From conversations with Mr. Steve Cahoon, I understand that the US Army Corps of Engineers has decided that an additional 404 Permit will not be required for this activity. Therefore, a 401 Water Quality Certification is also not required. With respect to the Neuse River Riparian Buffer Protection rules (15A NCAC 26 .0233), 1 understand from conversations with Mr. Cahoon, that the material can be dredged and disposed of without removing any trees within 50 feet of the canal. Box 1000 l Washington, NC 27889-1000 Sub ect Maintenance Dred t P E H F L St El Ply In 1997, in a cooperative effort with the United States Army Corps of Engineers (COE), the North Carolina Division of Water Quality (DWQ), U,S. Fish & Wildlife Service (USF&WS) and North Carolina Division of Water Resources (DWR), the Quaker Neck Dam on the Neuse River was removed to allow, unrestricted upstream access for anadromous fish spawning. As part of the removal of the dam, (COE Action ID 199304749) the COE and DWQ agreed to allow periodic maintenance dredging of the bypass canal for a period of 10 years from the date of the issuance of the permit (March 15,1994) provided: 1) the permittee advise the District Engineer in writing at least two weeks prior to any maintenance dredging, 2) The proposed area to be dredged, method of dredging and disposal of dredged material will be in strict accordance with the permit, and 3) all dredged material will be placed and retained in high ground disposal area. Due to high river conditions over the spring and summer there has been a heavy amount of sediment deposition at the mouth of the pump station canal, which was originally constructed through high ground. The deposited material will be removed with a drag line or other suitable equipment and disposed of on a high ground site within the Lee Plant boundary. Since the material is in the mouth of the canal less than 300 cubic yards of material will need to be removed. No wetlands will be impacted by the dredging operation, and no deposited material will be allowed to reenter the water. The canal will be dredged to its original width and depth. Because operation of the Lee Plant is critical to Progress Energy's obligations to ensure adequate electric generation to the community, we would appreciate your review of this request as expeditiously as possible. Modification to Permit No. Action ID. 199304749 for Removal of Quaker Neck Dam and Associated Work Dear Dr. Wright: The NC Department of Environment, Health and Natural' Resources (DEHNR)' respectfully requests that the above referenced permit be modified to reflect the following changes in the scope of the project. 1. As issued, the permit indicates that the sheet pile weir proposed to be installed in the bypass canal will be located adjacent to the short canal which contains the lake makeup pumps (shown in Sheet 2 of 5 on the permit). We request that the permit be modified to show the weir location near the mouth of the, bypass canal as shown in Attachment 1 to this letter. / - 2. On the issued permit, attached sheet 5 of 5 showed that the elevation of the top of the sheet pile weir would be 56.2 feet. This elevation was based on a study conducted by the Corps to ensure that sufficient water would be available for operation of the Lee Plant makeup pumps during low river flow conditions. We are requesting that the permit be modified to show that the weir.height be increased to elevation 64.2 feet. This increased height will ensure that the weir is clearly visible to any recreational anglers or other boaters. 3. To ensure that sufficient water flow will be maintained in the bypass canal during low river flows, dredging of a small portion of the bypass canal will be required. We estimate that the amount of material to be dredged will be on the order of 500 cubic yards. We request that a provision for this dredging, as well as subsequent maintenance dredging of the bypass canal for a 10 year period, be added to the permit. All dredged material will be disposed of on high ground, except an estimated 150 cubic yards of',materia . which will be placed adjacent to the sheet pile weir to prevent scour. P.O. The purpose of those modifications was to reflect changes in the scope of work for this project. To date, we have not received a formal response to our request and would like to move ahead with this project. Efforts by the Corps, to modify the permit at that time, may have been put on hold pending resolution of several issues concerning project implementation. Please know that these issues are nearing resolution and the project is poised to move forward.
