I have provided our responses in blue below. 1) Are the proposed 0.01 permanent impacts a result of above grade fill (permanent wetland with loss) or permanent wetland conversion from forested to herbaceous wetlands (permanent wetland impact with no loss)? The proposed 0.01 acre of permanent impact is wetland conversion from forested to herbaceous wetland and will result in no loss. 2) Can you provide a quick description of the habitat for USFWS within the permit area, so that we can determine the potential for suitable habitat for Michaux's sumac? Sumac survives best in areas where some form of disturbance has provided an open area. Several populations in North Carolina are on the edges of artificially maintained clearings. For example, was the easement maintained to not allow for woody vegetation growth? Were the edges of the easement too competitive to allow for colonization? Is the canopy dense not allowing for sufficient sunlight for sumac growth? Do you recall surveying for sumac species during the delineation? The site is entirely forested except for the roadside on the eastern side of the site and the maintained utility corridor bisecting the site. This roadside has heavy canopy cover over the maintained right of way that inhibits ample sunlight for sumac growth. English Ivy (Hedera helix) was also present along the maintained roadside and was the predominant groundcover species. The utility corridor was maintained, contained only herbaceous vegetation with no evident sumac stems, and had canopy cover from the surrounding trees that allowed for only moderate sunlight into the corridor. The species within the corridor were also highly competitive/invasive species, including Microstegium viminium and Solidago canandensis, and would likely outcompete Michaux's sumac for the limited sunlight. Therefore, we did not consider these areas to be suitable habitat for Michaux's sumac. While we did not perform a formal survey for Michaux's sumac, none were observed during delineation on May 18, 2018 which was within the survey window. The nearest known population of Michaux's sumac is 2.5 miles away. 3) Can you please provide me a copy of the PJD Request that was submitted for this project? Our PJD submittal is attached. (CEI) has completed a delineation of streams and wetlands for a 8.35- acre site off Grove Ave in Wake County, NC. The attached information, including required forms, tables, and figures, is submitted for your review and determination of jurisdiction under the Clean Water Act (CWA). Project Description & Methodology As shown in Figure 1, the proposed project is located in Raleigh, NC within the Neuse River Basin (USGS Hydrologic Unit 03020201) and comprises approximately 8.35 acres. Delineations were performed on May 24, 2018, in compliance with methodology set forth in the U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual (USACE 1987) and subsequent guidance including the Eastern Mountains and Piedmont Regional Supplement. Surface waters were assessed for jurisdiction under the CWA using field indications of ordinary high water mark and the NC Division of Water Quality (NCDWQ) Stream Identification Form Version 4.11. Delineation Results Figure 2 is presented using the Raleigh West (2013) US Geological Survey 1:24,000 Quadrangle Map. Figure 3 presents the results of the delineation, including one stream and three wetlands. Table 1 presents detailed information on each aquatic resource within the study area, including latitude/longitude, estimated amount and type of aquatic resource in the review area, and geographic authority to which the resource may be subject. Based on field data, there are approximately 487 linear feet of perennial stream, and approximately 1.6 acres of wetland. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One) I am requesting that the Corps provide a preliminary JD for the property identified herein. A Preliminary Jurisdictional Determination (PJD) provides an indication that there may be “waters of the United States” or “navigable waters of the United States”on a property. PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all waters and wetlands on the property will be treated as if they are jurisdictional “waters of the United States”. PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is “preliminary” in the sense that an approved JD can be requested at any time. PJDs do not expire. An Approved Jurisdictional Determination (AJD) is a determination that jurisdictional “waters of the United States” or “navigable waters of the United States” are either present or absent on a site.
