Meeting Participants From: Phillip Todd NCDOT Project Development & Environmental Analysis Branch Subject: Chatham County, Meeting Minutes and Comments for Tick Creek Mitigation Plan, TIP No. U-2524 WM The North Carolina Department of Transportation (NCDOT) has identified a portion of Tick Creek for preservation and its tributary for stream restoration. A draft report dated September 2002 was provided to state and federal permitting agencies and an onsite meeting was held on September 25, 2002 to review the proposed mitigation plan. The following concern s/comments were made: • A need to preserve existing trees that provide shade and wildlife habitat. • Move stream to utilize existing trees for shading. • Installation of fencing to protect stream and buffer from cattle and abuse by people. • What are the long-term development plans for the watershed and any impacts. WWW.DOT.ORG RALEIGH NC RALEIGH NC 27699-1598 USFWS: A comparison of the existing conditions within the mitigation reaches and the habitat requirements of harperella should be provided. "The comparison should provide a compelling argument that the species is not likely to be adversely affected by the mitigation effort. " The proposed mitigation site has been evaluated not only by stream engineers but also by Earth Tech biologists familiar with harperella and its preferred habitat. While potential habitat for harperella may be present in Tick Creek, no direct construction activities are being proposed for Tick Creek. The only channel to be disturbed will be the UT to Tick Creek. This is a very small stream that does not provide suitable harperella habitat. Design standards for Sensitive Watersheds will be implemented during construction to control sediment from entering Tick Creek. Additionally, this project will be a Priority 1 restoration. The new channel will be constructed in the dry in the floodplain adjacent to the existing channel. In areas where the existing channel is crossed, water will be pumped around. Water will not be turned into the new channel until the banks are stabilized with vegetation or coir matting. General Comment and Section 2.2.5 USFWS: Where in-stream construction occurs, certain measures (outlined in the letter) should be implemented to ensure protection for all aquatic resources occurring downstream. Restoration of the UT to Tick Creek will be a Priority 1 restoration. The new channel will be constructed in the dry in the floodplain adjacent to the existing channel. In areas where the existing channel is restored (such as Reach 1) or crossed, water will be pumped around the construction area. Water will not be turned into the new channel until the banks are stabilized with vegetation or coir matting (Addressed in Sedimentation and Erosion Control Plans). No in-stream work is planned work during the Cape Fear shiner spawning season. NCDOT will observe the moratorium dates (April 1 to June 15) for this species. Large trees will be identified and avoided as possible. See previous response. Section 4.0, Figure 10 DWQ, EPA, and USFWS: Placement of the new stream channel should be moved closer to the existing tree line. This will provide shade to the stream channel, provide bank stabilization, and facilitate regeneration of species already present on the site. After reviewing the current stream alignment of the proposed UT channel through the Tick Creek floodplain, no changes will be made to the alignment. The proposed alignment (Figure 10d of the Plan) positions the steam along the existing trees, capitalizing on the shade provided. Effort will be made during construction to minimize any root system damage that may occur from placing the channel close to the trees, but some damage should be expected. Tick Creek Mitigation Plan April 11, 2003 Meeting Minutes and Comments Page 3 of 8 TIP No. U-2524 WM Section 4.4 USFWS: Do not plant pioneer species at the expense of future canopy species. No pioneer species such as sweetgum and red maple are being proposed. However, it should be noted that future canopy species are often slower growing species and it may be desirable to plant some faster growing species to proved shade and wildlife habitat while slower growing species develop. USFWS: Clearly describe the extent to which exotics will be removed. The NCDOT will initially remove the privet prior to construction, but will not be responsible for privet that could return before the end of the project. Privet, autumn olive, multiflora rose, Japanese honeysuckle, and Microstegium are our listed exotics. Section 5.0 USFWS: Monitoring should occur for five years following construction and include at least two bankfull events. Additionally 2 permanent cross-sections should be established per 1000 feet of stream restoration work. During the biannual review of the stream, the entire stream reach will be evaluated for any potential problem areas such as stream bank