WATER QUAUTY WETLANDS AND STORMWATER BRANCH This correspondence is in reference to the Cripple Creek Stream and Wetland Mitigation Bank that is being developed by Restoration Systems, LLC, located east of Roney-Lineberry Road, north of Woodbrooke Drive, south of Deep Creek Church Road and west of North Fonville Road, in northeast Alamance County, North Carolina, within the Cape Fear River Basin, Hydrologic Unit Code (HUC) 03030002. The purpose of this letter is to notify you of the Corps' decision regarding the final mitigation banking instrument (MBI), entitled, "Agreement to Establish the Cripple Creek Stream and Wetland Mitigation Bank in Alamance County, North Carolina", dated November 30, 2009 and received on December 2, 2009. The bank sponsor, Restoration Systems, LLC also distributed copies to each Interagency Review Team (IRT) member on or around December 2, 2009 and sent an electronic copy to the Corps' Wilmington District, Office of Council, on December 9, 2009. Pursuant to 33 CFR Part 332.8(8), I am notifying you that the Corps has completed its review of the subject document and intends to approve the MBI. If any IRT member objects to this decision in accordance with the formal dispute resolution process described in 33 CFR Part 332.8(e), please notify the Corps of Engineers, Project Manager for this action, Mr. Andrew Williams, and other IRT members by letter, within 15 days of receipt of this notification. If there are no objections, please have the appropriate representative for your agency sign the attached final MBI signature page and return to, Mr. Andrew Williams, U.S. Army Corps of Engineers, 3331 Heritage Trade Drive, Suite 105, Wake Forest, North Carolina 27587, by no later than January 7, 2009.
