Dear Mr. Aiken,
I am in receipt of your letter on March 9, 2020 in regards to a compliance inspection for Nick
Waycaster Stone Company facility located at 5455 US. Highway 221 North, Marion, McDowell
County,North Carolina,performed by Isiah Reed from the Asheville Regional Office of The
Division of Energy, Mineral and Land Resources (DEMLR). The subject facility is covered by
NPDES Storm Water General Permit NCG07000 under Certificate of Coverage NCG070191.
On September 9, 2019, I, Kenneth Waycaster took ownership of the property in question.
After the inspection by Mr. Reed, I have taken immediate efforts to begin addressing the issues
stated in your letter. I am in the process of developing a Storm Water Pollution Prevention Plan
(S WPPP). I am also in the process of implementing the plan on site. It is my intention that when
Mr. Reed re-inspects the site on or after April 8, 2020 that I can present him with a S WPPP and
he can inspect my site with an implemented plan in hand and work with me to correct any
deficiencies that I may have.
In the past position of General Manager, I was unaware that Nick Waycaster Stone Company
was out of compliance with the NPDES Storm Water General Permit. Since I am now the
responsible party, I can assure you I will take all measures to comply and set a standard that I
