The lots are recorded as lots 2, 20, and 24, location maps are enclosed. The lots have been in Ms. Manasse's family since 1941 and 1954. A deed history, provided by Willard & Willard, L.L.P, Attorneys at Law, is attached. The lots were purchased as investment properties for Ms. and Mr. Manasse. However, with the August 2000 adoption of the Neuse River Riparian Area Buffer Rules, these properties were rendered unbuildable. The Manasses have relied on these investment properties for years, and because of the substantial loss in property value that resulted, are now unable to realize their long-term goals. The Manasses have coordinated with Mr. Stoney Chance, of Chance Associates Land Planners, who initiated coordination with NC DWQ. Ms. Cindy Karoly with NC DWQ met with Mr. Chance and Mr. Thomas C. Worth Jr., and advised that two separate variance applications would be required. Two of these lots, numbers 2 and 20, are proposed to impact Zone II of the protected buffers, requiring application to, and approval from NC DWQ. Ms. Karoly advised that including both lots on the same variance application would be preferable. The third lot, number 24, is proposed to impact both Zones I and II of the protected buffers, and will require application to, and approval from, the NC EMC. The enclosed applications have been prepared for the purpose of securing a variance from the Riparian Buffer Rules, to enable the Manasses to realize the full value of their land. Robert J. Goldstein and Associates biologists have visited the properties and determined that no wetland areas exist on the property. Impacts to the riparian buffers are the only proposed activity. Mitigation for the proposed impacts will consist of; 1) payment to the NC Ecosystem Enhancement Program (acceptance letter is attached), 2) Planting native hardwood species to restore 0.146 acre of on-site riparian buffers currently maintained as lawn, 3) Removal of an existing stonnwater discharge to Oxford Branch, and 4) Deed restrictions stipulating the use of gravel or porous concrete for driveway construction associated with the major variance request. The practical difficulties or hardships that would result from strict application of the Rule. Lot 24 of the D.L. Johnson Subdivision, located on Oxford Road in the City of Raleigh has been in the landowner's family since August of 1954 (deed history is attached). The family's long-term intent has been to develop these parcels as residential properties. However, with the adoption of the August, 2000 Neuse River Riparian Area Buffer Rules, these long-term goals have been rendered legally impossible without the requested variance. This new constraint has resulted in the loss of hundreds of thousands of dollars of land value, upon which the owner and her husband had relied for years. How these difficulties or hardships result from conditions that are unique to the property involved. Oxford Branch, a class 'C NSW' perennial tributary of Crabtree Creek, in the City of Raleigh, NC flows across Lot 24 (Figure 2). Oxford Branch makes a large bend south toward Oxford Road. When the mandatory buffers are applied to this property, combined with the City of Raleigh mandatory zoning setbacks, only 96 square feet of developable space is available on this previously valuable lot. Why reconfiguring and/or reducing the built-upon area to preserve a greater portion of the riparian area is not feasible on this proiect. The built upon area has been reconfigured to preserve a greater portion of the riparian area. Chance and Associates, Land Planners, provided the proposed footprint for the structure on Lot 24. See the proposed design attached as figure 4. Placement of the structure on the north of Oxford branch would require nearly all of the structure to be located in Zone I of the rule. This placement north of the creek would also require a new bridge crossing to access the proposed structure. The selected location of the proposed structure is as far out of the buffers as City of Raleigh Zoning regulations will allow. Additionally, rather than a large square structure as is proposed for lot 20 where impacts to Zone I could be avoided, the home on lot 24 was configured to minimize impacts to Zone I, while maintaining the suitability and character of this structure consistent with surrounding residential neighborhood. The house was designed to be longer than it is deep, with the bulk of the structure located at the landward most extent allowed by City