Nash County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Claude Mayo Maevco Development,LLC 3051 Sunset Avenue Rocky Mount,NC 27804 Subject Property: Birchwood—AFTER-THE-FACT Ut to Sapony Creek [030302, 28-55-(5.5), WSIV,NSW] REQUEST FOR MORE INFORMATION Dear Mr. Mayo: On August 25,2009,the Division of Water Quality(DWQ)received your After-The-Fact application dated August 20, 2009,to fill or otherwise impact 0.243 acres of 404/wetland, and 0.00 square feet of Zone I Tar-Pamlico River basin protected riparian buffer, and 0.00 square feet of Zone 2 Tar-Pamlico River basin protected riparian buffer,to construct the proposed residential development at the site. On November 12, 2009,the DWQ received additional information from you,however,the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore,unless we receive five copies of the additional information requested below,we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information,your project will be formally , returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The soils report provided does not include.the level of the SHWT in close proximity to the proposed dry detention basin. Please provide in-field soil testing to determine the level of the Seasonal High Water Table(SHWT). 2. The information given in the soils report does not support the depth and placement of the dry detention basin. The soils report states: "Based on soil morphology the seasonal high water table can be considered to be within 2 ft. of the bottom of the dry detention basin for unknown(but probably brief)periods during the wetter seasons of the year." Based on this information,the pond will have to be redesigned such that it does not dewater the natural wetlands on the site. Chapter 17 of the DWQ BMP Manual,the SHWT must be at least two feet below the invert of the dry detention basin. Given the proximity of the dry detention basin to the wetland, it is extremely unlikely that this separation exists.
