Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of additional information requested. Failure to submit all of the required items will lead to additional processing and review time for the permit application. For more information, visit the Water Quality Permitting Section Non -Discharge Permitting Unit web site: h ttp://Portal. ncdenr. or,-Aveblwglapsllau General —This form is required for all projects involving the generation, utilization, and or distribution of reclaimed water. At least one of the following forms must also be included in the application package. However, multiple forms may be applicable. Unless otherwise noted, the Applicant shall submit one original and two conies of the application and supporting documentation. Please check the boxes below as appropriate to indicate which additional forms are included in the application package: ❑ Reclaimed Water Generation (FORM: RWG) — for wastewater treatment facilities producing reclaimed water. ❑ Non -Conjunctive Utilization (FORM: RWNC) — for reclaimed water utilization activities, when the reclaimed water utilization activity is required in order to meet the wastewater disposal needs of the facility. ❑ Conjunctive Utilization (FORM: RWCU) — for reclaimed water utilization activities, when the reclaimed water option is not necessary to meet the wastewater disposal needs of the facility and other wastewater utilization/disposal methods are available. ❑ Bulk Distribution (FORM: RWBD) — for distribution of reclaimed water in a bulk manner. ® Distribution Lines (FORM: RWDL) — for construction of reclaimed water distribution lines. ❑ Wetland Augmentation (FORM: RWWA) — for projects seeking to utilize reclaimed water for the purpose of wetland augmentation. ❑ Local Program Approval (FORM: RWLPA) — for projects seeking permitting delegation for reclaimed water users. Please do not make any unauthorized content changes to this form. ® The applicant name in Item I.1. shall be consistent with the applicant name on the plans, specifications, agreements, etc. ® The Applicant's Certification on Page 3 of this form shall be signed in accordance with 15A NCAC 02T .0106(b). The application must be signed by a principal executive officer of at least the level of vice-president or his authorized representative for a corporation; by a general partner for a partnership or limited partnership; by the proprietor for a sole proprietorship; and by either an executive officer, an elected official in the highest level of elected office, or other authorized employee for a municipal, state, or other public entity. The "Effective Date" of this Agreement will be the date that final subdivision plat approval is granted by the Town. WHEREAS, the Developer seeks permission to subdivide a tract of property within the Town to be known as "The Vineyards Phase 1", Town Project # SUBD-2016-02, formerly known as "Section 5.1 — Thompson St. Subdivision" (the "Subdivision"), which is more particularly described on Exhibit A attached hereto and incorporated herein by this reference (the "Property"), the Property being part of Chatham Park Planned Development District approved by the Town (the "PDD"); and WHEREAS, the Town seeks to protect the health, safety and general welfare of the community by requiring the completion of various improvements in the Subdivision and thereby to limit the harmful effects of substandard subdivisions, including premature subdivision which leaves property undeveloped and unproductive; and Subdivision Improvement Agreement Page 2 WHEREAS, the purpose of this Agreement is to protect the Town from the cost of completing subdivision improvements itself and is not executed for the benefit of material furnishers, laborers, or others providing work, services or material to the Subdivision or for the benefit of lot or home buyers in the Subdivision; and. WHEREAS the mutual promises, covenants and obligations contained in this Agreement are authorized by state law and the Town's zoning and subdivision control laws; NOW, THEREFORE, the Parties hereby agree as follows: A. DEVELOPER'S OBLIGATIONS 1. IMPROVEMENTS: The Developer will construct and install, at its own expense, those on -site and off -site subdivision improvements required by the Town, as set forth in the records of the Town approving the PDD (including the associated "Master Plan" and "Additional Elements") and the Subdivision, including without limitation, all correspondence, cost estimates, subdivision plats, and other filings, which records are incorporated in this Agreement by reference (together, the "Town Records"), and including those subdivision improvements listed on Exhibit B attached hereto and incorporated herein by this reference (each, an "Improvement", and together, the "Improvements"). The Developer's obligation to complete the Improvements will arise upon final plat approval by the Town and will be independent of any obligations of the Town contained herein and will not be conditioned on the commencement of construction in the development or sale of any lots or improvements within the development. 