The North Carolina Department of Transportation (NCDOT) will hold a
Public Meeting on Monday, October 8, 2007 between the hours of 4:00 p.m. and
7:00 p.m. at the Belville Elementary School Cafeteria located at 575 River Road
SE, Leland, 28451.
NCDOT representatives will be available in an informal setting to answer
questions and receive comments relative to the proposed project. Interested
individuals may attend this informal workshop at their convenience during the
above stated hours. Please note there will be no formal presentation.
The purpose of this meeting is to present information, answer questions,
and receive comments regarding the proposed design modifications to this project.
NCDOT in cooperation with the Town of Leland proposes to widen Village Road
(SR 1472) from Old Fayetteville Road (SR 1437) / Navassa Road (SR 1435) to the
US 17 Ramps. Village Road (SR 1472) is proposed to become a four-lane median
divided roadway with curb & gutter. Additional right of way on only one parcel will
be required to accommodate the proposed improvements.
A map setting forth the location and design of the project are available for
public review at the Leland Town Hall, 102 Town Hall Drive, Leland, 28451; and at
the NCDOT - Division Office, 300 Division Drive, Wilmington, 28401.

at 991 South Winstead Avenue, Rocky Mount, 27804.

questions and receive comments relative to the proposed project. The

NCDOT proposes to widen SR 1616 (Country Club Road) from US 64
Business (Buck Leonard Boulevard) to SR 1541 (Jeffreys Road). The project
proposes to upgrade Country Club Road from a two-lane roadway to a five-lane
curb and gutter roadway. Additional right of way and the relocation of homes and
businesses will be required for this project.
A map showing the location of the project and a copy of the environmental
document- Environmental Assessment - are available for public review at the
Rocky Mount Engineering Department located on the second floor of City Hall,
331 South Franklin Street, Rocky Mount, 27802 and at the NCDOT District

above workshop on September 13, 2007, 5:00 p.m. to 7:00 p.m. in the Liberty
Middle School Atrium, 529 Enola Road, Morganton, 28655.

convenience during the above stated hours. Department of Transportation
representatives will be present to answer questions and receive comments
relative to the proposed project. The primary purpose of the meeting is to provide
an opportunity for comment on the Interstate 40 Interchange options.
NCDOT proposes to widen existing Enola Road from Arnold Drive to
NC 18 (South Sterling Street). Based on public input from the February 2006
Citizens' Informational Workshop and engineering studies that have been
conducted, the proposed improvements will include a four-lane, median divided
roadway from NC 18 (South Sterling Street) to south of the J. Iverson Riddle

Two options currently being evaluated for the 1-40 interchange are 1) East
Option: widen the bridge over 1-40 to the east of its current location and 2) West
Option: widen the bridge over 1-40 to the west of its current location. Additional
right of way will be required to accommodate either directional shift for the
proposed improvements along Enola Road.

The North Carolina Department of Transportation (NCDOT) will hold a Pre-
Hearing Open House and a Combined Public Hearing on Monday, October 22, 2007
in the Graham Middle School Auditorium, 311 East Pine Street, Graham, 27253.
NCDOT representatives will be available at the Pre-Hearing Open House
between the hours of 4:30 p.m. and 6:30 p.m. to answer questions and receive
comments relative to the proposed project. The opportunity to submit written
comments or questions will also be provided. Interested citizens may attend at
any time during the above mentioned hours.
A formal presentation will begin at 7:00 p.m. The presentation will consist of
an explanation of the proposed location, design, the state - federal relationship,
and right-of-way and relocation requirements and procedures. The hearing will be
open to those present for statements, questions and comments. The presentation
and comments will be recorded and a transcript will be prepared.
NCDOT proposes to relocate the mainline track on the-Norfolk-Southern
Railroad and add a siding track between Pomeroy Street in Graham and the
railroad bridge at Haw River. At times during construction the crossing at
Pomeroy Street may be closed. Additional right of way and the relocation of
homes and businesses will be required for this project.
A map displaying the location and design of the project and a copy of the
environmental document - Environmental Assessment (EA) - will be available for
public review at the City of Graham Planning Department located at 201 South
Main Street, Graham and at the NCDOT District Office located at 127 East
Crescent Square Drive, Graham.

Wildlife Service (Service) with the biological determination of the North Carolina Department of
Transportation that the replacement of Bridge No. 7 on SR 1250 over the Tar River in
Edgecombe County (TIP No. B-4503) may affect, but is not likely to adversely affect the
federally endangered Tar River spinymussel (Elliptio steinstansana). These comments are
provided in accordance with section 7 of the Endangered Species Act (ESA) of 1973, as
amended (16 U.S.C. 1531-1543).
According to information provided, a mussel survey was conducted at the project site on August
30, 2006. The survey extended 100 meters upstream and 400 meters downstream of SR 1250.
Although several mussels representing four species were observed, no Tar River spinymussels
were observed. Based on the survey results and other information available, the Service concurs
with your determination that the proposed project may affect, but is not likely to adversely affect
the Tar River spinymussel. We believe that the requirements of section 7(a)(2) of the ESA have
been satisfied. We remind you that obligations under section 7 consultation must be
reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered in this review; (2) this
action is subsequently modified in a manner that was not considered in this review; or (3) a new
species is listed or critical habitat determined that may be affected by this identified action.

the NC Division of Water Quality 303d list of degraded streams.
Based on the survey results and other information available, the Service concurs with your
determination that the proposed project may affect, but is not likely to adversely affect the dwarf
wedgemussel and Tar River spinymussel. We believe that the requirements of section 7(a)(2) of
the ESA have been satisfied. We remind you that obligations under section 7 consultation must

Transportation (NCDOT) that the replacement of Bridge No. 142 on SR 1315 over an unnamed
tributary to Little Fishing Creek in Halifax County (TIP No. B-4540) may affect, but is not likely
to adversely affect the federally endangered dwarf wedgemussel (Alasmidonta heterodon). In
addition, NCDOT has determined that the project will have no effect on the federally endangered
red-cockaded woodpecker (Picoides borealis) and Tar spinymussel (Elliptio steinstansana).
These comments are provided in accordance with section 7 of the Endangered Species Act
(ESA) of 1973, as amended (16 U.S.C. 1531-1543).
According to information provided, a mussel survey was conducted at the project site on August
4, 2005. No specimens of dwarf wedgemussel were observed, and only five specimens of the
common Elliptio complanata were observed. Poor quality habitat was observed at the bridge.
However, dwarf wedgemussels were observed in good habitat approximately 2.5 miles upstream
in Warren County during a separate survey on August 4, 2005. No habitat for Tar spinymussel
was observed in either survey.
It is understood from an email received from Amy James of NCDOT on 8/28/2007 that an off-
site detour will be used during bridge construction, that the existing 41 feet long bridge will be
replaced with an 80 feet long bridge that spans the channel and part of the floodplain, and that at
least some of the existing causeway will be removed from the floodplain.
Based on the mussel survey results and other available information, the Service concurs with
your determination that the bridge replacement may affect, but is not likely to adversely affect
the dwarf wedgemussel. Also, due to the lack of habitat, the Service concurs with your
determination that the project will have no effect on the red-cockaded woodpecker and Tar
spinymussel. We believe that the requirements of section 7(a)(2) of the ESA have been satisfied.
We remind you that obligations under section 7 consultation must be reconsidered if.- (1) now
information reveals impacts of this identified action that may affect listed species or critical
habitat in a manner not previously considered in this review; (2) this action is subsequently

