The deepening and widening of the stream is considered to be an impact based on some typical details provided. Please indicate the length of stream that will be impacted in this manner. The channel is only being deepened and widened at the outlets of the proposed culverts to create a stable plunge pool. These impacts were indicated in the permit and on the plans as perennial stream impacts 1 (45'), and 4 (47'), and open water impact D (0.01 ac.). No other deepening of the channel is proposed as indicated in the profile sheets (Sheets 10-12). As shown on the drawing, the channel banks above bankfull are being widened in other locations. However, the proposed stabilization techniques will only modify/stabilize the banks in these locations above the existing low flow channel (bankfull elevation). As indicated in the typical details (FBS 1-3, & 5) the bank stabilization will involve creating bankfull benches, grading stream banks to a stable slope, and stabilizing with vegetation (herbaceous plugs, live stakes, and seed mix) and erosion control matting. The areas stabilized in this manner are not an impact because they are not hard (i.e. rip rap) and do not impact below bankfull (normal high water). 2. The proposed culvert extensions and dissipater pads are impacts if they extend beyond the existing footprint. Please enumerate these impacts and/or provide a signed map form the Corps showing what portions of the streams are not waters of the United States. As indicated in the permit, the jurisdictional determination of jurisdictional open water above JEB Stuart and perennial stream below was agreed to during a November 30, 2001 on-site pre-application meeting with USACOE and NCDENR-DWQ. Please contact Angie Pennock, Corp of Engineers Wilmington, for more information concerning this determination. All impacts are to jurisdictional waters of the United States. All four culverts are being replaced and two Culverts are being extended beyond the existing footprint. The culvert extensions are downstream of Stonewall Jackson Drive and upstream of JEB Stuart Drive. These culverts were extended to protect two residential homes that have experienced foundations cracking likely from channel erosion. These culvert extension open water impacts are indicated as C (0.02 ac.) and G (0.03 ac.) in the permit. Inlet and outlet protection (rip rap and rip rap plunge pools) were provided at the inlets and outlets of all culverts due to entrance and exit velocities. These impacts are open water impacts B (0.002 ac.), D (0.01 ac.), and F (0.001 ac.), and stream impacts 1 (45'), 3 (10'), and 4 (47'). 3. If the channel or bank hardening as well as stream widening and deepening are greater then 150 total, then stream mitigation will be required and a stream mitigation plan must be provided. It is possible that deepening and widening could be conducted in a manner that would not require mitigation. Please contact Todd St. John of the Raleigh Office at (919) 733-9584 to discuss. The cumulative impacts to streams on-site are 148 linear feet. The proposed bio-stabilization of the banks in the other areas in combination with using a geomorphic approach (Rosgen Priority III) of providing a bankfull bench will provide a water quality benefit that exceeds the impacts. The project is a proposed self-mitigating project. 4. If the total widening and deepening as well as hardening and culvert extensions are greater than 500 feet, a SEPA document may also be required. The stream impacts are less than 150 linear feet and the impacts to jurisdictional open water are less than 0.08 acres. KimleyHorn and Associates, Inc. 5. If the entire culvert is to be replaced, then an aquatic life passage should be provided. All the four culverts are going to be replaced. The new culverts will be buried 1 foot, per DWQ guidelines. I was and amspeaking on behalf of my grandmother who is directly impacted by this project. One of the many concerns thatcame up was the question of the type if any environmental impact study whether it be an assessment or a fullblown environmental impact had been conducted. The reason for the letter to you is my grandmotherhas been informed that construction activity could begin as soon as the first of the year. She was informed of this bythe Engineering firm Kimley Horn and Wilmington PE David Mayes via an unsigned letter that actionwas imminent. The question I have is what type of study has taken place keeping in mind that thiswaterway is shown on a USGS map as a blueline stream which could raise the level of research to anenvironmental impact study. I could not determine if there is federal funding involved after my discussionswith the City and contract PE. I was given a small bit of information from both parties such asthe reason for no EIS was that it appeared that the waterway path had been altered by man thuschanging the classification. My grandmother has said many times in the past that this was a naturalwaterway named Watkins branch that shows up as a blue line stream. Granted small modifications downstreamnear the Pine Valley Country club might have taken place but in my opinion that does not allowsomeone to change the classification of the stream and all of the protection allowed. The City of Wilmingtonis attempting to reclassify and rename this waterway from Watkins Branch a free flowing natural creekto LongStreet Canal with the intention of widening it by some 20+ feet to improve drainage. This drainage, huge increased load, and outflow eventually flows into a sensitive marine nursery I believe called Hewlettes Creek.This marine area near Wilmington is already closed to shellfishing and under huge environmental stressesfrom current development. My grandmother has many other issues yet tobe answered that will be directed toward the City of Wilmington. Any attention or assistance given Whelping answer the above questions and concerns is greatly appreciated. Redirect this mail tothe appropriate parties if needed. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. No other permits or jurisdictional determinations have been obtained for this area. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No future permits are anticipated VI. Proposed Impacts to Waters of the United States/Waters of the State Paue 7 of 17 It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Provide a written description of the proposed impacts: The majority of impacts will be to open water. The existing culvert below Stonewall Jackson Drive will be extended 130 feet to the south, and a rip-rapped plunge pool will be constructed at the end of the culvert to reduce erosion. The culvert below Jeb Stuart Drive will be extended 150 feet to the north. The banks of the drainage way between the two culverts will be stabilized using the Type 6 bank stabilization (See plan sheets for specifications of Type 6 bank stabilization). Additional rip-rap will be placed at the confluence of a drainage ditch and the Longstreet Drainage Way north of Stonewall Jackson Drive and at the culvert entrance to Stonewall Jackson drive. Impacts to open water will total less than 0.1 acres. See attached plans for conceptual stabilization details and location of culverts and rip-rap. A plunge pool impacting 45 linear feet of stream will be needed below the Jeb Stuart Road culvert to dissipate water energy and control bank erosion. In addition, rip-rap, a retaining wall, and Type 6 bank stabilization will be required to stabilize the banks around and downstream of the plunge pool due the close proximity of an existing structure. The plunge pool and bank stabilization will impact 81 linear feet of stream. Rip-rap will impact 10 feet of stream upstream of the Robert E. Lee drive culvert, and a 47 foot long plunge pool will be constructed using rip-rap downstream of the culvert to dissipate water energy. Stabilization matting, live stakes, herbaceous plugs, temporary- and permanent seeding, will be used to stabilized the remaining banks. 2. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. There will be minimal channel impacts from bank stabilization. The use of rip-rap has been minimized to those areas that, due to constraints from roads or adjacent structures, cannot be stabilized with only the use of anchored mattin amend plantings. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
