PROJECT SUMMARY: The applicant is proposing to develop an existing upland basin in the City of New Bern. The development would consist of a 32 slip floating docking facility, the maintenance excavation of 211 yd' of bottom within the basin, the replacement of 688' of bulkhead, the construction of a 28 space dry storage facility(with associated infrastructure), and a 160' long wave attenuating dock. 9. NARRATIVE DESCRIPTION: Mr. Ipock's project is located on the southern side of New Bern on Lawson Creek in Craven County. The project site is found by traveling on Hwy. 70. Travel into New Bern, and turn onto exit 416 toward Pembroke Rd. /Trent Woods. Travel 0.2 miles and turn onto NC-55 and travel 0.2 miles and turn onto Walt Bellamy Dr. Take an immediate right onto First St. The subject project would take place on a 2.7 acre parcel and has an elevation of +6' NWL. The project parcel is cleared and maintained; vegetation consists of native grasses and a single tree in the center of the parcel. Presently, the parcel consists of an existing upland basin with wooden shoreline stabilization on all but the eastern side. The property has impervious surfaces consisting of a 14 space parking lot and gravel areas. There is a 5,670 ft2 building located 65' from the northwest corner of the basin. Impervious surfaces cover approximately 7,565 ft' within the 75' AEC and 1,962 ft2 within the 50' Neuse Buffer. There is maintenance excavation proposed inside the basin totaling 211 yd' and disturbing 5,697 ft2 of bottom. All bottom of the existing basin has been previously excavated. The site currently utilizes the City of New Bern municipal sewer system. Adjacent land uses consists of City of New Bern public right-of-ways on both the east and west sides. The shoreline contains coastal wetlands along the section bordering Lawson Creek, there are no wetlands within the basin, except along the east side where no shoreline stabilization exists. The width of Lawson Creek at this point is 180 feet. The subaqueous substrate adjacent the shoreline is predominately sand and silt. The entire shoreline within the basin has been previously disturbed. The Division of Water Quality classifies this area of Lawson Creek as SC-NSW waters. This area is not a Primary Nursery Area. This portion of Lawson Creek is closed to harvesting of shellfish. The portion of the parcel located within the 75' Estuarine Shoreline AEC is classified in the New Bern LUP as Conservation; the portion outside the AEC is classified as Developed. 10. PROJECT DESCRIPTION: The applicant is proposing to develop a 32-slip marina directly adjacent to 2.7 acres of highground with 999 ft. of shoreline. Twenty-nine slips are proposed to be located within the existing basin and entrance canal with three slips proposed directly outside of the basin. Approximately 211 yd' of material would be removed for maintenance excavation inside the basin. Highground development consists of a 28 space drystack with dimensions of 80' x 24' x 35' a minimum of 125' from NWL (with associated infrastructure), a 11,520 ft2 spoil disposal area located a minimum of 125'from NWL, and approximately 0.95 acres of highground grading. Also proposed on highground are three wood walkways measuring 6' x 10', 6' x 14', and 6' x 40.5'. The excavation would disturb approximately 5,697 ft' of previously disturbed shallow bottom habitat. All excavation would be considered maintenance in nature. Existing water depths range from -2.5' to -5.0' NWL. Proposed depths, post excavation, are -6.0 NWL. The maintenance excavation of the basin would connect to an existing entrance channel with a connecting water depth of -6.0' NWL. Excavation would be carried out by an excavator and dump truck and spoils would be stabilized onsite. An 80' x 24' x 35' dry storage facility is included in the proposal as well. The structure would be four levels and have spaces for 28 boats. Vessels would be removed from the dry storage with a fork lift, transported to the water, and launched at a designated space on the west side of the basin. The transport area would be concrete over existing impervious areas, with the exception of a 14' wide by 42' long concrete launch pathway leading to the basin, which would be new impervious area within the 50' buffer. Three slips are proposed to be located on Lawson Creek. At this location, Lawson Creek is 180' in width. This portion of the facility would be a maximum of 35' from the waterward edge of the marsh. This portion of the structure is well within the property owner's riparian corridor. The channel portion of Lawson Creek passes very near the location of the proposed slips with a depth of 5'-6' NLW. A new 32-slip floating docking facility of the following configuration is also proposed: • Total access walkway of 757' x 6' for 4,542 ft' of walkway. • Fourteen finger piers with dimensions of 29' x 4.5' for 1,827 ft2 of finger piers. • 198' x 8' in platform for 1,584 ft2 of platform. • 160' x 6' wave attenuating dock totaling 960 ftz located along the eastern side of the basin. Thirteen mooring pilings Total deck coverage for the docking facility would be 8,913 W. No SAVs or any other critical habitat were found in the areas to be excavated during site visits. 11. ANTICIPATED IMPACTS: Highground impacts consist of 0.95 acres of disturbance. A 28 space dry storage facility would be built in an area which is currently impervious. Additional impervious surface would need to be added to allow the launching of vessels from the dry storage. A concrete launching pad is proposed to facilitate the launching of vessels by a fork lift type machine. Approximately 823 ft2 of impervious surfaces are proposed to be added by this project within the 50' Neuse Buffer. Total for the 75' AEC is 1,055 ft2 of new impervious totaling 15.7%. The addition of new impervious within the AEC could facilitate additional stormwater runoff into adjacent waters. The proposed docking facility would incorporate approximately 44,400 ft2 of public trust waters and cause 8,913 ft2 of shading impacts. Shading should not have a negative effect on the benthic ecosystem due to the fact that this area has been previously disturbed, the water depths would average -6' NLW, and decreased water clarity and light penetration due to the increased levels of tannins in the adjacent water body. The project would consist of 3,411 ft2 of platform for 999 ft of shoreline. The facility would also add 32 wetslips and 28 dry storage spaces as well. This would cause an increase in usage in the areas immediate Lawson Creek. There