2. SECURITY: To secure the performance of his obligations hereunder, the Developer will deposit with the Town on or prior to the Effective Date, adequate security an in an amount and form acceptable to the Town in its reasonable discretion, but not less than the amount determined by the Town Engineer sufficient to secure the satisfactory construction, installation, and completion of the Improvements based on a Completion Estimate letter from Robbie Oldham, PE, of Withers & Ravenel, dated October 14, 2019. 3. STANDARDS: The Developer will construct the Improvements according to the standards and specifications required by the Town as set forth in the Town Records or otherwise listed on Exhibit B attached hereto and incorporated herein by this reference. 4. WARRANTY: The Developer warrants that the Improvements, each and every one of them, will be free from defects for a period of one year from the date that the Town accepts the dedication of the applicable Improvements completed by the Developer (the "Warranty Period"). 5. COMPLETION PERIODS: The Improvements, each and every one of them, will be completed on or before the earlier of one year from the Effective Date or 45 days prior to the Expiration Date of the financial security (the "Completion Period"). The developer will not cease Subdivision Improvement Agreement Page 3 construction activities for any period of more than sixty (60) consecutive days (the "Abandonment Period"). 6. COMPLIANCE WITH LAW: The Developer will comply with all relevant laws, ordinances, and regulations in effect at the time of final subdivision plat approval when fulfilling its obligations under this Agreement. When necessary to protect public health, the Developer will be subject to laws, ordinances and regulations that become effective after final plat approval. 7. DEDICATION: The Developer will dedicate to the Town the Improvements required by the Town or otherwise listed on Exhibit. C attached hereto and incorporated herein by this reference pursuant to the procedure described in Paragraph BA below. B. TOWN'S OBLIGATIONS 1. PLAT APPROVAL: The Town will grant final subdivision plat approval to the Subdivision upon the execution of this Agreement by the Developer and the delivery of adequate security in an amount and form acceptable to the Town in its reasonable discretion. 2. INSPECTION AND CERTIFICATION: The Town or other appropriate agencies will inspect the Improvements as they are completed and, if acceptable to the Town or other appropriate agency, certify such Improvements as being in compliance with the required standards and specifications of the Town. Before obtaining certification of any such Improvement, the Developer will present to the Town valid lien waivers from all persons providing materials or performing work on the Improvement for which certification is sought. Certification by the Town does not constitute a waiver by the Town of the right to draw funds under the financial security on account of defects in or failure of any Improvement that is detected or which occurs following such certification. 3. NOTICE OF DEFECT: The Town will provide timely notice to the Developer whenever inspection reveals that an Improvement does not conform to the required standards and specifications or is otherwise defective. The Developer will have thirty (30) days from the issuance of such notice to cure or substantially cure the defect. The Town may not declare a default under this Agreement during the thirty (30) day cure period on account of any such defect unless it is clear that the Developer does not intend to cure the defect. The Developer will have no obligation to cure defects in or failure of any Improvement found to exist or occurring after the Town accepts dedication of the Improvement. 4. ACCEPTANCE OF DEDICATION: The Town will accept the dedication of any validly certified Improvement within thirty (30) days of the Developer's offer to dedicate the Improvement. The Town's acceptance of dedication is expressly conditioned on the presentation by the Developer of a policy of title insurance, where appropriate, for the benefit of the Town showing that the Developer owns the Improvement in fee simple and that there are no liens, encumbrances, or other restrictions on the Improvement unacceptable to the Town in its Subdivision Improvement Agreement Page 4 reasonable judgment. Acceptance of the dedication of any Improvement does not constitute a waiver by the Town of the right to draw funds under the letter of credit on account of any defect in or failure of the Improvement that is detected or which occurs after the acceptance of the dedication. 