The North Carolina Department of Transportation will hold the above
Design Public Hearing on September 24, 2007 between the hours of 4:00 p.m.
and 7:00 p.m. in the cafeteria of Bethesda Baptist Church located at 1914 South
Miami Boulevard, Durham.
Department of Transportation representatives will be available in an
informal setting between the hours of 4:00 p.m. and 7:00 p.m. to answer
questions and receive comments relative to the project. The opportunity to
submit written comments or questions also will be provided. Interested citizens
may attend at any time during the above mentioned hours. This project is
federally funded.
NCDOT proposes to widen SR 1959 (South Miami Boulevard) to five
lanes to provide a center turn lane from south of SR 2112 (Methodist Street) to
north of SR 1960 (Bethesda Avenue) in Durham. This project will include
sidewalks on both sides of the roadway and wide outside lanes to accommodate
bicycles. Improvements are needed to improve the operational efficiency of
South Miami Boulevard and the intersection with SR 1954 (Ellis Road), and
improve safety for motorists, pedestrians, and bicyclists in the project area.
Additional right of way will be required to accommodate the proposed
improvements.

The North Carolina Department of Transportation (NCDOT) will hold a Pre-
Hearing Open House and a Combined Public Hearing on Monday, September 17, 2007
at West Montgomery High School located at 147 Warrior Drive, Mount Gilead.
NCDOT representatives will be available at the Pre-Hearing Open House
between the hours of 4:00 p.m. and 6:30 p.m. to answer questions and receive
comments relative to the proposed project. The opportunity to submit written comments
or questions will also be provided. Interested citizens may attend at any time during the
above mentioned hours.
A formal presentation will begin at 7:00 p.m. The presentation will consist of an
explanation of the proposed location, design, the state - federal relationship, and right of
way and relocation requirements and procedures. The hearing will be open to those
present for statements, questions and comments. The presentation and comments will
be recorded and a transcript will be prepared.
NCDOT proposes to construct a new four-lane, median-divided bypass south of
downtown Troy. The project limits extend from NC 24/27 just west of SR 1138 (Dairy
Road)/SR 1550 (Saunders Road) to just east of the Little River. The purpose of the
project is to reduce traffic volumes and improve safety through the Town of Troy. The
project length is about 6.0 miles. Additional right of way and the relocation of homes and
businesses will be required for this project.

environmental document - Environmental Assessment (EA) - are available for public
review at the Town of Troy Public Works Department located at 610 North Main Street,

This office has reviewed the referenced document dated August 8, 2007. The Division of Water Quality
(DWQ) is responsible for the issuance of the Section 401 Water Quality Certification for activities that
impact Waters of the U.S., including wetlands. It is our understanding that the project as presented will
result in impacts to jurisdictional wetlands, streams, and other surface waters. The DWQ offers the
following comments based on review of the aforementioned document:
This project is being planned as part of the 404/NEPA Merger Process. As a participating team
member, the NCDWQ will continue to work with the team.
2. Little Buffalo Creek and its tributaries are class C; Tr waters of the State. DWQ
recommends that the most protective sediment and erosion control BMPs be implemented
to reduce the risk of turbidity violations in trout waters. In addition, all disturbances within
trout buffers shall be conducted in accordance with NC Division of Land Resources and NC
Wildlife Resources Commission requirements.
The environmental document shall provide a detailed and itemized. presentation of the proposed
impacts to wetlands and streams with corresponding mapping. If mitigation is necessary as required
by 15A NCAC 214.0506(h), it is preferable to present a conceptual (if not finalized) mitigation plan
with the environmental documentation. Appropriate mitigation plans will be required prior to
issuance of a 401 Water Quality Certification.
4. Environmental assessment alternatives shall consider design criteria that reduce the impacts to
streams and wetlands from storm water runoff. These alternatives shall include road designs that
allow for treatment of the storm water runoff through best management practices as detailed in the
most recent version of NC DWQ Stormwater Best Management Practices, such as grassed swales,
buffer areas, preformed scour holes, retention basins, etc.

