On May 23, 2003, the Division of Water Quality (DWQ) received your application dated May 23, 2003 to impact 21 feet of
perennial stream and 11,765 square feet (ft) of protected riparian buffers to construct the proposed greenway trail. The
DWQ has determinedthat your application was incomplete and/or provided inaccurate information as discussed below.
The DWQ will require additional information in order to process your application to impact protected wetland, streams
and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will
have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B.0233(8) and will place this
project on hold as incomplete until we receive this additional information. Please provide the following information so that
we may continue to review your project.
Additional Information:
1. Impact Map - The impact map needs to be greater detail ("blow-ups") to determine where the proposed impacts are
located and if there is a practical alternative to avoid them.
2. Stormwater - Please describe how you intend to handle the stormwater runoff from the trail and comply with the diffuse
flow requirement of the Tar-Pamlico Buffer Rule (15A NCAC 02B.0259(5)), stormwater management plans may help.
Please respond within three weeks of the date of this letter by sending this information to me in writing and Mr. Steve
Mitchell of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected
buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DW.Q.

On behalf of the Town of Knightdale, we hereby request authorization from the
US Army Corps of Engineers (USACE) and the North Carolina Division of Water
Quality (DWQ) to use Nationwide Permit 14 and its associated 401-Water Quality
Certification for the subject project to cover permanent impacts to wetlands and
jurisdictional stream channels resulting from the installation of a greenway trail.
A Pre-construction Notification Application (PCN) form is attached,.as well as an
agent authorization form from the Town of Knightdale.
The proposed portion of the project is located within the Widewaters Subdivision
Project (formerly the Robertson-Dement Property), which is located south of
Highway 64 and north of Mingo Creek in Knightdale, NC. The corridor runs
primarily within Zone 2 of the Neuse Buffers and parallel to an unnamed tributary
of Mingo Creek. Please refer to the attached map (Figure 1) for the project's
location on a USGS topographic quadrangle.
Resulting impacts to perennial channels will total 21 linear feet. Resulting
Buffer impacts will total 11,765 ft2 (1,059ft2 of Zone 1 and 10,77706 ft2 of
Zone 2).

VII. Impact Justification (Avoidance and Minimization)