5. REDUCTION OF SECURITY: After the acceptance of any Improvement, the amount which the Town is entitled to draw on the financial security will be reduced by an amount equal to 90% of the estimated cost of the Improvement. At the request of the Developer, the Town will execute a certificate verifying the acceptance of the Improvement and waiving its right to draw on the financial security to the extent of such amount. A Developer in default under this Agreement will have no right to such a certificate. Upon the acceptance of all of the Improvements, the balance that may be drawn under the security will be available to the Town for ninety (90) days after expiration of the Warranty Period. 6. USE OF PROCEEDS: The Town will use funds drawn under the financial security only for the purposes of completing the Improvements or correcting defects in or failures of the Improvements. C. OTHER PROVISIONS 1. EVENTS OF DEFAULT: The following conditions, occurrences or actions will constitute a default by the Developer during the Completion Period: a. Developer's failure to commence construction of the Improvements within fourteen (14) days of final Subdivision plat approval; b. Developer's failure to complete construction of the Improvements within one (1) year of final Subdivision plat approval, unless otherwise extended by the Town; C. Developer's failure to cure the defective construction of any Improvement within the applicable cure period; d. Developer's failure to perform work within the Subdivision for a period of more than sixty (60) consecutive days; e. Developer's insolvency, the appointment of a receiver for the Developer or the filing of a voluntary or involuntary petition in bankruptcy respecting the Developer; f. Foreclosure of any lien against the Property or a portion of the Property or assignment or conveyance of the Property in lieu of foreclosure. g. Developer's failure to comply with any condition or obligation in this Agreement. Subdivision Improvement Agreement Page 5 h. The Town may not declare a default until written notice has been given to the Developer. 2. MEASURE OF DAMAGES: The measure of damages for breach of this Agreement will be the reasonable cost of completing the Improvements. For Improvements upon which construction has not begun, the estimated cost of the Improvements will be prima facie evidence of the minimum cost of completion; however, neither that amount, nor the amount of the financial security, establishes the maximum amount of the Developer's liability. The Town will be entitled to complete all unfinished Improvements at the time of default regardless of the extent to which development has taken place in the Subdivision or whether development ever commenced. 3. TOWN'S RIGHTS UPON DEFAULT: When any event of default occurs, the Town may draw on the financial security to the extent of the face amount of the security less 90% of the estimated cost of all Improvements previously accepted by the Town. The Town will have the right to complete Improvements itself or contract with a third party for completion, and the Developer hereby grants to the Town, its successors, assigns, agents, contractors, and employees a nonexclusive right and easement to enter the Property for the purposes of constructing, maintaining, and repairing such Improvements. Alternatively, the Town may assign the proceeds of financial security to a subsequent developer (or a lender) who has acquired the Subdivision by purchase, foreclosure or otherwise who will then have the same rights of completion as the Town if and only if the subsequent developer (or lender) agrees in writing to complete the unfinished Improvements. In addition, the Town also may suspend final plat approval during which time the Developer will have no right to sell, transfer or otherwise convey lots or homes within the Subdivision without the express written approval of the Town, or until the Improvements are completed and accepted by the Town. These remedies are cumulative in nature, except that during the Warranty Period, the Town's only remedy will be to draw funds under the financial security. This permit shall be effective from the date of issuance until rescinded, and shall be subject to the following conditions and limitations: I. SCHEDULES Upon completion of construction and prior to operation of the permitted distribution facilities, the Permittee shall submit an engineering certification from a North Carolina licensed Professional Engineer certifying that the permitted facilities have been constructed in accordance with G.S. 143- 215.1, Administrative Code Title 15A Subchapter 02U, this permit, and the Division -approved plans and specifications. For phased and partially certified facilities, the Permittee shall retain the responsibilfty to track further construction approved under this permit, and shall provide a final en ineerin . certification upon project completion. Easements for all the