After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The project is located in Durham, NC (Durham County) and is 1/2 mile north of Carver Street (SR 1407) on the west side Hillandale Road (SR 1321); as shown on the enclosed vicinity map. The wetland delineation has been reviewed in the field and approved Ms. Jean Manuele of the U.S. Army Corps of Engineers. It will be necessary to impact 0.03 acres (see map) of "waters of the US" for pplacement of -the proposed dam. In order to minimize impacts --dam was p 4 ° 'V located away from vegetated wetlands and aligned to be perpendicular to the wetland channel. The resulting pool will flood a total of 0.32 acres of jurisdictional wetlands and "waters of the US". The subsequent natural conversion of the pond margin and areas upstream of the pool to wetland will offset losses caused by construction. Although a sedimentation and erosion plan will be installed to preserve water quality, the lake will provide additional benefits. Water storage, recreation, pollutant removal and aquatic habitat values will significantly increase. Absolutely all vegetated wetland areas that will be impacted are dominated by multiflora rose and other exotic plant species. The DEM rating value for all wetlands on the property were very low. (See attached forms.) The construction of this project will actually increase those values, especially from a water quality standpoint.