of Raleigh Zoning requirements. This 'L' shaped structure conforms more parallel to the protected buffers than would a square shaped home. If economic hardship is the major consideration, then include a specific explanation of the economic hardship and the proportion of the hardship to the entire value of the proiect. The landowner owns three adjacent lots in this subdivision (lots 2, 20, and 24), depicted on figure 4. Lot 25, depicted on the figure is actually a part of the same lot, but was recorded this way with the City of Raleigh. For consistency, we have retained the lot number on our figures, but only refer to construction on Lot 24. An application is being submitted for lots 2 and 20 to the NC Division of Water Quality (NC DWQ) for minor variances for both of these lots, as only impacts to Zone II of the rule are necessary. These two lots contain sufficient space to avoid impacts to Zone I of the rule. These three lots comprise the entire project. The hardship imposed on the landowners would be roughly one-third of the entire project value. Part 3, Item 1. The owners have agreed to place deed restrictions on the proposed driveway, to stipulate the use of loose gravel or porous concrete to facilitate the rapid infiltration of stormwater runoff. The future home built on this lot will also be required to direct water collected in its gutters to forested areas in a diffuse fashion. Native hardwood trees will be planted in Zone I of the rule, where only maintained lawn currently exists. Based on a target density of 550 stems per acre, 43 hardwood stems will be planted in non-impacted portions of Zone I of the rule (Figure 3). Local near-stream forested buffers are comprised of hackberry, black walnut, green ash, river birch, and yellow poplar. Black walnut will not be used because its juglone secretions can interfere with understory vegetation, favorable in a healthy riparian buffer. Yellow poplar is not available from the selected nursery, so swamp chestnut oak will be planted in its place. River birch, green ash, hackberry, and swamp chestnut oak stems will be purchased from a local nursery and planted by RJG&A staff. Deed restrictions will be placed on the new forest vegetation, and once sold the Riparian Area Buffer Rules will apply to these properties, and no future variances will be possible. Protective tree fencing will be provided around these plantings during construction, including a reasonable root-zone to minimize soil compaction, to insure no construction related adverse impacts to the proposed buffer result. A six inch diameter plastic drain is located in a slight depression on the lot (Figure 3***), with all water it intercepts directly diverted into Oxford Branch via a six inch corrugated plastic pipe. This drain and drainpipe will be removed, facilitating the infiltration of stormwater into the soil and proposed forested buffer, rather than its direct discharge to Oxford Branch, as currently exists. In addition to the mitigative measures detailed above, the landowner has agreed to provide the North Carolina Ecosystem Enhancement Program with afee-in- lieu payment to offset adverse impacts to the protected buffers. The NC EEP acceptance letter is attached. In summary, proposed structural and non structural best management practices to be employed on the site include, 1) restoring forested buffers along Oxford Branch, 2) the removal of a stormwater discharge to Oxford Branch, 3) payment to the NC Ecosystem Enhancement Program to offset adverse impacts, and 4) the placement of deed restrictions stipulating the use of porous materials for driveway construction. Part 3, Item 6. *** All available buffer area on this lot will be planted with native hardwood trees obtained from a local nursery. The width of the proposed forested buffers will range from 5 to 37 feet in width. No standard multiplier was provided to calculate the nitrogen removal efficiency. Also, a direct stormwater discharge to Oxford Branch will be removed, facilitating the infiltration of stormwater rather than direct diversion into the creek. Actual nutrient removal should be far greater than reported in the required table. 