would be increased turbidity caused by the placement of pilings and during the maintenance excavation, but any increased turbidity would be expected to be minimal in impacts. To replace failing portions of the existing shoreline stabilization, 688' of new vinyl bulkhead is proposed. The bulkhead and subsequent backfilling would not fill any wetlands or critical habitat. The backfill could possibly enter the adjacent waters during the immediate time frame before the area stabilizes. By properly utilizing a silt fence, such runoff and associated impacts should be minimized. One area of concern is on the eastern side of the basin. The applicant's property has eroded to a point that the City of New Bern now possesses waterfront property within the basin and possibly the associated riparian rights as well. This proposal includes a 160' x 6' wave attenuating dock located directly waterward of the aforementioned area, approximately 15' offshore. It is a possibility that the wave attenuating dock could impede New Bern's riparian rights by limiting the ways in which its citizens could utilize the property and its associated water access. The City of New Bern has voiced objection to this portion of the proposal. No coastal or Section 404 Wetlands would be filled or excavated during this project. OAST reAscd. 12,27!03 PROPOSED LAWSON HARBOUR MARINA 114 FIRST STREET NEW BERN, CRAVEN COUNTY, NORTH CAROLINA Proiect Description The proposed Lawson Harbour Marina project encompasses the development of a 32 slip marina on a 2.77 acre parcel of land located at 114 First Street in New Bern, Craven County, North Carolina. The subject property is currently developed with a commercial building and commercial fenced storage yard. It is proposed that the marina be constructed in an existing manmade basin located on the site. The subject property is abutted along its southern side by Lawson Creek, a tributary of the Neuse River all located within the Neuse River Basin. Existing development on the subject property includes an existing commercial building, asphalt, concrete, and gravel parking areas, a fenced open storage area and an existing manmade basin. The existing manmade basin is rimmed with a wooden bulkhead. The subject property is abutted along its northern side by Walt Bellamy Drive, along its western side by First Street and to the east by the public right-of-way of Bryan Street, all owned and operated by the City of New Bern. Areas of environmental concern are located on the subject property. Specifically, a 75' foot CAMA AEC is located on the subject property primarily established from the normal water level as delineated on the project plans. Additionally, Neuse Riparian Buffer areas (Zone 1 and Zone 2 areas) are also located on the site as delineated on the project plans. Small coastal wetland areas are located on the southern extent of the subject property immediately adjacent to Lawson Creek. No other wetland areas are present on the subject property. The subject property covers a total of 2.77 acres. The subject property is located within the City of New Bern Planning Jurisdiction. Development of the marina will be governed by the City of New Bern Land Use Ordinance. A summary of the work included in the project includes: 1. Construction of floating dock system and haul-out well. 2. Construction of dry-stack storage space. 3. Replacement of deteriorated bulkhead. 4. Construction of wave attenuating dock along eastern side of dock system. 5. Completion of maintenance dredging. It is proposed that a new 32 slip commercial marina be constructed within the existing manmade basin located on the subject property. In addition to the 32 slip marina, it is also proposed that a haul-out well be constructed to launch and retrieve boats. A fork lift will be utilized to launch and retrieve boats. A portion of the dock system, the eastern most platform section will be constructed as a wave attenuating dock section. A 28 space dry stack boat storage rack is proposed to be constructed on top o the existing gravel surfacing on the western side of the site as depicted, on the site plan. The docks will be constructed as a floating dock system. It is proposed that the existing wood bulkhead bordering the perimeter of the basin be replaced:` Specifically, it is proposed that a new vinyl bulkhead material be installed immediately waterward of the existing bulkhead. It is proposed that a total of 688 linear feet of new vinyl bulkhead be installed to replace the existing dilapidated wooden bulkhead. The extent of bulkhead replacement is indicated on the project plans. It is proposed that dredging occur to accommodate the proposed construction. Hydrographic survey data of the existing manmade basin and the entrance channel in the Lawson Creek area revealed that adequate water depths exist to serve the proposed marina in areas other than immediately adjacent to the existing bulkhead where sedimentation and erosion has created irregular depths. It is proposed that the area immediately adjacent to the new bulkhead (approximately 9' wide x 633 LF) be dredged to create a uniform, stable slope condition. It is proposed that a total of 211 cubic yards of material be excavated. The dredge spoil will be disposed of on upland areas of the site and will be vegetated. Dredging will not occur in any other areas or in any wetland areas. The proposed project is located on Lawson Creek which is classified as SC, Sw, NSW by the North Carolina Department of Environment and Natural Resources. No boat maintenance activities will occur on the subject property. No fueling activities will occur on the site. No permanent live aboard slip rental will be permitted. It is proposed that the development as presented on the project plans be developed and constructed in one phase of construction. Public water supply will provided to each dock system. Public water will be provided through the City of New Bern public water distribution system in the area of the project. Public sewer is available to serve the project through the City of New Bern public sewer system. It is proposed that a mobile pump out facility be provided at the marina. Discharge of this pump- out facility will occur to the City of New Bern municipal sewer system. The project area covers a total of 120,610 SF. A total of 32,287 SF of impermeable area exists on the site resulting in a 26.75% built-upon area for the entire site. The total proposed built-upon area within the 75' CAMA AEC area is 8,642 SF (7,565 SF - Existing, 977 - New) or 7.15% of the total CAMA AEC area.
