Dear Mr. Searle:
On February 11, 2005, you requested a 401 Water Quality Certification application/modification from
the Division of Water Quality (DWQ) for your project. We wrote to you on March 28, 2005
discussing concerns that we have regarding the design of the project and stating that it would be
placed on hold for three weeks giving you time to address DWQ's concerns. As of today, DWQ has
not received a response to this request. Therefore, your file is hereby considered withdrawn and will
not be reviewed until DWQ's earlier concerns are addressed. Once you have collected sufficient
information to have a complete application (please see our March 28, 2005 letter for the missing
information), you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina General
Statuses and Administrative Code. Please call Mr. Ian McMillan at 919-715-4631 if you have any

Dear Mr. Searle:
On February 11, 2005, the Division of Water Quality (DWQ) received your application/modification
request dated February 9, 2005 to impact 0.052 acres of estuarine waters and shoreline to construct the
proposed bulkhead. This work is proposed in addition to the overall subdivision for which a 401 Water
Quality Certification was issued on October 9, 2003. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on the
subject property. Therefore, unless we receive the additional information requested below, we will have
to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project
on hold as incomplete until we receive this additional information. Please provide the following
information so that we may continue to review your project.
Additional Information Requested:
1. Stormwater Management Plan
Condition #5 of the 401 Certification issued on October 9, 2003 required that a stormwater
management plan be approved by this Office prior to proceeding with this work. As stated in the
Certification, a State Stormwater Permit would also suffice to meet this condition. Please provide a
copy of your stormwater management plan so that you can demonstrate compliance with your
existing Certification and so that we can proceed with your modification.
2. Please provide a statement indicating that no marina activities are proposed to be conducted
within the scope of this project.

This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not

APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. Wilton:
You have our approval, in accordance with the attached conditions, to disturb 4.0 acres of Estuarine Shoreline and
to pave and/or cover 0.64 acre of Public Trust Area and Estuarine Shoreline in order to construct the Pelican Pointe
residential and commercial subdivision in Pasquotank County, as described in your application received by the Division of
Water Quality on September 22, 2003. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3400, which can be downloaded from our web site at
httg://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC
Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed,
Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur; Aft

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum ext
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, tr
shall be removed and the natural grade restored within six months of the date that the Division of Le
Resources has released the project;
5. An additional condition is that a final, written stormwater management plan (including a signed and notari2
Operation and Maintenance Agreement) shall be approved in writing by this Office before the impacts specif
in this Certification occur. The stormwater management plan must include plans and specifications
stormwater management facilities that are appropriate for surface waters classified as Class C and designec
remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Managem
Practices Manual. These facilities must be designed to treat the runoff from the entire project, unless otherw
explicitly approved by the Division of Water Quality. Also, before any permanent building is occupied at
subject site, the facilities (as approved by this Office) shall be constructed and operational, and the stormwe
management plan (as approved by this Office) shall be implemented. The structural stormwater practices
approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to
structural stormwater practices shall be made without written authorization from the Division of Water Quality
State Stormwater Permit (15 A NCAC 2H .1000) can be considered to meet this condition;
6. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters
protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanis
shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under t
Certification Approval and Authorization Certificate. A sample deed notification can be downloaded from
401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapte
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigt
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If y,

8. PROJECT SUMMARY: The applicant proposes to realign an existing bulkhead within a man-made
canal on NC 34 north of the Coast Guard Air Station, Elizabeth City, in Pasquotank County.

The site of the development proposal is approximately a 145.9 acres tract adjacent to the north
boundary of the U.S. Coast Guard Air Station, on NC 34, Elizabeth City, in Pasquotank County and
on the Pasquotank River. The property has an elevation from 3 feet to 7 feet above normal water
level (NWL) and has Mattapex, Bertie and Barclay soils. Most of the property has been used for
agricultural crop production and is flat, and is currently being developed as a subdivision for single-
family dwellings, a planned unit village and a commercial area, authorized by CAMA Major Permit
#160-03.
The shoreline along the Pasquotank River has a bulkhead for shoreline protection. The north side of
the property is bounded by Pelican Creek, which is a man-made canal that connects to the Pasquotank
River through a basin area. A portion of the basin shoreline has a bulkhead, which was authorized by
CAMA Major Permit #107-95. The shoreline along Pelican Creek is vegetated with groves of sweet
gum, pine, oak, maple and cypress as well as indigenous grasses. The canal is approximately 4,000
feet long, 100 feet wide and approximately -4 feet deep.
The adjacent riparian property to the west is a trailer park. Existing man-made features on the
property other than the canal consist of a paved road system, a pond, a sales office, a boat ramp and a
bulkhead along the upstream area of the canal. Construction is underway for several homes in the
subdivision and several more have been completed.
The waters of the Pasquotank River in this area are classified as SB by the Division of Environmental
Management and are closed to shellfish taking.
The applicant proposes to replace a shoreline bulkhead located along the east shoreline of Pelican
Creek. The existing bulkhead is approximately 176.2 feet long and has an irregular alignment. The
applicant proposes to construct a bulkhead with a straight alignment, approximately 147 feet long with
a maximum distance waterward of NWL of 24 feet and a maximum distance landward of 28 feet. The
proposed bulkhead alignment will include a 20-foot long section of canal shoreline that currently has
no bulkhead. The existing water depths in the area of the project site range from -3-1/2 feet to -8 feet
below NWL.
The applicant proposes to remove approximately 106 feet of the old bulkhead and excavate
approximately 1,471 square feet of uplands located behind the old bulkhead to a depth consistent with
the adjacent canal bottom. The proposed bulkhead length for this section is 73.9 feet.
The proposed bulkhead waterward of NWL will be a 72.9-foot long section in Pelican Creek and will
require 833 square feet of the canal to be filled.