After the selection of the preferred alternative and prior to an issuance of the 401 Water Quality
Certification, the NCDOT is respectfully reminded that they will need to demonstrate the avoidance
and minimization of impacts to wetlands (and streams) to the maximum extent practical. In
accordance with the Environmental Management Commission's Rules {1 5A NCAC 2H.0506(h)},
mitigation will be required for impacts of greater than 1 acre to wetlands. In the event that
mitigation is required, the mitigation plan should be designed to replace appropriate lost functions
and values. The NC Ecosystem Enhancement Program may be available for use as wetland
mitigation.
6. In accordance with the Environmental Management Commission's Rules {I SA NCAC
2H.0506(h)}, mitigation will be required for impacts of greater than 150 linear feet to any single
perennial stream. In the event that mitigation is required, the mitigation plan shall be designed to
replace appropriate lost functions and values. The NC Ecosystem Enhancement Program may be
available for use as stream mitigation.
7. Future documentation, including the 401 Water Quality Certification Application, should continue
to include an itemized listing of the proposed wetland and stream impacts with corresponding
mapping.
8. DWQ is very concerned with sediment and erosion impacts that could result from this project. NC
DOT shall address these concerns by describing the potential impacts that may occur to the aquatic
environments and any mitigating factors that would reduce the impacts.
9. NC DOT is respectfully reminded that all impacts, including but not limited to, bridging, fill,
excavation and clearing, to jurisdictional wetlands, streams, and riparian buffers need to be included
in the final impact calculations. These impacts, in addition to any construction impacts, temporary
or otherwise, also need to be included as part of the 401 Water Quality Certification Application.
10. Where streams must be crossed, the DWQ prefers bridges be used in lieu of culverts. However, we
realize that economic considerations often require the use of culverts. Please be advised that
culverts shall be countersunk to allow unimpeded passage by fish and other aquatic organisms.
Moreover, in areas where high quality wetlands or streams are impacted, a bridge may prove
preferable. When applicable, DOT should not install the bridge bents in the creek, to the maximum
extent practicable.
11. Sediment and erosion control measures shall not be placed in wetlands or streams.
12. Borrow/waste areas shall avoid wetlands to the maximum extent practical. Impacts to wetlands in
borrow/waste areas will need to be presented in the 401 Water Quality Certification and could
precipitate compensatory mitigation.
13. The 401 Water Quality Certification application will need to specifically address the proposed
methods for stormwater management. More specifically, stormwater shall not be permitted to
discharge directly into streams or surface waters.
14. Based on the information presented in the document, the magnitude of impacts to wetlands and
streams may require an Individual Permit (IP) application to the Corps of Engineers and
corresponding 401 Water Quality Certification. Please be advised that a 401 Water Quality
Certification requires satisfactory protection of water quality to ensure that water quality standards
are met and no wetland or stream uses are lost. Final permit authorization will require the submittal
of a formal application by the NCDOT and written concurrence from the NCDWQ. Please be
aware that any approval will be contingent on appropriate avoidance and minimization of wetland
and stream impacts to the maximum extent practical, the development of an acceptable stormwater
...management plan, -and the inclusion of_appropriate _mitigation.plans_where_ appropriate.. _ _ . . __.
15. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact
between curing concrete and stream water. Water that inadvertently contacts uncured concrete shall
not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and
fish kills.
16. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction
contours and elevations. Disturbed areas shall be seeded or mulched to stabilize the soil and
appropriate native woody species shall be planted. When using temporary structures the area shall
be cleared but not grubbed. Clearing the area with chain saws, mowers, bush-hogs, or other
mechanized equipment and leaving the stumps and root mat intact allows the area to re-vegetate
naturally and minimizes soil disturbance.
17. Placement of culverts and other structures in waters, streams, and wetlands shall be placed below
the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow
low flow passage of water and aquatic life. Design and placement of culverts and other structures
including temporary erosion control measures shall not be conducted in a manner that may result in
dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the
above structures. The applicant is required to provide evidence that the equilibrium is being
maintained if requested in writing by DWQ. If this condition is unable to be met due to bedrock or
other limiting features encountered during construction, please contact the NC DWQ for guidance
on how to proceed and to determine whether or not a permit modification will be required.
18. If multiple pipes or barrels are required, they shall be designed to mimic natural stream cross section
as closely as possible including pipes or barrels at flood plain elevation and/or sills where
appropriate. Widening the stream channel shall be avoided. Stream channel widening at the inlet or
outlet end of structures typically decreases water velocity causing sediment deposition that requires
increased maintenance and disrupts aquatic life passage.
19. If foundation test borings are necessary; it shall be noted in the document. Geotechnical work is
approved under General 401 Certification Number 3494/Nationwide Permit No. 6 for Survey
Activities.
20. Sediment and erosion control measures sufficient to protect water resources must be implemented
and maintained in accordance with the most recent version of North Carolina Sediment and Erosion
Control Planning and Design Manual and the most recent version of NCS000250. .
21. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP
measures from the most current version of NCDOT Construction and Maintenance Activities
manual such as sandbags, rock berms, cofferdams and other diversion structures shall be used to
prevent excavation in flowing water.
22. While the use of National Wetland Inventory (NWI) maps, NC Coastal Region Evaluation of
Wetland Significance (NC-CREWS) maps and soil survey maps are useful tools, their inherent
inaccuracies require that qualified personnel perform onsite wetland delineations prior to permit
approyal_
23. Heavy equipment shall be operated from the bank rather than in stream channels in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into streams. This
equipment should be inspected daily and maintained to prevent contamination of surface waters
from leaking fuels, lubricants, hydraulic fluids, or other toxic materials.
24. Riprap shall not be placed in the active thalweg channel or placed in the streambed in a manner that
precludes aquatic life passage. Bioengineering boulders or structures shall be properly designed,
sized and installed.
25. Riparian vegetation (native trees and shrubs) shall be preserved to the maximum extent possible.
Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.

Recent studies conducted in the mountain regions of NC have shown improved sediment and
erosion control using coir fiber logs and straw wattles. These measures should be used to control
turbid runoff from the construction site where practicable.
2. DWQ has concerns regarding the potential for acidic rock in the project corridor. Pre-
construction geotechnical testing should be conducted for the presence of acidic rock. If any
acidic rock is found, efforts should be made to avoid and minimize disturbance of these areas. As
part of the 401 Water Quality Certification, DWQ will require a treatment and mitigation plan for
handling and disposing of acidic rock.
3. DWQ has concerns with the parallel orientation of Teeoatlah Branch and Snowbird Creek to the
proposed project. Improvements to NC 143 should be conducted to avoid and minimize impacts
to Teeoatlah Branch and Snowbird Creek and associated tributaries and wetlands as much as
possible. This may include but is not limited to widening to the roadside opposite of the streams,
steeper fill slopes, and retaining walls.

approved by NC DWQ. Approved BMP measures from the most current version of NCDOT
Construction and Maintenance Activities manual such as sandbags, rock berms, cofferdams and
other diversion structures should be used to prevent excavation in flowing water.
17. Sediment and erosion control measures shall not be placed in wetlands and streams.
18. Borrow/waste areas shall avoid wetlands to the maximum extent practical. Impacts to wetlands
in borrow/waste areas could precipitate compensatory mitigation.
19. While the use of National Wetland Inventory (NWI) maps, NC Coastal Region Evaluation of
Wetland Significance (NC-CREWS) maps and soil survey maps are useful tools, their inherent
inaccuracies require that qualified personnel perform onsite wetland delineations prior to permit
approval.

The alternatives under consideration at this time for each of these bridge replacement
projects are as follows:
B-4522 The proposed project consists of replacing Bridge no. 102 on Goochs Mill
Road, spanning the Tar river in Granville County. Two design alternatives
are proposed for this project: 1) Replace the bridge at the existing location
with a new structure. During construction, traffic will be maintained by an
offsite detour. 2) Replace the bridge downstream (east) of the existing
structure. During construction, traffic will be maintained by an offsite
detour.
B-4600 The proposed project consists of replacing Bridge No. 43 on Chalrie Long
Road, spanning the South flat River in Person. Two design alternatives
are proposed for this project: 1) Replace the bridge at the existing location
with a new structure. During construction, traffic will be maintained by an
offsite detour. 2) Replace the bridge downstream (north) of the existing
structure. During construction, traffic will be maintained by an offsite
detour.