instability, in-stream structure failure or unsuccessful vegetation establishment. Beside permanent photographic points, photographs of good stable sections of the stream as well as potential problem areas will be taken. This will document the stability of the stream and the severity of the potential problem area(s) that may be encountered. A yearly report documenting the biannual visits to the stream mitigation site will be prepared. The report will contain photographs and written documentation of the stream during the monitoring phase. If during the biannual review a failure area of the stream reach is noted, the area will be evaluated in more detail to determine the corrective actions needed to resolve the problem. The NCDOT will take cross-sections in these failure areas and compare them to the established as-built cross-sections. If remediation of a failure area is required, a proposal will be submitted to the resource agencies for the needed work. Remedial actions will be taken as soon as possible barring any seasonal limitations at the site. The NCDOT does not recommend taking cross-sections under this proposal in order to avoid unnecessary survey work of areas that are not failing. The NCDOT believes surveying a large number of cross-sections and reviewing them in the office will not provide conclusive evidence about where cross-sections of the stream may be failing. A site visit would be needed to define whether the stream is actually failing. Upon completion of monitoring the stream site for three successful growing seasons, a final report will be prepared and presented to the resource agencies prior to a "Final Tick Creek Mitigation Plan April 11, 2003 Meeting Minutes and Comments Page 4 of 8 TIP No. U-2524 WM Review" of the project. If remedial action has been required during the monitoring period, an updated "as-built" section will be attached to the report. The stream mitigation site will be reviewed with the resource agencies for final approval of the stream reach. If the resource agencies require additional work to the stream, then the work will be performed as soon as possible barring any seasonal limitations of the site. Section 6.0 DWQ, EPA, and USFWS: Buffer areas along the waterways should be fenced to reduce or minimize long-term anthropogenic impacts. NCDOT currently has an option of a conservation easement. The conservation easement will likely be signed before June 2003 upon completion of the design plans. The Triangle Land Conservancy has been offered the land surrounding the Tick Creek Restoration Site, which will serve as an additional buffer to the project. NCDOT will not install fencing around the project if the Triangle Land Conservancy accepts the offer. The NCDOT will provide an "as-built" of the stream mitigation site within 90 days after construction has been completed. The "as-built" will include both profile and plan view of the completed stream project. The "as-built" will serve as the baseline during the monitoring phase. The "as-built" will consist of "red line" design plans which will also include the location of permanent photographic points and vegetation plots. The mitigation project will be monitored biannually for three years. The NCDOT recommends this "preventive" review in order to identify early the potential problem areas that may develop along the stream reach. As part of the biannual review, the entire stream reach will be visually monitored for stability and vegetation establishment. The NCDOT believes this walkthrough will ensure that the entire stream reach remains in good condition and provides a thorough, preventive review of the stream. Permanent photographic reference points along the stream will be established a part of the biannual monitoring. Section 7.0 EPA: 3:1 credit for Tick Creek, and 1:1 credit for the UT We concur DWQ: Feels it is unclear whether the proposed project is an "unusual situation" per NCDWQ's Flexible Stream Mitigation Policy. DWQ asks for additional data to support the proposal, as it is not clear that a stream harboring eight mussel taxa is uncommon for the Slate Belt region. (Earth Tech should probably ask for macrobenthos sampling in Tick Creek, which may reveal the presence of unusual species, further adding to the importance of restoration.) DWQ recommends NCDOT conduct additional mussel surveys in nearby creeks before a 3:1 mitigation ratio is considered. There is no mention of an acceptable mitigation ratio for the UT. Tick Creek Mitigation Plan April 11, 2003 Meeting Minutes and Comments Page 5 of 8 TIP No. U-2524 WM 1 USFWS: `The Service seeks greater justification for lower mitigation ratios based on the presence of rare mussels, other aquatic organisms, and the proximity to habitat of Federally protected species. While we fully understand the many threats to freshwater aquatic fauna, and constantly seek the recovery of listed species, these species represent the