Anthony, will you please take the lead? Comments are Due May 7th (next Thursday), so if you can have something to by COB Tuesday, I'd really appreciate it. Sorry for the short deadline. I just spoke with Danny about and he agreed with us providing comments. As these are scoping comments, I believe we can keep our comments short just to ensure water quality is addressed and we keep our seat at the table. Specifically I would ensure the comments stated, at a min: 1. The need to address water quality with specific focus on the standards and classification of the waterbodies and how the moratorium window relief would impact biological integrity, best uses and conditions related to best use that are contained in the relevant standard. 2. The impacts of turbidity during moratoria, as related to water quality and standards described above. I think Robb's comments on the Surf City/North Topsail Beach CSRM EA Scoping are a great example to use. It's important to make these comments as DWR being a regulatory authority "enforces" the compliance with the resource agency comments. Also, commenting now in the scoping phase will ensure water quality issues are in the EA and will preserve our "seat at the table" to react to how the Corps addressed water quality in the EA. Lastly, it's unclear whether they will request a 401 for these projects. Corps Works has in the past, but being as there is no Federal permit to which to attach the 401, it's enforceability is ambiguous. Not sure if we can/should ask that in formal scoping comments, but something to consider.