This office has reviewed the referenced document. The Division of Water Quality (DWQ) is responsible for the
issuance of the Section 401 Water Quality Certification for activities that impact Waters of the U.S., including
wetlands. The DWQ offers the following comments based on review of the aforementioned document:
A) Based on the document, no jurisdictional streams and/or wetlands exist within the project area. If the
project limits change and jurisdictional streams and/or wetlands will be affected, a 401 Water Quality
Certification will be required. A 401 Water Quality Certification requires satisfactory protection of water
quality to ensure that water quality standards are met. Final permit authorization will require the submittal
of a formal application by the NCDOT and written concurrence from the NCDWQ.
B) A 401 Water Quality Certification application will need to specifically address the proposed methods for
stormwater management. More specifically, stormwater should not be permitted to discharge directly into
streams or surface waters.
C) Borrow/waste areas should avoid wetlands to the maximum extent practicable. Impacts to wetlands in
borrow/waste areas could precipitate compensatory mitigation.
D) Sediment and erosion control measures should not be placed in wetlands.

Reference your correspondence dated September 19, 2007, in which you requested comments for the
referenced project. Preliminary analysis of the project reveals the potential for multiple impacts to perennial
streams and jurisdictional wetlands in the project area. More specifically, impacts to:

Further investigations at a higher resolution should be undertaken to verify the presence of other streams
and/or jurisdictional wetlands in the area. In the event that any jurisdictional areas are identified, the Division
of Water Quality requests that NCDOT consider the following environmental issues for the proposed project:
General Project Comments:
1. The environmental document shall provide a detailed and itemized presentation of the proposed
impacts to wetlands and streams with corresponding mapping. If mitigation is necessary as required by
15A NCAC 21-1.0506(h), it is preferable to present a conceptual (if not finalized) mitigation plan with the
environmental documentation. Appropriate mitigation plans will be required prior to issuance of a 401
Water Quality Certification.
2. Environmental assessment alternatives shall consider design criteria that reduce the impacts to
streams and wetlands from storm water runoff. These alternatives shall include road designs that allow
for treatment of the storm water runoff through best management practices as detailed in the most
recent version of NC DWQ Stormwater Best Management Practices, such as grassed swales, buffer
areas, preformed scour holes, retention basins, etc.
3. After the selection of the preferred alternative and prior to an issuance of the 401 Water Quality
Certification, the NCDOT is respectfully reminded that they will need to demonstrate the avoidance and
minimization of impacts to wetlands (and streams) to the maximum extent practical. In accordance
with the Environmental Management Commission's Rules {15A NCAC 2H.0506(h)}, mitigation will be
required for impacts of greater than 1 acre to wetlands. In the event that mitigation is required, the
mitigation plan shall be designed to replace appropriate lost functions and values. The NC Ecosystem
Enhancement Program may be available for use as wetland mitigation.

4. In accordance with the Environmental Management Commission's Rules {15A NCAC 2H.0506(h)),
mitigation will be required for impacts of greater than 150 linear feet to any single perennial stream. In
the event that mitigation is required, the mitigation plan shall be designed to replace appropriate lost
functions and values. The NC Ecosystem Enhancement Program may be available for use as stream
mitigation.
5. DWQ is very concerned with sediment and erosion impacts that could result from this project. NC DOT
shall address these concerns by describing the potential impacts that may occur to the aquatic
environments and any mitigating factors that would reduce the impacts.
6. Bridge supports (bents) shall not be placed in the stream when possible.
7. Whenever possible, the DWQ prefers spanning structures. Spanning structures usually do not require
work within the stream or grubbing of the streambanks and do not require stream channel realignment.
The horizontal and vertical clearances provided by bridges allow for human and wildlife passage
beneath the structure, do not block fish passage and do not block navigation by canoeists and boaters.
8. Bridge deck drains shall not discharge directly into the stream. Stormwater shall be directed across the
bridge and pre-treated through site-appropriate means (grassed swales, pre-formed scour holes,
vegetated buffers, etc.) before entering the stream. Please refer to the most current version of NC
DWQ Stormwater Best Management Practices.
9. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact
between curing concrete and stream water. Water that inadvertently contacts uncured concrete shall
not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and
fish kills_
10. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction
contours and elevations. Disturbed areas shall be seeded or mulched to stabilize the soil and
appropriate native woody species should be planted. When using temporary structures the area shall
be cleared but not grubbed. Clearing the area with chain saws, mowers, bush-hogs, or other
mechanized equipment and leaving the stumps and root mat intact allows the area to re-vegetate
naturally and minimizes soil disturbance.
11. Placement of culverts and other structures in waters, streams, and wetlands shall be below the
elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20
percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow
passage of water and aquatic life. Design and placement of culverts and other structures including
temporary erosion control measures shall not be conducted in a manner that may result in dis-
equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above
structures. The applicant is required to provide evidence that the equilibrium is being maintained if
requested in writing by DWQ. If this condition is unable to be met due to bedrock or other limiting
features encountered during construction, please contact the NC DWQ for guidance on how to proceed
and to determine whether or not a permit modification will be required.
12. If multiple pipes or barrels are required, they shall be designed to mimic natural stream cross section as
closely as possible including pipes or barrels at flood plain elevation and/or sills where appropriate.
Widening the stream channel shall be avoided. Stream channel widening at the inlet or outlet end of
structures typically decreases water velocity causing sediment deposition that requires increased
maintenance and disrupts aquatic life passage.
13. If foundation test borings are necessary; it should be noted in the document. Geotechnical work is
approved under General 401 Certification Number 3494/Nationwide Permit No. 6 for Survey Activities.

14. Sediment and erosion control measures sufficient to protect water resources must be implemented and
maintained in accordance with the most recent version of North Carolina Sediment and Erosion Control
Planning and Design Manual and the most recent version of NCS000250.
15. All work in or adjacent to stream waters shall be conducted in a dry work area unless otherwise
approved by NC DWQ. Approved BMP measures from the most current version of NCDOT
Construction and Maintenance Activities manual such as sandbags, rock berms, cofferdams and other
diversion structures should be used to prevent excavation in flowing water.
16. Sediment and erosion control measures shall not be placed in wetlands and streams.
17. Borrow/waste areas shall avoid wetlands to the maximum extent practical. Impacts to wetlands in
borrow/waste areas could precipitate compensatory mitigation.
18. While the use of National Wetland Inventory (NWI) maps, NC Coastal Region Evaluation of Wetland
Significance (NC-CREWS) maps and soil survey maps are useful tools, their inherent inaccuracies
require that qualified personnel perform onsite wetland delineations prior to permit approval.
19. Heavy equipment shall be operated from the bank rather than in stream channels in order to minimize
sedimentation and reduce the likelihood of introducing other pollutants into streams. This equipment
shall be inspected daily and maintained to prevent contamination of surface waters from leaking fuels,
lubricants, hydraulic fluids, or other toxic materials.
20. In most cases, the DWQ prefers the replacement of the existing structure at the same location with
road closure. If road closure is not feasible, a temporary detour should be designed and located to
avoid wetland impacts, minimize the need for clearing and to avoid destabilizing stream banks. If the
structure will be on a new alignment, the old structure shall be removed and the approach fills removed
from the 100-year floodplain. Approach fills should be removed and restored to the natural ground
elevation. The area shall be stabilized with grass and planted with native tree species. Tall fescue
shall not be used in riparian areas.
21. Riprap shall not be placed in the active thalweg channel or placed in the streambed in a manner that
precludes aquatic life passage. Bioengineering boulders or structures should be properly designed,
sized and installed.

