The project site consists of approximately 158.58 acres site located southeast of the intersection of Hodge Road and Interstate 495 (Knightdale Bypass), to the west of Hodge Road and
to the east of the Neuse River in Knightdale, North Carolina within Wake County. The Site is currently occupied by mixed hardwood -dominated forested area, approximately 0.38-acres
of wetland, and 9,297 linear feet of stream. The project site is bound by residential development and mixed hardwood -pine forests to the north and south, Hodge Road to the east, and
the Neuse River to the west.

The purpose of this project is to construct an affordable and family friendly residential subdivision with cohesion and the necessary amenities southwest of the Town of Knightdale.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The proposed residential development will consist of 276 single-family lots, 103 townhomes, and associated amenities including roadway, storrnwater control measures (SCMs), and
utility improvements (i.e. public water supply and sanitary sewer alignment). The project is located to the west of Hodge Road, south of Panther Rock Blvd and east of the Neuse River.
The proposed project requires the following impacts to jurisdictional features: three (3) road crossings, one (1) drainage/road impact, nine (9) drainage impacts, three (3) 30-ft wide
utility easements associated with gravity sewer line crossings. These impacts require 0.044 acres of permanent wetland impacts, 0.024-acres of temporary wetland impact, 283 linear
feet of permanent stream impact, 137 linear feet of temporary stream impact, 34,911 square feet of permanent Zone 1 buffer impacts, and 34,239 square feet of permanent Zone 2
buffer impacts.
Additional impacts to waters of the U.S. are not proposed. The proposed project is the final and complete phase of the project with appropriate land use control measures in place for
specific areas which require them. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment, graders, and earth movers.

The proposed road crossing impacts are required for connecting the southern and western portions of the site. The proposed utility impact is required
for the installation of the gravity sewer line. Both road crossings will include the installation of culverts along the adjacent streams to maintain the
hydrologic connection between the up gradient and down gradient areas.
Impact 7B is associated with the installation of a gravity sewer line and is considered a permanent, no net loss impact. The proposed sewer line will be
installed through temporary ground disturbance for open cut installation which is anticipated to cause temporary disturbance to the portions of the
wetland area located within the 30-ft wide easement. Upon completion of the temporary impacts, the area will be restored to pre -project contours and
elevations, stabilized, and re -seeded with a riparian mix

All permanent stream impacts are associated with road crossings required for connecting the southern and western portions of the site. Culverts will
be installed along each stream segment at these road crossings and will count toward compensatory mitigation. Culvert details, including the plan and
profile, for each road crossing are included in the attached Impact Maps.
The proposed temporary utility impacts are required for the installation of the gravity sewer line. The proposed sewer line will be installed through
open cut. Upon completion of the temporary impacts, the streambed will be restored to pre -project elevations and widths using natural streambed
material. The trench will be backfilled with the excavated natural streambed material to a depth of at least 12-inches or to bottom depth of impact area,
whichever is shallower. Streambanks will be restored to pre -project grade and contours.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning,
including the utilization of the wetland delineation to adjust the layout to avoid and minimize impacts during the design phase of the project. The
proposed impacts are required in order for the project's goals to be realized.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with
the requirements of the North Carolina Department of Environment and Natural Resources Erosion Control Planning and Design Manual (May 2013)
and local codes. All work will take place during dry conditions and can be facilitated from high , non -jurisdictional, stable ground. The contractor shall
install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and cleaning only as necessary to install
devices. All erosion and sediment control measures Will be checked for stability and operation following every runoff producing rainfall, but in no case
less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is
required and Will be kept by the owner's representative.
Measures will be taken to prevent oil, tar, trash, debris and other pollutants from entering the adjacent jurisdictional features. Any excess excavated
materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent
jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the
construction of this project. All project construction activities initialed within jurisdictional waters of the U.S. will be carried to completion in an
expeditious manner to minimize the period of disturbance within jurisdictional waters.

Wildlands Engineering was contacted for stream and buffer mitigation credits. Stream credits are available through Wildlands Holdings III, LLC, and
buffer credits are available through Wildlands Holdings V, LLC. Upon consultation with Wildlands, they currently only have partial stream credits
(341.3-ft) available. Further, both stream and buffer credits may no longer be available at the time of permit issuance.
Therefore, additional SOAs for the required stream and buffer mitigation credits were obtained from RES.

Impact 1 is a perpendicular road crossing which will result in impacts to more than 1/3-acre or the riparian buffer and is therefore Allowable with
Mitigation.
Zone 1 and Zone 2 Impacts associated with Impact 5B, 7B, and 10A are perpendicular sanitary sewer line utility impacts with a width of greater than
10-ft, and are therefore Allowable with Mitigation. A portion of impact 513 (1,567-sq. ft. in Zone 2) and impact 7C consist of non -perpendicular Zone 2
utility line impacts and are therefore Allowable, not requiring mitigation.
Impact 6 is a proposed drainage associated with a road crossing impact. f is required to connect a naturally low area located outside of the project's

Impacts 2A and 3A are perpendicular road crossings that impact less than 150-linear feet of buffer and less than 1/3-acre of buffer, and are therefore

USFWS IPaC noted 6 species with the potential to occur in the vicinity of the project area. These include the red -cockaded woodpecker, the Neuse
River waterdog, the Carolina madtom, the Atlantic pigtoe, the dwarf wedgmussel, and Michauxts sumac. There are no critical habitats in our project
area according to USFSW IPaC.
The red -cockaded woodpecker's habitat includes pine trees 60 years old or older. The project occurs on a site that was clearcut in 2013. This has led
to a dense mid -story and understory habitat which is not conducive to RCW foraging habitat. The project should have no effect on the red -cockaded
woodpecker.
The Neuse river voterdog, Carolina madtom, and Atlantic pigtoe all prefer habitat with excellent water quality, which does not include the streams on
this site. Further, the site is not located within critical habitat areas for any of these species. The project therefore may affect, but is not likely to
adversely affect these species.
Dwarf wedgemussel can be found in the Swift Creek sub -basin, which does not include our project area. The proposed project may affect, but should
not adversely affect the dwarf wedgemussel.
Michaux's sumac prefers open, disturbed areas as habitat. Due to the clearcut in 2013, the understory and mid -story are too dense to support
Michawes sumac. The proposed project should have no effect on Michawes sumac.
According to NCNHP, there is NHP Natural Area within the project area along the Neuse River. Dwarf Wedgemussel was observed in the project area
in 1951 and Neuse river wraterdog was observed in 1987. There have been no recent sightings of either species, according to NCNHP. Further, it
should be noted that the project review area overlaps with a portion of the Neuse River, which will not be impacted.

Therefore, the proposed project should have no effect on historic resources.

of Zone 2 Buffer Impact for gravity sewer line installation, and 1,227-sq. ft. of Zone 1 Buffer Impact & 831-sq. ft. of Zone 2 Buffer Impact for drainage of
SCMs which will attenuate flow and control nitrogen.

FEMA Flood Insurance Maps #3720173300J and #3720174300J (effective 5/2/2006) were used. The project's western side is located within Zone AE,
which is an area of special flood hazard area/part of the 100-year floodplain. Base flood elevation is at 174 feet.
A portion of the regulatory floodway is located along the western site boundary along the Neuse River but will remain undisturbed. The rest of the site
is in Zone X which is an area of minimal flood hazard outside of the 100-year floodplain.

The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally-protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel

Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.

communities, natural areas, and/or conservation/managed areas within the proposed project

If a Federally-listed species is documented within the project area or indicated within a one-mile
radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service
