Reevaluation of Permit Decision. This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following: a. You fail to comply with the terms and conditions of this permit. b. The information provided by you in support of your permit application proves to have been false, incomplete, or inaccurate (See 4 above). c. Significant new information surfaces which this office did not consider in reaching the original public interest decision. Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CPR 326.4 and 326.5. "MITIGATION PLAN FOR MARANATHA ISLAND SUBDIVISION 199201184" Mr. Ben Whitfield Att: M & M Associates Limited Partnership c/o Mr. Peter W. Martone Post Office Box 9058 Virginia Beach, Virginia 23450 INTRODUCTION The purpose of this mitigation plan is to comply with.the requirements of the Memorandum of Agreement between the Environmental Protection Agency and the Department of the Army concerning the determination of acceptable mitigation under the Clean Water Act Section 404(b)(1) Guidelines. MITIGATION PLAN This mitigation project must meet all 3 wetland parameters per the 1987 Corps of Engineers Wetland Delineation Manual to be considered a success. To accomplish this, the following activities must be undertaken on the site: A. VEGETATION: The following wetland tree species are to be planted on the site: Bald Cypress (Taxodium distichum), Black Gum (Nyssa aquatica and Nyssa sylvatica var. biflora), Red Maple (Acer rubrum), Sweetgum (Liquidambar styraciflua), Atlantic White Cedar (Chamaecyparis thyoides), Green Ash (Fraxinus pennsylvanicum). 1. Plant 12 to 18 inch seedlings, each tree on 12 foot centers. No more than 20% of any one of the species may be planted on the site. Tree seedlings may be obtained from the N C Forest Service Claridge Nursery in Goldsboro, NC, telephone (919) 731-7972; the N C Forest Service Clayton Nursery, telephone (919) 553-6178, or a nursery within 200 miles north or south of the project site. Inquiries into available plant stock should be initiated as soon as possible to avoid ordering delays. 2. To be considered a success, a minimum of 180 trees will be surviving in the mitigation area at the end of the third growing season. The applicant may wish to plant a higher ratio of trees to obtain this goal. 3. Planting will be undertaken during the period of November through March. 4. Designate one (1), 50-foot wide by 50-foot long permanent sample plot. This plot will be utilized to measure the success of the vegetation planting. B. SOILS: 1. Remove all historic fill material within the mitigation site to a target elevation equal to 1.7 feet above sea level. 2. After the site is excavated to the target elevation, the site should be plowed or disked to alleviate compaction effects. Site elevations should be double-checked to ensure that the target elevation is maintained. 3. Erosion control measures will be installed to prevent the entry of sediments into the mitigation area. C. HYDROLOGY: 1. The mitigation site must be saturated to within 12 inches of the surface, ponded, or flooded for at least 30 consecutive days between March 21 and November 19 under normal conditions (i.e. 12.5% of the growing season). 2. Visual observation of ponding or flooding may be supported by dated photography and/or video evidence. 3. Evidence of soil saturation may be supported by ground water well data. Installation, reading, and interpretation of well data should be coordinated with the Corps of Engineers prior to the installation of any wells on the site. D. MONITORING REQUIREMENTS: 1. An "As Built" report must be submitted within 30 days of mitigation site completion. This will serve as official notice of completion o mitigation construction. This report should include a summary 11 of the construction activities, sample plot location, well locations (if applicable), photographs, and any problems encountered during construction. 2. Annual monitoring will be conducted in August or-September of each year, for 3 years. An annual report must be prepared and submitted by October 15 of each monitoring year. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process.
