Dear Ms. Chapman: On July 24th, and April 19th of 2006, NC DWQ issued both Major and Minor variances for impacts to protected Neuse River Riparian Area Buffers associated with proposed residential construction along Oxford Branch, a tributary of Crabtree Creek in Raleigh NC. Cumulative mitigation for the proposed activities included payment into the NC EEP Program, removal of an existing residential stormwater discharge, planting of native buffer vegetation, the use of porous concrete or gravel for driveway construction, prior approval of a stonnwater and rain garden design for the property, and the placement of deed notifications on future owners. Unforeseen complications (original purchaser backed out unexpectedly) have delayed the proposed activities, and we would like to request an extension for complying with the required mitigation schedules. Payment into the NC EEP Program is complete, and with the exception of planting native buffer vegetation, the remainder of the proposed mitigation is dependent on construction schedules and not calendar deadlines. If it would be possible, please issues my clients (address below) a 12-month extension for planting native hardwood vegetation associated with these variances. This portion will be completed by the purchaser of the properties, prior to conducting any ground disturbing activities.