Certification requires that appropriate measures be instituted to ensure that water quality standards are met

On august 30-31. 1994, NCDOT Environmental Unit Specialists,
Cyndi Bell, Robin Little and Eric Penley, with members of the
NCDOT Dive Team, Bill Lutz and Eric Basinger, performed a
submerged aquatic vegetation (SAV) survey in the proposed
impact areas associated with the relocation/replacement of
the John. Lawson Bridge on the Neuse River and widening of the a
Freedom Memoria.1 Bridge on the.Trent River.
METHODOLOGY
Survey methodology followed that which has been suggested by
the National Marine Fisheries Service, and which was applied
to assess SAV impacts at the.Wright Memorial Bridge site in
Currituck and Dare Counties.
Transects were run perpendicular to the shoreline at .10 meter
intervals within the temporary constructs on zones and within
the permanent construction limits. In most cases, the center
transect fell under the centerline, or began to one side of
the existing bridge within the construction easement. (See
diagrams for site locations.)
Information was collected along each transect. at 10 meter
intervals, starting at the shoreline. :A 1 meter square grid,
subdivided into.sixteen 25 cm by 25 cm subplots, was placed
on the river bottom at each sample point. The number of sub-
plots containing SAV were recorded, as was the species
composition, blade length and water depth. This information
was collected until three consequtive.empty plots were
encountered. or until the water depth reached ;:ppro.ximately

Sample points within the sample plots were numbered in the
order which they were sampled and each transect was labeled
with a consequtive letter. Thus, Site 2 had three sample
areas represented by 2Al through 2VS, where 2A-L represent
the sample area and corresponding tran sects where Ramp DB and
the "L" line intersect with.'the shore, according to stakes .

RESULTS
Areas of S:AV impacts Eire indicated on the attached maps., with
the areas mapped shown in relation.to the proposed.
construction. The total area of SAV mapped was approximately
5:3 acres. The Lawson Creek and Scotts Creek areas had such
dense SAV that it was not possible to count within the grid.
so 100'o coverage was assumed. Impacts' were calculated as 1000
of the mapped areas beneath both permanent and temporary

south side of the new bridge over the Neuse River. 2A
through 2L include the mainline, 2M through 2Q include ramp
DC, and 2R through 2V include ramp DA..

the N.C. Department of Transportation (DOT) in accordance with the following conditions of
CAMA Permit No. 81-95:
16) During the construction'phases of this project, the DOT will monitor and record all
impacts to submerged aquatic vegetation (SAV) habitat that.occurs as a result of the
permitted activity.
17) Prior to the expiration date of this permit, the DOT will develop and implement an
approved mitigation plan to compensate for SAV losses associated with this project. The
plan will be coordinated with and approved by the National Marine Fisheries Service, the
N.C. Division of Coastal Management, the N.C. Division of Marine Fisheries and the
U.S. Army Corps of Engineers.

The following memorandum provides the, results of a submersed aquatic vegetation (SAV) survey
for the subject project. The survey was conducted on June 5, 2001 by NCDOT environmental
biologists Bruce Ellis and Mary Frazer; and members of the NCDOT dive team, Bill Lotz and
Allen Hancock to determine impacts to SAVs as a result of the subject project, Supplemental
surveys were conducted by Ellis and Frazer on June 27 to look at nearby SAY growth for
comparison, and on October 27 to complete the survey at Lawson Creek.
Previous surveys were conducted in August 1994, prior to project construction; June 1996,- after
construction was initiated; August 2000, after construction was complete -and June, 2001.
Surveys between 1996 and 2000 were disrupted by inclement.weather (i.e., hurricanes).
METHODOLOGY
Survey methodology followed procedures outlined in the above referenced memorandum.
Briefly, transects were run perpendicular to the shoreline at ten meter intervals within the
temporary construction zones and permanent construction limits.. A one meter square grid, which
was subdivided into nine-33 cm by 33 cm subplots, was then placed on the river bottom at ten
meter intervals along each transect. SAV species present within the one-meter square grid were
identified, and percent cover within the grid was determined for each sample location. Survey
work was conducted using contaminated water protocol, to minimize exposure to water-born
pathogens. Vegetation from each sample plot was collected and identified according to Godfrey
and Wooten (1981) and Fassett (1975).
Care was taken in the survey to establish the wansects at the same locations as the August 1994 and
June 1996 surveys. However, there were four exceptions, listed below.
1. In 1996, five additional transects were established on the western shoreline of the Neuse River at
loop BA and ramp CD. These transects are identified as 2A'-2E'.
2. Site four was not sampled in 1996, 2000 or 2001 due.to shallow water depths and a substrate
of extremely soft muck, which prohibited divers from working safely in the area.
RESULTS
Results of the regular 2001 survey are included in. Table 1. The results of the August 1994,
June 1996 and August 2000 surveys are also included in the table for comparison. Sample
locations depicted in Figure 1. Two SAV species were identified during the course of the survey:
A. Tapegrass (Vallisneria americana)
B. Horned pondweed (Zannichellia palustris)
The tapegrass averaged 1-2 feet in height, while the homed pondweed was no. more than
eight to ten inches high. During the June 2001 survey, water salinity was 1.5 ppt (vs. 2.8 ppt the
previous August) in the Neuse River and the Trent River,. and secchi depth was four feet in the
Neuse, the same as the previous year.
The June 1996 survey identified coontail (Ceratophyllum demersum) in addition to the two
species above, but only in Lawson Creek. No SAV's were found at the Lawson Creek site (site
1) during the August 2000 survey at the bridge location, nor were any SAV's seen within 100 feet
up or down. the shoreline from the bridge.
The August 1994 survey identified tapegrass and either coontail or homed pondweed, which.
were misidentified as eelgrass (Zostera sp.) and milfoil (Afyriophyllum sp.).
RESULTS FROM SUPPLEMENTAL SAMPLING AREAS, 2001
1) Lawson Creek was examined, but no vegetation. was present in the creek. The water was
slightly turbid; a loose silty substrate was present. The creek south of the bridge was
examined until the channel splits, a distance of at least 75 meters: only detritus and leaves
were found in the creek. The water depth was 0.60-1.2 meters.
2) The cove north of Union Point contained a small sandy beach about 23 meters long, while
most adjacent areas of shoreline contained low seawalls. No SAVs were found. The water
was clear and one meter deep at about 18 meters out from the shoreline.
3) SAVs in the Neuse River, near the confluence with the Trent River, were sampled with the
first transect 30 meters north of northern edge of the new bridge; the.following transects were
.40 in north, 50 m north, etc. Tapegrass was found in all of the sample plots between 10 and
40 in from the shoreline. Results of this survey are present in Table 4.
4) Marsh vegetation along the Trent River bridge was examined. Data are presented in Tables 5
and 6. The results of the survey indicate that vegetation is re-establishing on the site,
however, the vegetation that is present is of a much smaller type than the surrounding marsh.
The marsh in vicinity of the bridge is dominated by cattail (Typha latifolia) and giant cord
grass, (Spa?Wna cynosuroldes). Since the vegetation in the footprint of the workbridges is of a
smaller type than the surrounding marsh, the footprints of the work bridges are very
apparent.
No homed pondweed was found in the supplmental SAV sampling areas, nor was any found
washed up on"shore or observed casually. It appears that homed pondweed has been removed
from the New Bem area due. to regional environmental factors, rather than bridge construction.

