R ERANCH Re: Burgaw Development Group, LLC [SEGi Project #: 04-044.011 Request for Modification to NWP 39 DWQ Project #: 031201-Ver. r 3 Dear Ms. Dennison, This letter is in response to the Division of Water Quality's (DWQ) request for additional information (RFAI) regarding the Coastal Carolina Country Club, in Burgaw, Pender County, North Carolina. The aforementioned letter was dated 17 April 2009. Below you will find the requests made, followed by SEGi's responses: 1. Please submit five (5) sets on the new PCN form that went into effect 12 January 2009, along with appropriate maps and narrative for the modification. Attached you will find four (4) copies of the revised PCN (Attachment 1) and impact map (Attachment 2 - addendum), as one (1) copy has already been submitted to the WiRO, attention Ms. Joanne Steenhuis. 2. A request for a modification of an issued 401 approval permit requires submission of the appropriate fee based on impacts. SEGi, with guidance from Ms. Joanne Steenhuis (WiRO), has determined the appropriate filing fee to process the Applicant's request to modify the existing GC (see attached), to include an additional 15 linear feet of stream impact, is $240. This finding was based on the Corps' issuance of the Nationwide Permit 39, dated 8 June 2009 (Attachment 3), which states "this permit authorizes the discharge of fill material into 0.029 ares of non- riparian wetlands and 35 linear feet of stream." Unfortunately, the filing fee has not been included with this submission. While SEGi is aware that the processing of the request will not begin until the filing fee has been received by the DWQ, the Applicant has not 5r-GI yet provided us with the funds. Therefore, once received, SEGi will forward it to you. In summary, the Applicant is seeking a modification to the existing NWP 39, which is to include an additional 15 linear feet of stream impact at Fairway 15.