natural, historic organisms of piedmont streams. If the purpose of all stream restoration and preservation is to provide additional habitat or protect existing habitat for the flora and fauna of these streams, the normal goals of all stream mitigation efforts appear to encompass those given for the Tick Creek project. There is no question that mitigation credit can be given for preserving existing, relatively undisturbed streams. The question is the criterion that distinguishes "normal" preservation from truly extraordinary situations. If the majority of undisturbed streams contain some native mussels, then every instance of stream preservation would gradually come to be considered exceptional. In such a process, the cases of exceptional preservation would become the norm and the former ratio of ten-to-one mitigation credit would disappear. There would no longer be any cases of normal preservation and the exceptional would become routine. The Service seeks a clearer distinction between routine and exceptional cases of compensation by preservation. " The NCDOT does not understand NCDWQ's comment about acceptable mitigation ratio for the UT. The 1:1 mitigation credit for the UT is applicable because the proposed project will restore pattern, dimension and profile to the stream as well as reconnecting the stream to its floodplain. The NCDOT hopes its response will be assist the USFWS in differentiating "exceptional" preservation from "routine" preservation. The NCDOT understands the regulatory community has proposed a range of mitigation values to capture "routine" and "exceptional" preservation. The NCDOT understands that "routine" preservation involves protecting a stream reach with a conservation easement if the stream already has a stable pattern, dimension and profile along with an adequate buffer. An "exceptional" preservation site would include those four components but also contain uncommon elements, including but not limited to, rare fauna and flora. Historically, streams likely contained the four mentioned components, were connected to their floodplain and contained mussel species; however, human land use practices have lead to the degradation of many stream channels and buffer, disconnecting the stream from the floodplain and subsequently losing freshwater mussel species. However, Tick Creek Mitigation Site is an exception to these degraded systems, providing a valuable refugia for these freshwater mussel species. The NCDOT had originally planned to provide more pattern to Tick Creek. However, a cursory survey of the stream by NCDOT biologist and Ms. Judy Ratcliffe of NCWRC in May 2002 revealed the presence of rare mussels in the stream. The NCWRC stated it would not support the pattern change because these rare mussel species were present in the stream. The following information about mussel populations provides a summary of the field work (documentation of field work is found Appendix C of the mitigation plan) and watershed assessment that supports this opinion of Tick Creek as provided by mussel experts on NC mussel populations. Tick Creek Mitigation Plan April 11, 2003 Meeting Minutes and Comments Page 6 of 8 TIP No. U-2524 WM t The mussel survey conducted by NCDOT indicates that a very diverse mussel fauna occurs in this portion of Tick Creek. Mussel populations in the main channel of the Rocky River have shown declines in abundance and diversity in recent years. Thus, Tick Creek serves as a valuable refugia for these species, and it is a significant stream for maintaining species diversity in the Rocky River Sub-basin. Few other stream segments in the Rocky River Sub-basin contain such diversity. Additional mussel surveys in the watershed may result in the discovery of other stream segments that support a comparable mussel fauna. However, the potential for these discoveries of comparable fauna would not diminish the importance of Tick Creek for the continued viability of many of these species in the Rocky River Sub-basin. The Tick Creek surveys indicated that viable reproducing populations of a number of rare species are present in Tick Creek. DWQ questioned whether this was unusual in the Slate Belt Ecoregion. Based on the experience of Tim Savidge (NCDOT), there are other stream segments in the Slate Belt Ecoregion in other watersheds that have comparable diverse aquatic faunas; however, besides Tick Creek and Bear Creek, there are not any other stream segments like Tick Creek in the Rocky River Sub-basin. Therefore, Tick Creek is a valuable, exceptional resource that merits protection. The DWQ has recommended that mussel surveys also be conducted in nearby creeks such as Bear Creek, Landrum Creek and Harlands Creek. Although NCDOT has not conducted comprehensive mussel surveys in these water bodies, a limited amount of survey work has been done in these creeks. Bear Creek has been visited on a number of occasions by NCDOT