6. Calculations and References The post-development nitrogen loading rate without BMPs was calculated using "Figure 2b: Method 2 for Quantifying TN Export from Residential /Industrial /Commercial Developments when Footprints of all Impervious Sun`aces are Shown" found on p12 of the Neuse River Basin: Model Stormwater Program for Nitrogen Control (1999), shown below. Step 1: Determine area for each type of land use and enter in Column (2). Step 2: Total the areas for each type of land use and enter at the bottom of Column (2). Step 3: Multiply the areas in Column (2) by the TN export coefficients in Column (3) and enter in Column (4). Step 4: Total the TN exports for each type of land use and enter at the bottom of Column (4). Step 5: Determine the export coefficient for site by dividing the total TN export from uses at the bottom of Column (4) by the total area at the bottom of Column (2). There is no BMP percent nitrogen removal efficiency reported for planting trees in buffer zones (NC DWQ website, http://h2o.enr.state.nc.us/su/Neuse NSW Management Strategy.htm). With no percent reduction from 5.39 Ibs/ac/yr, this value is then multiplied by the size of fhe drainage basin (0.306 ac), resulting in a final nitrogen loading from drainage basin of 1.65 Ibs (the original TN export from use). It is the responsibility of the applicant to contact these agencies to determine if payment to the NC EEP will be approved. This acceptance is valid for six months from the date of this letter. As you are aware, all three of the properties in question were originally titled in John D. Minter and wife, Mary S. Minter as tenancy by the entireties. John D. Minter passed away on November 26, 1990 and Mary S. Minter became the sole owner of the three properties upon his death. Mary S. Minter passed away on January 8, 2004. Her estate was filed with the Wake County Clerk of Court (04E557) and has been closed. By the terms of her will, you are the sole heir and inherited all of her real property, including these three properties. I have summarized the ownership history for each of the three properties. I have attached copies of the recorded maps and deeds for your reference. Ownership History of 2221 Oxford Road The properties located between Beech Ridge Road and Oxford Road are known as the DL Johnston Subdivision as surveyed by Pittman Stell on April 8, 1938 and recorded in Book of Maps 1935, Page 96, Wake County Registry(hereinafter "WCR"). These lands were deeded into DL Johnston and Edith Pou Johnston in two separate conveyances. The first was from JA Boone and wife, Vida Boone recorded in Book 437, Page 299, WCR on May 26, 1924. This deed was re-recorded in Book 775, Page 241, WCR to correct the spelling of the Johnston name. The second conveyance into the Johnstons was recorded on May 27, 1940 in Book 823, Page 611, WCR. The Johnstons subdivided the land and recorded the map as noted above. The property known as 2221 Oxford Road was comprised of Lots 26 and 27 and was deeded out to Jack P. Morison and wife, Pearl L. Morison in Book 827, Page 457, WCR on June 21, 1940. The Morisons deeded the property to Thomas W. Ruffin on March 28, 1941 in Book 860, Page 177, WCR. Thomas W. Ruffin filed a new map of the DL Johnston lots 26-29 in Map Book 1941, Page 81, WCR. Lots 26 and 27 became known as Lot 2, Thomas Ruffin Subdivision. The Ruffins deeded Lot 2 into EW Stalvey and wife, Frances W. Stalvey on March 14, 1942 in Book 872, Page 467, WCR. The Stalveys then deeded Lot 2 into John D. Minter and wife, Mary S. Minter on August 16, 1954 in Book 1 149, Page 299, WCR. No additional map recordings or recombinations of the property have been filed since this time. An agreement regarding the joint driveway easement along the western boundary line of Lot 2 was recorded on July 17, 1992 in Book 5261, Page 537, WCR. Ownership History of 2301 Oxford Road This property was acquired by DL Johnston and wife, Edith Pou Johnston as noted above. The property known as 2301 Oxford Road was comprised of Lots 24 & 25 and was first conveyed out to EW Stalvey and wife, Frances W. Stalvey on February 24, 1945. The Stalveys then deeded Lots 24 & 25 into John D. Minter and wife, Mary S. Minter on August 16, 1954 in Book 1149, Page 299, WCR. No additional map recordings or recombinations of the property have been filed since this time. Ownership of 2305 Oxford Road This property was acquired by DL Johnston and wife, Edith Pou Johnston as noted above. The property known as 2305 Oxford Road is the southern part of Lot 20 of the DL Johnston subdivision. The property was first conveyed out to Thomas W. Ruffin in Book 862, Page 73, WCR on March 18, 1941 as all of Lot 20. The Ruffins then deeded the southern part of Lot 20 (South of Cool Water Branch) to John D. Minter and wife, Mary S.