properties on which the distribution line is to be located. b. Specifications for future upstream and downstream reclaimed water distribution lines shall include quality assurance testing procedures, which shall be adhered to prior to operation of the reclaimed water distribution facilities permitted herein. [G.S. 143-215.1] H. PERFORMANCE STANDARDS The Permittee shall maintain and operate the subject reclaimed water distribution facilities so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, the Permittee shall take immediate corrective actions, including Division required actions, such as the construction of additional or replacement reclaimed water distribution facilities, or cessation of reclaimed water distribution. [15A NCAC 02T .0108(b)(1)(A)] 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. [15A NCAC 02T .0108(b)(1)(A)] 3. Construction of the reclaimed water distribution facilities permitted herein shall be scheduled as not to interrupt service of existing utilities. [15A NCAC 02T .0108(b)(1)(A)] 4. All reclaimed water valves, storage facilities, and outlets shall be tagged or labeled to warn the public or employees that the water is not intended for drinking. [15A NCAC 02U .0403(b)] 5. All reclaimed water piping, valves, outlets, and other appurtenances shall be color -coded, taped, or otherwise marked to identify the source of the water as being reclaimed water as follows: a. All reclaimed water piping and appurtenances shall be either colored purple (Pantone 522 or equivalent) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER - DO NOT DRINK" or be installed with a purple (Pantone 522 or equivalent) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three feet or less; b. Identification tape shall be at least three inches wide and have white or black lettering on purple (Pantone 522 or equivalent) field stating "CAUTION: RECLAIMED WATER - DO NOT DRINK". Identification tape shall be installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and run continuously the entire length of the pipe; and c. Existing underground distribution systems retrofitted for the purpose of conveying reclaimed water shall be taped or otherwise identified as noted in II.5.a. and II.5.b. This identification need not extend the entire length of the distribution system but shall be incorporated within 10 feet of crossing any potable water supply line or sanitary sewer line. [ 15A NCAC 02U .0403 (c)] 6. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by personnel authorized by the entity that operates the reclaimed water system. [15A NCAC 02U .0403(d)] 7. Hose bibs shall be located in locked, below grade vaults that shall be labeled as being of non -potable quality. As an alternative to the use of locked vaults with standard hose bib services, other locking mechanisms such as hose bibs that can only be operated by a tool may be placed above ground and labeled as non -potable water. [15A NCAC 02U .0403(e)] 8. There shall be no direct cross -connections between the reclaimed water and potable water systems, unless such connection has been approved by the Department pursuant to 15A NCAC 18C .0406. Reclaimed water distribution lines shall be located at least 5 feet horizontally from and 18 inches below any water line if practicable. If these separation distances cannot be met, the piping and integrity testing procedures shall meet water main standards in accordance with 15A NCAC 18C. [15A NCAC 02U .0403(h)] 10. Reclaimed water distribution lines shall not be less than 50 feet from a well unless the piping and integrity testing procedures meet water main standards in accordance with 15A NCAC 18C, but in no case shall they be less than 25 feet from a private well. [15A NCAC 02U .0403(i)] 11. Reclaimed water distribution lines shall meet the separation distances to sewer lines in accordance with 15A NCAC 02T .0305. [15A NCAC 02U .04030)] III. OPERATION AND MAINTENANCE REQUIREMENTS 1. The Permittee shall operate and maintain the subject facilities as a non -discharge system. [15A NCAC 02U .0101] 2. The Permittee shall maintain an Operation and Maintenance Plan, which shall include: a. A description of the operation of the system in detail to show what operations are necessary for the system to function and by whom the operations are to be conducted; b. A sampling and monitoring plan to evaluate quality of reclaimed water within the distribution system to provide quality assurance at the time of reuse, and specify actions to be taken in response to unsatisfactory monitoring results; c. A map of all reclaimed water distribution lines; d. A description of anticipated maintenance of the system; e. Provisions for safety measures, including restriction of access to the site and equipment; and £ Spill control provisions that include response to upsets and bypasses, including control, containment, and remediation, and contact information