Jurisdictional de te rmination upload The project Site is a planned residential development that consists of an approximately 189.34-acre parcel located at 1408 & 1520 New Bethel Church Road, within Garner, North Carolina (Wake County). The project Site is bound by New Bethel Church Road to the north and residential homes and forest to the south, west, and east. Approximately 50% of the site is comprised of agricultural fields with the remainder of the site being occupied by hardwood forest and planted pine forest. The proposed residential development will consist of 180 townhome lots and 364 single-family lots and associated amenities, roadway, stormwater control measures, and utility improvements (i.e. public water supply and sanitary sewer alignment). A delineation of the Site was completed by S&EC in early 2019, and a site visit was conducted with Dave Bailey of the USACE on March 22, 2019 confirming the boundaries utilized for avoidance and minimization during project planning. Impacts associated with the proposed project are limited to those necessary for one road crossing to connect the northern and southern portions of the site, minor wetland and stream impacts associated with installation of a greenway system, and minor impacts to Zone 2 Stream Buffers for site grading. The project site will include approximately 364 single family homes, 180 townhomes, and associated amenities (including roads, stormwater control measures (SCMs), utility improvements, and a greenway). All work will be conducted in accordance with local, state, and federal regulations. Impact Justification and Mitigation Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts proposed are necessary in order for the project's goals to be realized. The proposed sewer line was designed at a minimal slope while staying as consistent as possible with natural grade. A portion of the sewer line was designed as an aerial crossing to both avoid permanent stream/wetland impacts and allow for appropriate slopes. Further, the proposed sewer line was placed in a way to minimize wetland and stream impacts to the maximum extent practicable and was adjusted to limit stream buffer impacts to only portions of Buffer Zone 2. Only one road crossing is proposed for connecting the northern and southern portions of the proposed development, avoiding additional crossing impacts down-stream. Further, the crossing was designed to use headwalls to minimize the amount of grading required. A culvert will be installed beneath the crossing to maintain the hydrologic connection of the wetland up and down-slope. Impacts associated with the development's 10-ft wide greenway trail system and the 30-ft public greenway easement (required by the local municipality) were designed around the delineation in order to minimize the amount of crossing, and place all unavoidable impacts in upslope and narrow areas, reducing impact amounts. Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non-jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and clearing only as necessary to install devices.