The proposed bulkhead alignment will result in approximately 833 square feet of Public Trust Area
(PTA), Estuarine Water (EW) Areas of Environmental Concern (AEC) canal bottom being filled, and
approximately 1,471 square feet of Estuarine Shoreline (ES) AEC being excavated to an average depth
of 7 feet, thus creating an offsetting area of PTA, EW AECs. Approximately 125 cubic yards of fill
material will be placed below NWL and approximately 380 cubic yards of material be excavated
below NWL.

claiming to be the owner' of said property, then

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to

8. PROJECT SUMMARY: The applicant proposes to construct a residential subdivision with four
boardwalks along a man-made canal and the Pasquotank River located on NC 34 north of the Coast
Guard Air Station, Elizabeth City, Pasquotank County.

Project Setting
The site of the development proposal is approximately 145.9 acres tract adjacent to the north boundary
of the U.S. Coast Guard Air Station, on NC 34, Elizabeth City, Pasquotank County and on the
Pasquotank River. The property has an elevation of from 3 ft to 7 ft above normal water level (NWL)
and has Mattapex, Bertie and Barclay soils. Most of the property has been used for agricultural crop
production and is flat.
The shoreline along the Pasquotank River has a bulkhead for shoreline protection. The north side of
the property is bounded by Pelican Creek, which is a man-made canal that connects to the Pasquotank
River through a basin area. A portion of the basin shoreline has a bulkhead, which was authorized by
CAMA Major Permit #107-95. The shoreline along Pelican Creek is vegetated with groves of sweet
gum, pine, oak, maple and cypress as well as indigenous grasses. The canal is approximately 4,000 ft
long, 100 ft wide and approximately -4 ft deep.
The adjacent riparian property to the west is a trailer park. Existing man-made features on the property
other than the canal consist of a gravel road system, a pond, a sales office, a boatramp and a bulkhead
along the upstream area of the canal. Construction is underway for the road system of the subdivision.
The waters of the Pasquotank River in this area are classified as SB by the Division of Environmental
Management and are closed to shellfish taking.
Development Proposal
The applicant proposes to subdivide the property into 107 single family residential building lots which
will occupy a majority of the property area and a 106 unit adult community called Pelican Pointe Village
which occupies approximately 21 acres. The entire project will have approximately 11,345 ft of paved
roadway approximately 20 ft wide. Approximately 8,000 sq ft of pavement will be located within 75 ft of
the adjacent canal near the basin area. The roadway located in the area designated for single-family
building lots will be drained by open grassed swales. Nine swales are proposed to be constructed from
the roadway to the adjacent canal and two are proposed to be constructed from the roadway to the
Pasquotank River. Temporary stone sediment traps are proposed to be installed at the shoreline in the
swales and will be removed after the swales are vegetated.
In the area of Pelican Pointe Village, 31 units of the planned 106 units will either be within 75 ft of the
NWL of the canal or will have a portion of the building footprint within 75 ft of the NWL of the canal.
The applicant proposes to construct a walking trail along the shoreline for the village area. The trail will
be constructed of wood chips or gravel and will be approximately 8 ft wide and approximately 3,000 ft
long and will be located within 30 ft of the NWL of the canal. Four boardwalks, each 8 ft wide, are
proposed to be constructed adjacent to the shoreline in the canal as part of the trail system. The
individual boardwalk lengths will be 172 ft, 227 ft, 353 ft and 192 ft. A gazebo 18' x 18' is proposed to
be located at the point.

