Dear Mr. Osborne:
On December 9, 2003, the Division of Water quality (DWQ) received your Pre-Construction Notification (PCN) application
to place 0.015 acres of fill within wetlands for the purpose of constructing a home at the subject property. The DWQ has
determined that your application was either incomplete and/or provided inaccurate information as discussed below. The
DWQ will require additional information in order to process your application to fill wetlands on the subject property.
Therefore, unless we receive the additional information requested below, we will have to move toward-denial of your
application as required by 15A NCAC 2H .02500 and will place this project on hold as incomplete until we receive this
additional information. Please provide the following information so that we may continue to review your project.
1. Section 1: Processing
In Section 1 (1) of the PCN application,,you did not check the box for "Section 404 Permit" and in Section 1 (2) you did
not state what Nationwide, Regional or Genioral Permit Number you are requesting to use. The proposed fill will most
likely require the use of a Permit from the U.S. Army Corps of Engineers (USACE) and Water Quality Certification
from the DWQ. Please contact the USACE Washington Regulatory Field Office (252-975-1616 ext. 25) to determine
which permit they will allow or suggest that y u use for the proposed activity if you have not already done so. Please
be sure to provide them with the Action ID number 199503797. Once you obtain this information, then please
complete Section 1 of the PCN application. this will allow us to determine which DWQ Water Quality Certification to
review the proposed fill under.
2. Section 8: River Basin
You did not complete Section 8 of the PCN application. Based on information provided in Section 7 and a map
search conducted by the DWQ staff to confirm the project's location, the DWQ determined that the proposed activity is
located within the Tar-Pamlico River Basin. Please confirm that this is accurate. This information is important to
determine which DWQ regulations apply to they property.

3. Section 10: Project Description
You stated in Section 10 of the PCN application that the overall project is "building house within "MBL" lines". The
DWQ staff assumed that you are referring to the "MBL" area designated on the preliminary plot plan provided with the
application. Please confirm that this is accurate. Please define the area of wetland fill on the proposed plot plan.

4. Section 11: Project Purpose
You stated in Section 11 of the PCN application that the purpose of the proposed work was "to fit the house on the lot
and within minimum boundary lines". The proposed footprint for the "2-story brick house" appears to be located within
the "MBL" area, but not over the "wetland limits" area. Therefore, it is not clear as to the location of the wetlands area
you are proposing to fill. Nor is it clear as to why you need to fill the wetlands to construct the home. Please provide
additional justification as to why a home can not be built on the lot without impacting the wetlands.
5. Section IV: Prior Project History
You stated in Section IV of the PCN application that a 404 Permit (Action I.D. 199503797) was received from the
USACE which "requested certification on a larger amount of wetlands area". You did not provide the DWQ Project
Number. The DWQ staff conducted a review of projects issued under your name. No projects were found. The DWQ
then conducted a review of projects issued under the subdivision name, "Ironwood". On August 14, 1995 the DWQ
authorized the use of General Water Quality Certification Number 2671 with additional conditions to impact 7.38 acres
of wetlands to construct the proposed Ironwood Subdivision / Golf Course Development under DWQ Project Number
95499 (see attached). This Certification allowed the applicant, "Ironwood Development, Inc.", to use Nationwide
Permit Number 26 previously permitted for use by the USACE on July 25, 1995. Your lot was identified on the
subdivision plans provided with the approved application. One of the conditions of the 1995 authorization was that a
"deed restriction shall be added to all lots with jurisdictional wetlands to prevent future wetland fill". The DWQ staff
could not find a request for an adjudicatory hearing to contest the conditions. As such, the DWQ staff assumes that
the conditions of the 1995 authorization where accepted and that the approved impacts have occurred.
As stated within the deed language provided with the 1995 authorization, "the intent of the deed restriction is to
prevent additional wetland fill, so the property owner should not assume that a future application for fill will be
approved". As such it is the inclination of the DWQ staff to deny your proposed request to fill the wetlands on the
property. Please provide additional justification as to why a home can not be built on the property without impacting
the wetlands.
Section VI (1): Impact' Description
You did not complete Section Vi (1) of the PCN application. Please complete this section and provide a written
description of the proposed impacts. Specifically, it is not clear whether you are proposing to fill the wetlands to
construct the home or to provide a lawn around the home. Please specify exactly how and why you intend to fill the
wetlands.
7. Section VI (2): Wetland Impacts
You did not complete the table within Section VI (2) of the PCN application. Please complete this section.
8. Section VII: Impact Justification (Avoidance and Minimization)
You stated within Section VII of the PCN application that you "need the area within the "MBL" to fit the house on the
lot". However, it appears based on the proposed plot plan that the house can be fit on the lot without impacting the
wetlands. Please provide additional justification as to why a house can not be built on the lot without impacting the
wetlands.
9. Section VIII: Mitigation
You stated in Section VIII of the PCN application that mitigation was not applicable for the proposed impacts. The
DWQ staff has determined that mitigation will be required for any wetlands filled on tlie'property due to the cumulative
wetland impacts that were approved in 1995. Therefore, please complete Section VIII of the PCN application and
state how you intend to mitigate for the proposed impacts.
10. Section XI: Stormwater
It is not clear what you meant by "none" in Section XI of the PCN application. Please describe the existing and
proposed impervious area versus the total area on the site and discuss stormwater controls proposed in order to
protect surface waters and wetlands downstream from the property. Another condition of the 1995 authorization was
that "stormwater shall be directed so as not to directly flow into streams on the property". Please complete this
section of the form and describe how you intend to comply with the stormwater condition of the 1995 authorization.