for personnel, emergency responders, and regulatory agencies. [15A NCAC 02U .0801(a)] 3. Only reclaimed water generated from Chatham Park Decentralized WRRF (Permit No. WQ0039375) shall be conveyed in the reclaimed water distribution facilities permitted herein. [15A NCAC 02U .0101] WQ0041029 Version 1.0 Shell Version 180901 Page 3 of 6 IV. MONITORING AND REPORTING REQUIREMENTS 1. The Permittee shall conduct and report any Division required monitoring necessary to evaluate this facility's impact on groundwater and surface water. [15A NCAC 02T .0108(c)] 2. Noncompliance Notification: The Permittee shall report to the Raleigh Regional Office, telephone number (919) 791-4200, within 24 hours of first knowledge of the following: a. Any failure rendering the reclaimed water distribution facilities incapable of adequately conveying the reclaimed water (e.g., mechanical or electrical failures, line blockages or breaks, etc.). b. Any failure resulting in a discharge to surface waters. c. Any discharge to land surface greater than or equal to 5,000 gallons. The Permittee shall document discharges less than 5,000 gallons to land surface, but do not require Regional Office notification. Emergencies requiring reporting outside normal business hours shall call the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. All noncompliance notifications shall file a written report to the Raleigh Regional Office within five days of first knowledge of the occurrence, and this report shall outline the actions proposed or taken to ensure the problem does not recur. [15A NCAC 02T .0108(b)(1)(A)] V. INSPECTIONS 1. The Permittee shall perform inspections and maintenance to ensure proper operation of the reclaimed water distribution facilities. [15A NCAC 02U .0801(i)] 2. The Permittee shall inspect the reclaimed water distribution facilities to prevent malfunctions, facility deterioration, and operator errors that may result in discharges of wastes to the environment, threats to human health, or public nuisances. The Permittee shall maintain an inspection log that includes the date and time of inspection, observations made, and maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of the inspection, and this log shall be made available to the Division upon request. [15A NCAC 02U .0801(h), 02U .0801(i)] 3. Division authorized representatives may, upon presentation of credentials, enter and inspect any property, premises, or place related to the reclaimed water distribution facilities permitted herein at any reasonable time for determining compliance with this permit. Division authorized representatives may inspect or copy records maintained under the terms and conditions of this permit, and may collect groundwater, surface water, or leachate samples. [G.S. 143-215.3(a)(2)] VI. GENERAL CONDITIONS 1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to a Division enforcement action. [G.S. 143-215.6A, 143-215.6B, 143-215.6C] 2. This permit is effective only with respect to the nature and volume of wastes described in the permit application, and Division -approved plans and specifications. [G.S. 143-215.1(d)] 3. Unless specifically requested and approved in this permit, there are no variances to administrative codes or general statutes governing the construction or operation of the facilities permitted herein. [15A NCAC 02T .0105(n)] 4. The issuance of this permit does not exempt the Permittee from complying with all statutes, rules, regulations, or ordinances that other jurisdictional government agencies (e.g., local, state, and federal) may require. If the permitted facilities change ownership, or the Permittee changes their name, the Permittee shall submit a permit modification request on Division -approved forms. The Permittee shall comply with all terms and conditions of this permit until the permit is transferred to the successor -owner. [G.S. 143- 215.1(d3)] 6. The Permittee shall retain a set of Division -approved plans and specifications for the life of the facilities permitted herein. [15A NCAC 02T .0105(o)] 7. This permit is subject to revocation or modification upon 60-day notice from the Division Director, in whole or part for: a. violation of any terms or conditions of this permit or Administrative Code Title 15A Subchapter 02U; b. obtaining a permit by misrepresentation or failure to disclose all relevant facts; c. the Permittee's refusal to allow authorized Department employees upon presentation of credentials: i. to enter the Permittee's premises where a system is located or where any records are required to be kept; ii. to have access to any permit required documents and records; iii. to inspect any monitoring equipment or method as required in this permit; or iv. to sample any pollutants; or d. a Division determination that the conditions of this permit are in conflict with North Carolina Administrative Code or General Statutes.