Anticipated Impacts
The roadway for the proposed development will result in approximately 227,000 sq ft of pavement of
which 8,000 sq ft will be located within the Estuarine Shoreline (ES) Area of Environmental Concern
(AEC).
In the area of Pelican Village, approximately 20,058 sq ft of ES AEC will be covered by impervious
surface by the construction of the adult housing units and the gazebo. This represents approximately 7%
impervious coverage within the ES AEC. The construction of the boardwalks will result in the shading of
approximately 7,552 sq ft of Public Trust Area and Estuarine Waters AECs within the existing man-made
canal. The Pelican Village area shoreline is approximately 4,000 ft long. It is anticipated that a
stormwater management plan and a sedimentation and erosion control plan will be required. All public
utilities including water, sewer and power will be provided by the City of Elizabeth City.
The total amount of land disturbance involved with the project as proposed is 52.42 acres of which,
approximately 4 acres are located within the ES. This involves the proposed drainage swales as well as
anticipated grading and landscaping.
Temporary water turbidity will occur during construction of the wooden boardwalks over the canal.

Design Narrative
Page Development Company LLC is proposing the development of a new mixed-use
residential/commercial subdivision. The proposed development will include the construction of a
roadways infrastructure and the necessary utilities to serve the development. Storm water
management of the low-density residential areas will be by swales and over land flows, the
higher density commercial and town home areas will require wet detenton ponds for treatment.
Addition information and calculations on the project storm water manage systems will be
provided in more detail as this report progresses.
The project site is approximately 139.4 acres. The site is located in Pasquotank County, with in
the city limits of Elizabeth City, NC. The project is on NC 34, adjacent to the US Coast Guard
Base to the West, the Pasquotank River to the North, and a man made canal to the East.
The majority of the project site is currently used for agriculture crops, a small area of
undisturbed lands exists on the point, near the Pasquotank River and along the man made
channel. These small undisturbed areas are made up of turkey oak, scattered longleaf pines,
and limited ground cover.
The Soil Survey of Pasquotank County is dated and requires cross-reference with Camden
County's soil properties, (a cross reference sheet is included) the soils within the project area
are Barclay silt loam, Roanoke/Perquimans, Udorthents loam, Yeopim silt loam and
Pasquotank silt loam. These soil types' hydrologic groups range from "B" to "D", have an
apparent high water table 1 to 4 feet below grade and the permeability is generally slow at
approximately 0.2 to 6.0 inches per hour. The project soil characteristics indicated above will
benefit and support a wet detention pond treatment system.
The project is within the Pasquotank River Basin and drains to Pasquotank River, stream class
SB; stream index number 30-3-(12).
The project is broken up in to three (3) drainage basins (see drainage basin mar Ch,$).

Drainage basins 1 and 2 are high density, storm water runoff from these drainage basin s be
conveyed to one of two wet detention ponds, via overland flow, storm inlets, culverts and

grassed swales. Storm water treatment, from the proposed improvements, will be prov n
the wet detention ponds. The detention ponds have been designed in accordance with
NCDENR Best Management Practices (BMP). Both ponds' designed length to width ratio is
approximately 3:1 and includes a fore-bay volume of 20% of the ponds overall volume. P ond
side slopes are 3H to 1V, with 6H to 1V planted littoral shelf. The littoral shelf is provided just
below the control water surface elevation. The permanent pool depths of pond #1 and #2 is 7
feet. The pond will detain the 1" rainfall volume from the projects drainage basins. Th e 1"
rainfall volume will draw down throw a 3" orifice in Pond #1, in 3.28 days and a 3" orific e in
Pond #2, in 2.83 days. Storm water in excess of the 1" rainfall volume will overflow the po nd's
riser structure and discharge to the drainage channel along the property line bordering the US
Coast Guard base. The permanent pool water elevations of both pond #1 and #2 is 3. 0 ft.

overflow riser structure. The water elevation of the pond #1 realizes an elevation of 4.49 du ring
a 24-hour 10-year storm event, 5.05 during the 24-hour 50-year storm event and 5.65 du
the 24-hour 100-year storm event. The water elevation of the pond #2 realizes an elevatio ring

4.60 during a 24-hour 10-year storm event, 4.89 during the 24-hour 50-year storm event and
5.24 during the 24-hour 100-year storm event.
The emergency overflows of both ponds, is at elevation 6.00 and discharges from the ponds to
the drainage channel along the property line bordering the US Coast Guard base. The 24-hour
100-year storm event water elevation of both ponds is well below the ponds top elevations.

Drainage basin 3 is made up 107 residential lot of approximately 5/8 acres each and some
common areas, the built upon area of this basin shall be no more that 30%. Storm water runoff
is conveyed to the channels to the North and South and the Pasquotank River, via overland
flow, storm culverts and grassed swales. The swales have been design with 4 to 1 and 6 to 1
side slope and 10-year storm velocities are less than 2.0 feet per second for all swales.
