C) of the National Environmental Policy Act of 1969; the Council on Environmental Quality Guidelines (40 CFR Part 1500); and the Soil Conservation Service Guidelines (7 CFR Part 650); the Soil Conservation Service (SCS), U.S. Department of Agriculture, has determined that the project will not cause significant local, regional, or national impacts on the environment. Therefore, the SCS has concluded that the preparation and review of an environmental impact statement are not needed for this project. On September 14, 1992 the SCS issued a Finding of No Significant Impact for this project. I have given full consideration to this application. After weighing favorable and unfavorable aspects, I find that the issuance of a permit to the Rutherford County Watershed Commission will not be contrary to the general public interest provided that they adhere to the conditions incorporated in the permit. ACTIVITY Construction of floodwater-retarding Structure No. 2, Second Broad River Watershed. Structure consists of a compacted earth fill dam with a 36-inch concrete conduit through the dam. The top of dam elevation is 1043.7 P-1SL, the crest of emergency spillway elevation is 1034.5 MSL and the principal spillway elevation is 1014.5 MSL. Earthfill will be 111,300 cubic yards and excavation will be 144,532 cubic yards. Permanent pool surface area will be 41 acres. +o. PURPOSE The purpose is flood control. Structure No. 2 is an integral part of the Second Broad River Watershed Plan. Eleven floodwater-retarding structures have been built to date as part of this plan. Construction is planned for late 1993 and 1994, depending on the availability of funds. r- DISCHARGE OF DREDGED OR FILL MATERIAL Fill material will be used to construct the earthfill dam. Fill will be transported by large tracked or rubber-tired equipment. there will be 111,300 cubic yards of earthfill associated with dam construction. EDDIE HOLLAND, Chairman, Room 122 Federal Building, 121 South Main Street, Rutherfordton, North Carolina, 28139, has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIALS INTO THE WATERS OF CATHEYS CREEK TO CONSTRUCT A 41-ACRE, FLOOD CONTROL IMPOUNDMENT WEST OF UNION MILLS, Rutherford County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers. Plans submitted with the application show the proposed construction of a 46-foot high, compacted earth fill dam with a 36-inch concrete conduit on Catheys Creek just downstream of the confluence with Harris Creek. The approximate 111,300 cubic yards of fill material required for construction would be obtained from excavation required for the dam and spillway. The planned permanent pool would have a surface area of 41 acres. A 300-foot-long section of Catheys Creek would be filled for construction of the dam and an additional 7,000 linear feet of stream channel on Catheys and Harris Creeks would be inundated by the project. Approximately 4.5 acres of wetlands would also be inundated by the permanent pool. These wetlands consist primarily of alder shrub swamp and wet meadow that has developed in abandoned pastureland. One small slough-like depression close to the dam site is forested with green ash, red maple and sycamore. As compensation for these wetland losses, the applicant proposes to create a total of approximately 6.1 acres of wetland at various locations around the impoundment. This mitigation proposal is described on sheets 8 through 10 of the project plans. The purpose of this project is to control flooding of downstream agricultural lands. This work is part of the U.S. Department of Agriculture, Soil Conservation Service's Second Broad River Watershed Project. Plans showing the proposed work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. EDDIE- HOLLAND, Chairman, Room 122 Federal Building, 121 South Main Street, Rutherfordton, North Carolina, 28139, has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIALS INTO THE WATERS OF CATHEYS CREEK TO CONSTRUCT A 41-ACRE, FLOOD CONTROL IMPOUNDMENT WEST OF UNION MILLS, Rutherford County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers. Plans submitted with the application show the proposed construction of a 46-foot high, compacted earth fill dam with a 36-inch concrete conduit on Catheys Creek just downstream of the confluence with Harris Creek. The approximate 111,300 cubic yards of fill material required for construction would be obtained from excavation required for the dam and spillway. The planned permanent pool would have a surface area of 41 acres. A 300-foot-long section of Catheys Creek would be filled for construction of the dam and an additional 7,000 linear feet of stream channel on Catheys and Harris Creeks would be inundated by the project. Approximately 4.5 acres of wetlands would also be inundated by the permanent pool. These wetlands consist primarily of alder shrub swamp and wet meadow that has developed in abandoned pastureland. One small slough-like depression close to the dam site is forested with green ash, red maple and sycamore. As compensation for these wetland losses, the applicant proposes to create a total of approximately 6.1 acres of wetland at various locations around the impoundment. This mitigation proposal is described on sheets 8 through 10 of the project plans. The purpose of this project is to control flooding of downstream agricultural lands. This work is part of the U.S. Department of Agriculture, Soil Conservation Service's Second Broad River Watershed Project. Plans showing the proposed work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (DEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. -2- This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public bearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or ace of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. -3- Generally, the decision whether to issue this Department of the Army permit will not be made until the DEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serve as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina.