General Comments Regarding Bridge Replacement Projects
1. DWQ is very concerned with sediment and erosion impacts that could result from this project. NCDOT should
address these concerns by describing the potential impacts that may occur to the aquatic environments and any
mitigating factors that would reduce the impacts.
2. If foundation test borings are necessary, it should be noted in the document. Geotechnical work is approved under
General 401 Certification Number 3494/Nationwide Permit No. 6 for Survey Activities.
3. If a bridge is being replaced with a hydraulic conveyance other than another bridge, DWQ believes the use of a
Nationwide Permit may be required. Please contact the US Army Corp of Engineers to determine the required
permit(s).
4. If the old bridge is removed, no discharge of bridge material into surface waters is allowed unless otherwise
authorized by the US ACOE. Strict adherence to the Corps of Engineers guidelines for bridge demolition will be a
condition of the 401 Water Quality Certification.
5. Whenever possible, the DWQ prefers spanning structures. Spanning structures usually do not require work within
the stream or grubbing of the stream banks and do not require stream channel realignment. The horizontal and
vertical clearances provided by bridges allow for human and wildlife passage beneath the structure, do not block fish
passage and do not block navigation by canoeists and boaters.
6. Bridge deck drains should not discharge directly into the stream. Storm water should be directed across the bridge
and pre-treated through site-appropriate means (grassed swales, pre-formed scour holes, vegetated buffers, etc.)
before entering the stream. Please refer to the most current version of NC DWQ Storm Water Best Management
Practices.
7. If concrete is used during construction, a dry work area should be maintained to prevent direct contact between
curing concrete and stream water. Water that inadvertently contacts uncured concrete should not be discharged to
surface waters due to the potential for elevated pH and possible aquatic life and fish kills.
8. Bridge supports (bents) should not be placed in the stream when possible.
9. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction contours and
elevations. Disturbed areas should be seeded or mulched to stabilize the soil and appropriate native woody species
should be planted. When using temporary structures the area should be cleared but not grubbed. Clearing the area
with chain saws, mowers, bush-hogs, or other mechanized equipment and leaving the stumps and root mat intact
allows the area to re-vegetate naturally and minimizes soil disturbance.
10. Sediment and erosion control measures sufficient to protect water resources must be implemented and maintained in
accordance with the most recent version of North Carolina Sediment and Erosion Control Planning and Design
Manual and the most recent version of NCS000250.
11. All work in or adjacent to stream waters should be conducted in a dry work area unless otherwise approved by NC
DWQ. Approved BMP measures from the most current version ofNCDOT Construction and Maintenance
Activities manual such as sandbags, rock berms, cofferdams and other diversion structures should be used to prevent
excavation in flowing water.
12. Heavy equipment should be operated from the bank rather than in stream channels in order to minimize
sedimentation and reduce the likelihood of introducing other pollutants into streams. This equipment should be
inspected daily and maintained to prevent contamination of surface waters from leaking fuels, lubricants, hydraulic
fluids, or other toxic materials.

13. In most cases, the DWQ prefers the replacement of the existing structure at the same location with road closure. If
road closure is not feasible, a temporary detour should be designed and located to avoid wetland impacts, minimize
the need for clearing and to avoid destabilizing, stream banks. If the structure will be on a new alignment, the old
structure should be removed and the approach fills removed from the 100-year floodplain. Approach fills should be
removed and restored to the natural ground elevation. The area should be stabilized with grass and planted with
native tree species. Tall fescue should not be used in riparian areas.
General Comments if Replacing the Bridge with a Culvert
1. Placement of culverts and other structures in waters, streams, and wetlands shall be below the elevation of the
streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter
for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. Design and
placement of culverts and other structures including temporary erosion control measures shall not be conducted in a
manner that may result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down
stream of the above structures. The applicant is required to provide evidence that the equilibrium is being
maintained if requested in writing by DWQ. If this condition is unable to be met due to bedrock or other limiting
features encountered during construction, please contact the NC DWQ for guidance on how to proceed and to
determine whether or not a permit modification will be required.
2. If multiple pipes or barrels are required, they should be designed to mimic the natural stream cross section as closely
as possible including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the stream
channel should be avoided. Stream channel widening at the inlet or outlet end of structures typically decreases
water velocity causing sediment deposition that requires increased maintenance and disrupts aquatic life passage.
Riprap should not be placed in the active thalweg channel or placed in the streambed in a manner that precludes
aquatic life passage. Bioengineering boulders or structures should be properly designed, sized and installed.
Thank you for requesting our input at this time. The NCDOT is reminded that issuance of a 401 Water Quality
Certification requires that appropriate measures be instituted to ensure that water quality standards are met and designated

allows the area to re-vegetate naturally and minimizes soil disturbance.

features encountered during construction, please contact the NC DWQ for guidance on how to proceed and to
determine whether or not a permit modification will be required.

