Gregson Governor Director December 5, 2009 MEMO TO: Chad Coburn, DWQ Rich Carpenter, DMF Molly Elwood, WRC Dave Timpy, USACE Jason Dail, DCM FROM: Doug Huggett Natural Resources Dee Freeman Secretary SUBJECT: NPIV-Cape Fear River LLC, (River Lights) Project, New Hanover County (Corps Action ID. No. SAW-2007-02319-065, DWQ Project No. 09-1008) Based upon issues raised during the initial review of the subject project, the applicant has provided the attached response. Their response includes replies to the issues raised, as well as a redesign of the proposed marina to try and further address these issues. I would ask that you review the attached information provided by the applicant and provide additional agency comments to this office. I would like to ask that, if possible, you provide additional comments to this office no later than December 23, 2009. If you have any questions on the specifics of this proposal, please give me a call at (252) 808- 2808. Thanks in advance for your consideration of this matter. cc: Jim Gregson (w/out attachment) Steve Morrison (w/out attachment) 400 Commerce Ave., Morehead City, NC 28557 Phone: 252-808-28081 FAX: 252-247-3330 Internet: www.nccoastalmanagement.net An Equal Opportunity \ Affirmative Action Employer - NorthCarolina Natur"Iff Project Narrative -REVISED 12-01-09 Major Modification to CAMA Permit # 92-07 RiverLights New Hanover County, North Carolina River Road Holdings, LLC, Applicant This Major Modification proposes a 111 slip community boating facility, a kayak/skull _ launching dock, a dry storage facility with 84 slip storage capacity and approximately 301.5 linear feet of temporary tie-up dockage, two crabbing docks, a riverfront boardwalk and expansion of a permitted access pier from 6 ft in width to 10 ft in width. Although there are only 111 permanent wet slips available for ownership for residents of RiverLights, there are a total of 454 linear feet of side-to temporary dockage available along the outermost t-docks (attenuators), etc that could numerically represent an additional 9 slips. The community boating facility, therefore, has the potential to accommodate 120 slips. Again, only 111 permanent wet slips will be available for ownership. RiverLights will be a mixed-use community. All features of the marina will be private use for residents and guests of RiverLights with the exception of the dry storage facility, which will be commercial use. Individuals who are not residents of River Lights will have the opportunity to purchase/lease a dry storage slip and access the temporary dockage along the waterfront. There will be approximately 301.5 linear feet of temporary tie-up dockage which will offer a temporary staging area for the dry storage facility. The kayak/skull launching dock will be available to residents of the RiverLights and will also be open to the crew team at the University of North Carolina Wilmington. The two additional crabbing docks will remain private use by the residents of RiverLights and will be accessed by a mulch/gravel drive. The marina facility and associated amenities will not be open for general public use. The site is located adjacent to the Cape Fear River, New Hanover County, North Carolina. Phase IA is included as upland development associated with the project. As a result of comments received during the DCM CAMA Major Permit review process, the marina was redesigned in December 2009. Please note the following revisions to the proposed project; a. Re-alignment of the forklift pier and temporary tie-up dockage for the dry storage facility - increases water depth within the footprint of the forklift drop area from -2 ft MLW to greater than -3 ft MLW, increases water depth for a majority of the temporary dockage b. Separation of temporary tie-up dockage for dry storage facility and temporary tie-up dockage for private use - reestablishes public trust access c. Shift Dock 13 closer to the '/ waterbody distance to obtain increased water depth for Wet Slip #76 d. Reduce the size of lift slips (#87-92 and #103-108) from 30 ft to 20 ft so slips can be accessed through -3 ft MLW rather than -2 ft MLW E ?• CAMA Permit # 92-07 authorized a 4-slip docking facility, a crabbing pier with a covered gazebo, and boardwalks along the waterfront in the Marina Village site. A Minor Modification was submitted in January 2008 requesting changes to the alignment of both piers and boardwalks to reflect the current plans as shown in the Environmental Assessment. Also requested with the Minor Modification was authorization for directional bores for utilities under Barnards Creek and Mott Creek. Approval for this Minor Modification was received from DCM on 3 March 2009. The RiverLights development has been annexed by the City of Wilmington and a development agreement was entered into on 10 June 2009. Approximately 184.7-ac within the development, including the Marina Village, are zoned MX-CD. The remaining 1,155.6-ac, including Phase IA, are zoned R7-CD. Waters of the Cape Fear River in the vicinity of the subject property are classified as SC by DWQ and DMF has classified the marshes and bottom areas as Primary Nursery Area (PNA). All floating structures will be located in water depths ranging from -3 ft to -6 ft MLW. The federally maintained Cape Fear River channel is over 1500 feet west of the proposed project. Several small undeveloped islands exist between the federally maintained navigation channel and the subject property. Jason Dail verified the coastal wetland line in the field with Greg Finch from LMG in July 2007 as part of the CAMA Express Permitting; however, the primary focus was in the marina village. The coastal wetlands to the south (in the vicinity of the 2 crabbing docks) were delineated by LMG in July 2007 but this line has not been verified by DCM staff. The marina facility will provide water access and low impact recreational opportunities to residents of the RiverLights community and also to individuals outside of the community who choose to lease/purchase dry storage slips. The community marina facility received a "Finding of No Significant Impact" on 2 June 2008. Stormwater permits for the Marina Village and Phase IA have been obtained. The Sedimentation and Erosion control plan has not been finalized. RiverLights will be serviced by the Cape Fear Public Utility Authority. The pumpout facility located at the marina will tie into the community sanitary services. 2 Form DCM MP-4 STRUCTURES (Construction within Public Trust Areas) Attach this form to Joint Application for CAMA Major Permit, Form DCM MP-1.