biologists. Like Tick Creek, Bear Creek has a diverse mussel fauna. The Brook floater (Alasmidonta varicosa), a Federal Species of Concern, is known from Bear Creek. This species was not found during the Tick Creek survey. Conversely, the Carolina creekshell (Villosa vaughniana) was found in Tick Creek, but has not been reported from Bear Creek. However, as indicated in the survey report in Appendix C of the mitigation plan, subsequent surveys in Tick and Bear Creek may yield other species. Brief surveys by NCDOT biologists have been conducted in Landrum and Harland Creeks. The common eastern elliptio (Elliptio complanata) has been found in both creeks. Although intensive surveys for mussels were not conducted in these two creeks, it is apparent that mussel diversity and abundance is not as high in these creeks as it is in Tick and Bear Creeks. USFWS: For the UT, a mitigation ratio of 2:1 is suggested. It will take many decades for fish and wildlife benefits to be achieved. Many of the impacts from the Greensboro Western Loop occur in the Haw River drainage, while the project is in the Deep River drainage, and may be considered "off-site ". Furthermore, the mitigation site is over 30 miles from the impact sites. The Tick Creek site is being proposed as mitigation for impacts occurring in Hydrologic Unit 03030003 from construction the Greensboro Western Urban Loop (TIP No. U-2524 AB and AC). Impacts from sections of TIP No. U-2524 within the Haw River drainage basin are being mitigated through fees paid to the N.C. Wetland Restoration Program. Tick Creek Mitigation Plan Meeting Minutes and Comments TIP No. U-2524 WM April 11, 2003 Page 7 of 8 NCDOT is calculating stream impacts on a 2:1 basis (mitigating 1 foot of impact with 2 feet of restoration). This already takes into account loss of function while a mitigation site stabilizes and matures. Current USACE and DWQ guidelines allow for 1:1 mitigation ratios for Priority 1 stream restoration projects. NCDOT strongly believes that a 1:1 ratio for the UT to Tick Creek is warranted for project benefit outlined in the Section 7.0. USFWS: Prior to their endorsement of a 3:1 mitigation ratio, USFWS would like an assessment of possible degradation of the preservation site in both the short term (flve years) and long term (beyond five years). This would include actual evidence of planned development within the watershed and documentation of an eminent threat. NCDOT is not aware of any planned large residential, commercial, or industrial developments in the watershed. This review does not preclude the continued land use of agriculture and timber practices that already occurs. NCDOT is utilizing a watershed approach. to improving and maintaining water quality within the Tick Creek watershed. NCDOT is conducting searches as well as working with the Triangle Land Conservancy in identifying additional stream restoration, enhancement, and preservation sites to obtain as much buffer as possible to provide protection for this important watershed and improve water quality in Rocky River and Cape Fear shiner habitat. USFWS suggests that proposed work within the Tick Creek buffer may be better characterized as enhancement rather than preservation. "If the NCDOT is committed to removing those exotic shrubs, preventing their establishment, and augmenting natural vegetation within the riparian buffer the overall action may be more properly characterized as enhancement, specifically enhancement that augments channel stability, water quality, and stream ecology, but falls short of restoring both dimension and profile. " The NCDOT will initially remove the privet prior to construction, but will not be responsible for privet that could return before the end of the project. Channel Dimension NCDOT has expressed concern over side slopes steeper than 2:1. Based on their experience they are concerned that these steep slopes are difficult to construct and are unstable. Earth Tech believes that slopes must be greater than 2:1 to create the correct dimension for the stream type proposed. In this case an E-type stream is being proposed. The construction of each of the specific reaches is discussed in detail below. In all reaches the stream flow will be pumped around during construction and each channel built in the dry. Reach 1 Construction Reach 1 is currently a steep E-type channel of an E-type stream (Eb). The stream is overcome with exotic invasive vegetation and has no pattern. The new channel will provide grade control and deeper pools for habitat. Some of the existing channel will remain intact with only miner changes in thalweg location. 1:1 slopes are proposed on the outside meander bends in the pools and 1.5:1 slopes are proposed in the riffle sections. The existing bed material will be stockpiled and used to armor the new channel. The soils have a good amount of cohesive material, and the proposed channel is very small.