General Comments Regarding Bridge Replacement Projects
DWQ is very concerned with sediment and erosion impacts that could result from this project. NCDOT should
address these concerns by describing the potential impacts that may occur to the aquatic environments and any
mitigating factors that would reduce the impacts.
2. If foundation test borings are necessary, it should be noted in the document. Geotechnical work is approved under
General 401 Certification Number 3494/Nationwide Permit No. 6 for Survey Activities.
If a bridge is being replaced with a hydraulic conveyance other than another bridge, DWQ believes the use of a
Nationwide Permit may be required. Please contact the US Army Corp of Engineers to determine the required
permit(s).
4. If the old bridge is removed, no discharge of bridge material into surface waters is allowed unless otherwise
authorized by the US ACOE. Strict adherence to the Corps of Engineers guidelines for bridge demolition will be a
condition of the 401 Water Quality Certification.
Whenever possible, the DWQ prefers spanning structures. Spanning structures usually do not require work within
the stream or grubbing of the stream banks and do not require stream channel realignment. The horizontal and

The Project Development and Environmental Analysis Branch is starting the project
development, environmental and engineering studies for the proposed widening of NC 3 to a multi-lane
facility from Kannapolis Parkway (U-2009) to SR 1691 (Loop Road). The project is included in the
2007-2013 North Carolina Transportation Improvement Program and is scheduled for right of way in
fiscal year 2011 and construction in fiscal year 2013.
Attached for your review and comments are the scoping information sheets for the proposed project.
We would appreciate any information you might have that would be helpful in evaluating potential
environmental impacts of the project. If applicable, please identify any permits or approvals that may be
required by your agency. A scoping meeting will be scheduled with NCDOT staff to discuss the proposed
project in more detail. In order to include your comments in our materials for this meeting, we would

General Comments Regarding Bridge Replacement Projects
1. DWQ is very concerned with sediment and erosion impacts that could result from this project. NCDOT should
address these concerns by describing the potential impacts that may occur to the aquatic environments and any
mitigating factors that would reduce the impacts.
2. If foundation test borings are necessary, it should be noted in the document. Geotechnical work is approved under
General 401 Certification Number 3494/Nationwide Permit No. 6 for Survey Activities.
If a bridge is being replaced with a hydraulic conveyance other than another bridge, DWQ believes the use of a
Nationwide Permit may be required. Please contact the US Army Corp of Engineers to determine the required
permit(s).
4. If the old bridge is removed, no discharge of bridge material into surface waters is allowed unless otherwise
authorized by the US ACOE. Strict adherence to the Corps of Engineers guidelines for bridge demolition will be a
condition of the 401 Water Quality Certification.
Whenever possible, the DWQ prefers spanning structures. Spanning structures usually do not require work within
the stream or grubbing of the stream banks and do not require stream channel realignment. The horizontal and
vertical clearances provided by bridges allow for human and wildlife passage beneath the structure, do not block fish
passage and do not block navigation by canoeists and boaters.
6. Bridge deck drains should not discharge directly into the stream. Storm water should be directed across the bridge
and pre-treated through site-appropriate means (grassed swales, pre-formed scour holes, vegetated buffers, etc.)
before entering the stream. Please refer to the most current version of NC DWQ Storm Water Best Management
Practices.
7. If concrete is used during construction, a dry work area should be maintained to prevent direct contact between
curing concrete and stream water. Water that inadvertently contacts uncured concrete should not be discharged to
surface waters due to the potential for elevated pH and possible aquatic life and fish kills.
8. Bridge supports (bents) should not be placed in the stream when possible.
9. If temporary access roads or detours are constructed, the site shall be graded to its preconstruction contours and
elevations. Disturbed areas should be seeded or mulched to stabilize the soil and appropriate native woody species
should be planted. When using temporary structures the area should be cleared but not grubbed. Clearing the area
with chain saws, mowers, bush-hogs, or other mechanized equipment and leaving the stumps and root mat intact
allows the area to re-vegetate naturally and minimizes soil disturbance.
10. Sediment and erosion control measures sufficient to protect water resources must be implemented and maintained in
accordance with the most recent version of North Carolina Sediment and Erosion Control Planning and Design
Manual and the most recent version of NCS000250.
11. All work in or adjacent to stream waters should be conducted in a dry work area unless otherwise approved by NC
DWQ. Approved BMP measures from the most current version of NCDOT Construction and Maintenance
Activities manual such as sandbags, rock berms, cofferdams and other diversion structures should be used to prevent
excavation in flowing water.
12. Heavy equipment should be operated from the bank rather than in stream channels in order to minimize
sedimentation and reduce the likelihood of introducing other pollutants into streams. This equipment should be
inspected daily and maintained to prevent contamination of surface waters from leaking fuels, lubricants, hydraulic
fluids, or other toxic materials.

13. In most cases, the DWQ prefers the replacement of the existing structure at the same location with road closure. If
road closure is not feasible, a temporary detour should be designed and located to avoid wetland impacts, minimize
the need for clearing and to avoid destabilizing stream banks. If the structure will be on a new alignment, the old
structure should be removed and the approach fills removed from the 100-year floodplain. Approach fills should be
removed and restored to the natural ground elevation. The area should be stabilized with grass and planted with
native tree species. Tall fescue should not be used in riparian areas.
General Comments if Replacing the Bridge with a Culvert
Placement of culverts and other structures in waters, streams, and wetlands shall be below the elevation of the
streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter
for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. Design and
placement of culverts and other structures including temporary erosion control measures shall not be conducted in a
manner that may result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down
stream of the above structures. The applicant is required to provide evidence that the equilibrium is being
maintained if requested in writing by DWQ. If this condition is unable to be met due to bedrock or other limiting
features encountered during construction, please contact the NC DWQ for guidance on how to proceed and to
determine whether or not a permit modification will be required.
2. If multiple pipes or barrels are required, they should be designed to mimic the natural stream cross section as closely
as possible including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the stream
channel should be avoided. Stream channel widening at the inlet or outlet end of structures typically decreases
water velocity causing sediment deposition that requires increased maintenance and disrupts aquatic life passage.
Riprap should not be placed in the active thalweg channel or placed in the streambed in a manner that precludes
aquatic life passage. Bioengineering boulders or structures should be properly designed, sized and installed.
Thank you for requesting our input at this time. The NCDOT is reminded that issuance of a 401 Water Quality
Certification requires that appropriate measures be instituted to ensure that water quality standards are met and designated

