Pfohl Carolina Sunrock, LLC 200 Horizon Drive,Suite 100 Raleigh, NC 276IS Subject: Notice of Violation NOV-2014-PC-0082 Carolina Sunrock—Butner Quarry NPDES Stormwater Permit NCG020072 Granville County Dear Mr. Pfohl: On March 25, 2014, Dave Parnell,from the Raleigh Regional Office of the North Carolina Division of Energy, Mineral and Land Resources (DEMLR) conducted a compliance evaluation inspection (CEI) at the referenced facility, located at 1001 West B Street in Butner, North Carolina. Cheng Zhang of the Division of Water Resources (DWR) accompanied Mr. Parnell during the site visit. The facility lies in the watershed of an unnamed tributary(UT) to Falls Lake, in the Neuse River Basin. The following observations were noted during the DEMLR inspection and file review: This facility is a gravel mining operation. Mr. Tony Sample was available on site during the inspection and provided valuable assistance to DEMLR and DWR staff. The DEMLR Stormwater Program has issued certificate of coverage (COC) NCG020072. The permit is current and was available to Mr. Parnell during a document review meeting,at the office of Mr. Sample, on March 28, 2014. The Stormwater Pollution Prevention Plan (SPPP) was reviewed by Mr. Parnell during that meeting. The SPPP met the intent of the NPDES permit. The Sunrock Butner Quarry has on-site tanks which are utilized during vehicle maintenance. The tanks were secured with secondary containment. Mr. Sample stated that he had failed to monitor the stormwater discharge outfalls (SDO), qualitatively and analytically,since 2010. It was at that time,the facility had ended a contract with a monitoring consultant. A subsequent file review revealed a Notice of Violation was issued for failing to monitor the SDO -dated July 10, 2008 (NOV-2008-PC-0498). SDO are to be analytically sampled once during a six month period, except when discharging wastewater, as is SDO # 10,which is monitored quarterly. The stormwater collection system location and the drainage area flowing to each SDO were reviewed during the inspection. Process water was flowing from the dewatering pond through Outfall #10 during the site visit. Requested response: You are directed to respond to this letter in writing to DEMLR at the address provided below within 30 days of receipt Please address the following items noted in bold: • Please provide a monitoring plan for the facility. Include in the monitoring plan, required qualitative and analytical monitoring of the Stormwater Discharge Outfalls. Additionally, pay particular attention to the permit requirement that analytical monitoring of the wastewater process water must be implemented on a monthly basis, when a facility fails to monitor. • Please adhere to the requirements of the NPDES permit with respect to the Tier program.
