Dear Mr. Waldroup:
This letter is in reference to the City of Raleigh's Umbrella Mitigation Bank and the first
site proposed for banking inclusion, Proctor Farm. The Proctor Farm mitigation site has been
distributed for comment via a U.S. Army Corps of Engineer (Corps) issued public notice and has
also been reviewed by the Interagency Review Team (IRT) as prescribed in the 2008 Federal
Mitigation Rule (April 10, 2008 Revisions to 33 CFR Parts 325 and 332 and 40 CFR Part 230).
As you may know, the final IRT comment period for this site ended on November 301h
2009. Two agencies commented on this final plan, the North Carolina Historic Preservation
Office and the North Carolina Wildlife Resources Commission. Each of the agencies stated that
they had no further comments.
With this letter, it is understood that the Proctor Farm Mitigation Site will be
incorporated as the initial site into the City of Raleigh's Umbrella Mitigation Bank at the time the
banking instrument is officially executed. It is also understood that each additional site found
favorable by the IRT would be incorporated into this umbrella bank by modifying this
instrument. Instrument modification will take place as described within the above mentioned
2008 Federal Mitigation Rule.
