Box 368 Linville, NC, 28646 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Clifton: You have our approval, in accordance with the attached conditions, to conduct bank stabilization measures on 300 linear feet of the Linville River associated with the Island Stackwall Project in Avery County, as described in your modified application received by the Division of Water Quality on November 21, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3399 which can be downloaded from our web site at httr)://h2o.enr.state.nc.us. This Certification allows you to use Nationwide Permit Number 13 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. You should send an application to the Division of Land Resources for their review of your project under dam safety rules as well as erosion and sediment control. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. Equipment used in the streams shall be in good working order and be free of oil leaks and drips. Equipment shall be checked daily for leaks and drips; 2. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 3. Throughout construction, upstream and downstream visual observation of stream conditions (for loss of sediment to waters) shall be conducted during rainfall events equal to or greater than 0.5 inches. If turbidity exceeds those required in 15 A NCAC 2B .0200, measure must be used to bring the project into compliance with this standard; 4. The stone wall shall not extend further into the lake than the existing timber retaining wall or ground surface. The stone wall shall not be constructed to an elevation higher than the existing timber retaining wall; 5. The drawdown on the lake shall not result in a discharge of sediment to downstream receiving waters; 6. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-construction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; N. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 8. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. How we draw down the lake - We have a 36" pipe placed through the darn several feet from the lake bottom. We open the pipe value and allow water to escape through the pipe and when we have the lake lowered to the proper level, we reduce the out flow to equal the incoming water to maintain the constant low water level. 2. Should we receive a 1/2-rain storm in a 24-hour period During January we do not experience many if any rain ^ only snow. However, if it does warm up enough and we do receive a rain storm, the lake will fll l up and overflow over the spillway and during this process, all sediment and silk will be caught in the lake and. will not be allowed to flow down stream. Also, we will be constant vigil to insure no sediment escapes during this process. v d j 22 '¢ NOV-21-2003 09:0? FROM: I!. ' " TO:WETLANDS s P: 13/14 ??i)999 G"i? Sullins, Deputy Director Division of Water Quality Asheville Regional Office WATER QUALITY SECTION November 5, 2003 CERTIFIED MAIL RETURN RECEIPT REQUESTED Mr. Norris Clifton Grandfather Golf & Country Club Post Office Box 368 Linville NC, 28646 Subject: Additional Information Request 401 Water Quality Certification Application Number: 03-1233 Status of Application: On Hold Grandfather Golf & Country Club - Island Stackwall Avery County Dear Mr. Clifton: The Division of Water Quality's Asheville Regional Office performed a site visit on November 4, 2003. At the time of this site visit, it was determined that the proposed purpose of the work is not suitable. (Application Item III, 11.) as no active erosion was observed at the site, this is not a suitable reason for a stabilization effort on an otherwise stabile shoreline. Additionally, as the existing timber retaining walls are mostly of a sound nature, it may be appropriate to apply to the Asheville Regulatory Office of the U.S. Army Corps of Engineers office for a "maintenance" permit for the replacement of the few decomposed timbers. Should you wish to pursue this project, a revised application must be submitted, including an approvable impact, a thoughtful discussion in regards to the impacts from the desired work (including habitat, land gain / losses, future instability due to a change in water velocity vectors, etc...), a thoughtful impact justification (including the impacts / gains from not performing the work, from the addition of woody vegetation to the stream banks, etc...), an approvable mitigation plan as the proposed impacts are greater than 300 linear feet. Also, a discussion of stormwater management and treatment for the development should be included, as to how stormwater will be managed during and after the desired construction activity. As the submitted application is incomplete, you must submit seven copies of an updated application, along with an approvable stormwater control plan, an approvable mitigation to my attention within 10 business days. Failure to provide the requested information will result in the application package being returned as incomplete.