On October 3, 2007, at your request and in your attendance, Sue Homewood, Division of Water Quality (DWQ) staff,
conducted an on-site determination to review drainage features located adjacent to the new location project referenced
above for applicability to the mitigation rules (15A NCAC 2H.0506(h)). The drainage features are approximated on the
attached map initialed and dated October 5, 2007.
Streams that were reviewed on site and determined to be perennial and therefore subject to mitigation in accordance with
15A NCAC 2H.0506(h) were: UT7, UT8, UT12
Streams that were reviewed on site and determined to be intermittent and therefore not subject to mitigation in
accordance with 15A NCAC 2H.0506(h) were: UT5, UT6, UT10, UT2, UT11 (from the road to the adjacent driveway),
UT9 (from a headcut approximately 30 feet upstream of Wetland A, and UT13. Please note that the USACE may still
require mitigation on streams that do not require mitigation by the Division's regulations. UT9 upstream of the headcut
was determined to be ephemeral.
Please note that other sites identified in the jurisdictional vertification request package but not reviewed on site by DWQ
will be considered accurate as presented.
Please also note that it was determined on-site that if impacts should occur to UT11 downstream of the adjacent
driveway, the Division reserves the right to inspect that portion of the stream and determine applicability of the
mitigation rule at a later date.
This letter only addresses the applicability to the mitigation rules and does not approve any activity within Waters of the
United States, or Waters of the State. Any impacts to wetlands and streams must comply with the 404/401 regulations,
water supply regulations (15A NCAC 2B .0216), and any other required federal, state and local regulations.
The owner (or future owners) or Permittee shall notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property and/or project. This on-site determination shall expire five (5) years

Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a
surface water exists and that it is subject to the mitigation rules may request a determination by the Director. A request
fora determination by the Director shall be referred to the Director in writing c/o John Hennessy, DWQ Wetlands/401
Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. Individuals that dispute a determination by the DWQ or
Delegated Local Authority that "exempts" a surface water from the mitigation rules may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day
statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of
this decision. DWQ recommends that the applicant conduct this notification in order to be certain that third party appeals
are made in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.

This office has reviewed the referenced document dated September 17, 2007. The Division of Water
Quality (DWQ) is responsible for the issuance of the Section 401 Water Quality Certification for
activities that impact Waters of the U.S., including wetlands. It is our understanding that the project as
presented will result in impacts to jurisdictional wetlands, streams, and other surface waters. The DWQ
offers the following comments based on review of the aforementioned document:
Boone Creek is class C; Tr+ waters of the State. DWQ recommends that the most
protective sediment and erosion control BMPs be implemented to reduce the risk of
turbidity violations in trout waters. In addition, all disturbances within trout buffers shall be
conducted in accordance with NC Division of Land Resources and NC Wildlife Resources
Commission requirements. The + sign indicates this water drains to high quality or
outstanding resource waters and additional measures may be necessary for the control of
sediment and turbidity.
2. In accordance with the Environmental Management Commission's Rules {15A NCAC
2H.0506(h)}, mitigation will be required for impacts of greater than 150 linear feet to any single
perennial stream. In the event that mitigation is required, the mitigation plan shall be designed to
replace appropriate lost functions and values. The NC Ecosystem Enhancement Program may be
available for use as stream mitigation.
3. Future documentation, including the 401 Water Quality Certification Application, shall continue to
include an itemized listing of the proposed wetland and stream impacts with corresponding
mapping.
4. DWQ is very concerned with sediment and erosion impacts that could result from this project. NC
DOT shall address these concerns by describing the potential impacts that may occur to the aquatic
environments and any mitigating factors that would reduce the impacts.
5. NC DOT is respectfully reminded that all impacts, including but not limited to, bridging, fill,
excavation and clearing, to jurisdictional wetlands, streams, and riparian buffers need to be included
in the final impact calculations. These impacts, in addition to any construction impacts, temporary

6. Sediment and erosion control measures shall not be placed in wetlands or streams.
7. Borrow/waste areas shall avoid wetlands to the maximum extent practical. Impacts to wetlands in
borrow/waste areas will need to be presented in the 401 Water Quality Certification and could
precipitate compensatory mitigation.
The 401 Water Quality Certification application will need to specifically address the proposed
methods for stormwater management. More specifically, stormwater shall not be permitted to
discharge directly into streams or surface waters.
9. Based on the information presented in the document, the magnitude of impacts to wetlands and
streams may require a Nationwide (NW) application to the Corps of Engineers and corresponding
401 Water Quality Certification. Please be advised that a 401 Water Quality Certification requires
satisfactory protection of water quality to ensure that water quality standards are met and no wetland
or stream uses are lost. Final permit authorization will require the submittal of a formal application
by the NCDOT and written concurrence from the NCDWQ. Please be aware that any approval will
be contingent on appropriate avoidance and minimization of wetland and stream impacts to the
maximum extent practical, the development of an acceptable stormwater management plan, and the
inclusion of appropriate mitigation plans where appropriate.
10. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact
between curing concrete and stream water. Water that inadvertently contacts uncured concrete shall
not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and
fish kills.
11. Placement of culverts and other structures in waters, streams, and wetlands shall be placed below
the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow
low flow passage of water and aquatic life. Design and placement of culverts and other structures
including temporary erosion control measures shall not be conducted in a manner that may result in
dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the
above structures. The applicant is required to provide evidence that the equilibrium is being
maintained if requested in writing by DWQ. If this condition is unable to be met due to bedrock or
other limiting features encountered during construction, please contact the NC DWQ for guidance
on how to proceed and to determine whether or not a permit modification will be required.
12. If multiple pipes or barrels are required, they shall be designed to mimic natural stream cross section
as closely as possible including pipes or barrels at flood plain elevation and/or sills where
appropriate. Widening the stream channel should be avoided. Stream channel widening at the inlet
or outlet end of structures typically decreases water velocity causing sediment deposition that
requires increased maintenance and disrupts aquatic life passage.
13. If foundation test borings are necessary; it shall be noted in the document. Geotechnical work is
approved under General 401 Certification Number 3494/Nationwide Permit No. 6 for Survey
Activities.

15. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP
measures from the most current version of NCDOT Construction and Maintenance Activities
manual such as sandbags, rock berms, cofferdams and other diversion structures shall be used to
prevent excavation in flowing water.
16. While the use of National Wetland hlventory (NWI) maps, NC Coastal Region Evaluation of
Wetland Significance (NC-CREWS) maps and soil survey maps are useful tools, their inherent
inaccuracies require that qualified personnel perform onsite wetland delineations prior to permit
approval.
17. Heavy equipment shall be operated from the bank rather than in stream channels in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into streams. This
equipment shall be inspected daily and maintained to prevent contamination of surface waters from
leaking fuels, lubricants, hydraulic fluids, or other toxic materials.
18. Riprap shall not be placed in the active thalweg channel or placed in the streambed in a manner that
precludes aquatic life passage. Bioengineering boulders or structures shall be properly designed,
sized and installed.
19. Riparian vegetation (native trees and shrubs) shall be preserved to the maximum extent possible.
Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
