Director Division of Water Quality March 14, 2007 CERTIFIED MAIL: RETURN RECEIPT REQUESTED #7006 0100 0000 8377 3244 Sandcastle Development Attn: Tom Barbour 47 Brookwood Road Staunton, VA 24401 DWQ Project # 04-0698 vs. 2 Tyrell County Subject Property: Cypress Retreat Subdivision Tyrell County, Scuppernong River [03-01-53, 30-14-4-(9), SC] REQUEST FOR MORE INFORMATION Dear Mr. Barbour: On January 26, 2007, the Division of Water Quality (DWQ) received your application dated December 1, 2006 to dredge 3744 cubic yards of Public Trust Waters to construct the proposed access channels to upland canal boat basin. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected isolated wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .1300 and 15A NCAC 2B .0200 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impact Justification (Avoidance and Minimization) The information provided in the application indicates that the canal system and the current basin system to the south are excavated to depths of -7.0 to -9.2 feet. The proposed connection to the Scuppernong River is only to the -5.5 to -6 foot contour. The deeper depths of the canal system present a concern that this project will create the potential for poor water quality. This issue was discussed in an environmental assessment (EA) circulated to the resource agencies reviewing this project in August of 2006. Flushing Model Please provide a flushing model for the basin system to provide sufficient information that the project as proposed or modified will not violate Water Quality Standazds. Please respond in writing within four weeks of the date of this letter by sending this information to Kyle Barnes of the DWQ Washington Regional Office and Ian McMillan of the 401 Oversight/Express unit in the Raleigh Central Office. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to isolated wetlands, waters or streams. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
