During the pre -review process, it was noted that the following items were missing from the submitted application package: Pursuant to 15A NCAC 02T . 1104(a)(2)(A), the Applicant shall submit Engineering Plans that have been signed, sealed, and dated by a licensed North Carolina Professional Engineer. The submitted plans were sealed on multiple dates in April 2020 by Mark R. Sizemore (PE License No. 19004), however, review of the North Carolina Board of Examiners for Engineers and Surveyors directory (https://www.membersbase.com/ncbels/search) shows that Mr. Sizemore's license is inactive. Accordingly, the Division cannot accept the submitted Engineering Plans. In addition, it should be noted that Mr. Sizemore may have inappropriately sealed the seven plan sheets provided by FabTech. Pursuant to 21 NCAC 56 .0701(c)(3), a North Carolina licensed Professional Engineer shall not affix their signature or seal to any "plan or document not prepared under the licensee's direct supervisory control. Direct supervisory control (responsible charge) requires a licensee or employee to carry out all client contacts, provide internal and external financial control, oversee employee training, and exercise control and supervision over all job requirements to include research, planning, design, field supervision and work product review." Please note that the North Carolina Board of Examiners for Engineers and Surveyors is copied on this correspondence for their determination if the enclosed plans from FabTech have been properly sealed in accordance with their rules. Pursuant to 15A NCAC 02T .1104(a)(2)(B), the Applicant shall submit Specifications that have been signed, sealed, and dated by a licensed North Carolina Professional Engineer. Specifications shall include a description of materials to be used, methods of construction, and means for ensuring quality and integrity of the finished product, including leakage testing. 3. Pursuant to 15A NCAC 02T .1104(a)(2)(C), the Applicant shall submit Engineering Calculations that have been signed, sealed, and dated by a licensed North Carolina Professional Engineer. Engineering Calculations shall include hydraulic and pollutant loading for each unit, unit sizing criteria, hydraulic profile of the facilities, total dynamic head and system curve analysis for each pump, and buoyancy calculations. Accordingly, your permit major modification request is being returned as incomplete per the requirements in 15A NCAC 02T .0107(b). The success of the Water Quality Permitting Section's Non -Discharge Branch process depends upon the receipt of complete and accurate applications and supporting documentation. Please amend the application package to include the previously noted omitted items and resubmit with the appropriate permit processing fee. Please be advised that construction and/or operation of the subject facilities without a valid permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions in accordance with G.S. 143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be assessed for failure to secure a valid permit. Mr. David C.
