CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Port Cape Fear, Inc. pursuant to an application filed on the 7
day of November, 1990 to enlarge a boat basin.
The Application provides adequate assurance that the
discharge of fill material into the waters of the Cape Fear River
in conjunction with the proposed boat basin enlargement in New
Hanover County will not result in a violation of applicable•Water
Quality:.Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are not
considered significant).
2. That mitigation follow the revised mitigation plan
for Port Cape Fear (21 January 1991) except that
monitoring shall be for 5 years after planting.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.
This the 22 day of March, 1991.

RE: Modification of Po Cape Fear Mitigation Plan
The planned modification of the above mentioned plan as
described in Robert Needham's letter to Bob Stroud on 4 June 1991
is acceptable to the Division of Environmental Management since
it poses no significant water quality issues.
I believe that an additional individual 401 Certification
would not be necessary since there would be no significant impact
of this change. If the Division of Coastal management needs a
modification of the 401 which is signed by (for) our Director,
please notify Ron Ferrell since I will be on vacation until July
25.

Revised Mitigation Plan for Port Cape Fear (21 Jan 1991)
Port Cape Fear needs to be enlarged and deepened in order to accomodate larger
boats in need of repair and maintenance. A permit for deepening the existing basin has
already been approved, but additional approval is needed for the enlargement of the
southeastern portion of the basin. This enlargement will take place primarily in uplands
except for a narrow fringe of marsh along the edge of the basin and around the upland
pennisula on the west side of the entrance channel. This fringe is dominanted primarily by
smooth cordgrass ( in alterniflora). A few other species are intermixed in some places.
These other species include: common reed (Phragnites ausLrwhia), salt meadow cordgrass