Please respond within three weeks of the date of this letter by sending this information to me in writing and to Mr. Tom
Steffens of the DWQ Washington Regional Office. If we do not hear from you within three weeks, we will assume that you
no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application roview and does not authorize any impacts to wetlands, waters or protected
buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.

02-1885 (see attached) was received on 12/00/02 and sent to the WaRO on 12/12/02. WaRO provided comments
sometime after 12/12/02 (comments were not dated) to "Issue n/c". It was then put in my box, presumably to write the
Issue letter, sometime after WaRO comments, I most likely saw WaRO comments to "Issue n/c" and put it in my pile of
projects to write approval letters on. I kept pushing it back to the end of the pile because other higher priority projects
came up. I failed to check the "drop dead" datle and as such the project is now past the 60-day review period and would
normally be waived. I found the file today andlbegan to write the "waiver " letter once I realized that it had past 60 days.
In writing the letter I came across the followings issues.
Basic facts provided within the PCN: The PCN was submitted by the property owner (possible homebuilder). The PCN
states that no buffers will be impacted and it doesn't appear that any will. The PCN states that they plan to build a "house
with in "MBL" lines". Todd sent it to the WaROI stating "proposed impact to wetlands but none are shown on plans". The
h "triage check list" also stated (not sure who wrote it), "discuss w/ applicant specifics of impact areas - just how much
needs to be impacted for what specific purposo -no need for impacts just to produce the "green carpet lawn" area". The
PCN stated under "prior project history", "Actiorl ID 199503797 - Requested certification on a larger amount of wetlands
area." It did not provide the "DWQ Project Nunhber".
My review on 2/18/03: 1 found the project location on the USGS and soil survey with the aid of the Pitt Co. ,web-based
GIS database. I checked Filemaker for any prior projects under the name Osborne. Nothing came up. I then checked for
any projects under the subdivision name (Ironwood) and found DWQ Project No. 95499 (see attached). [went to the lab
and pulled the file. It contained the DWQ Certification issued on August 14, 1995 and the USACE Permit 199503797.
The Certification required, "A deed restriction shall be added to all lots with jurisdictional wetlands to prevent future
wetland fill". It also required that "DEM shall b6copied on all mitigation reports including an as built report after
construction". The file did not contain any such reports. The 1995 "Joint Form" requested 1.67 acres of fill, 4.88 acres of
flooding and 0.83 acres of excavation. The authorization letter gave "approval to placed fill in 7.38 acres of wetlands or
waters". One of the "mitigation techniques" proposed in the 1995 cover letter was "(5) The total wetlands created and/or
enhanced will total a minimum of 10.78 acres". Jt looks like you circled "10.78" and wrote a note "inc. pond". The
Certification also required no direct discharge of! stormwater into the streams.
Does the fact that they failed to provide the "DWQ Project Number" in the "Prior Project History" section of the new PCN
constitute an incomplete application? If so, can we deny the project (or at least request additional information) based on
"no practical alternatives" and the 1995 deed restrictions? If not, please return and I'll write the waiver letter. I apologize
for letting this project slip through. `

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Tdpographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

IV. Prior Project History

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples' of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers t protect open waters such as streams; and replacing losses of
aquatic resource functions and v*lues by creating, restoring, enhancing, or preserving similar
functions and values, preferable ini the same watershed.
