Please find attached the updated PCN, Impact Map (WTIM), Site Plans (E&SC), and Culvert Crossing detail in
response to the request for additional information received on April 1, 2020. The impact numbers changed
slightly while making sure our impact maps were consistent with the approved site plans, but have been
updated in the attached PCN.
1. The request for cross section details included and previously provided in response to the USACE request
for information on 4/8/2020.
2. Dewatering methods are depicted on the Erosion & Sediment Control Plans, including depictions of the
proposed pump -around system and construction sequencing (Stream Construction Sequence details on
sheet C11.0 of pdf, depiction of pump around on sheet C11.10)
3. We have updated both the WTIM, plan, and PCN to ensure proposed impacts are consistent across plans.
4. What was previously impact 5 has been removed. **note, buffer impact numbers have been adjusted

The project Site is a planned residential development that consists of an approximately 189.34-acre parcel located at 1408 & 1520 New Bethel Church Road, within Garner, North
Carolina (Wake County). The project Site is bound by New Bethel Church Road to the north and residential homes and forest to the south, west, and east. Approximately 50% of the site
is comprised of agricultural fields with the remainder of the site being occupied by hardwood forest and planted pine forest.
The proposed residential development will consist of 180 townhome lots and 364 single-family lots and associated amenities, roadway, stormwater control measures, and utility
improvements (i.e. public water supply and sanitary sewer alignment).
A delineation of the Site was completed by S&EC in early 2019, and a site visit was conducted with Dave Bailey of the USACE on March 22, 2019 confirming the boundaries utilized for
avoidance and minimization during project planning. Impacts associated with the proposed project are limited to those necessary for one road crossing to connect the northern and
southern portions of the site, minor wetland and stream impacts associated with installation of a greenway system, and minor impacts to Zone 2 Stream Buffers for site grading.

The purpose of the project is to construct a single-family residential subdivision with community cohesion and the necessary amenities within the southeastern section of Wake County.
Magnolia Walk is a multi-phased residential development project that is located at 1408 & 1520 New Bethel Church Road, within Garner, North Carolina (Wake County).
The project site will include approximately 364 single family homes, 180 townhomes, and associated amenities (including roads, stormwater control measures (SCMs), utility
improvements, and a greenway).
All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment,
graders, and earth movers. SCMs are required and will be used.

S&EC submitted a combined Preliminary and Approved Jurisdictional Determination Request for the project Site. Dave Bailey of the USACE conducted a site inspection with S&EC on
March 22, 2019 reviewing and confirming the delineated boundaries utilized for site planning. The AJD portion of the review was limited to a non-jurisdictional farm pond located within
high ground. All other areas were included as part of the PJD review. Please see attached confirmed delineation map and email from Dave Bailey confirming delineation.

Magnolia Walk is a 3-phased residential development, consisting of 3 phases, which will be for the development of 364 single family homes, 180 townhomes, and associated amenities.
Phase 1 will total 68.47 acres and contain 129 single family homes with an average lot size of 5,175 square feet and 48 townhome units with a minimum width of 22 feet. Phase 2 will

Impact 3 consists of 859-sq. ft. of temporary wetland impacts in order to install a sewer line aerially through the area. Impacted areas will be
stabilized and re-seeded immediately following installation.

Impact 1 consists of 61-ft of permanent stream impact associated with the installation of a 48" corrugated plastic pipe (CPP) culvert to allow for a
greenway trail crossing. The impact is necessary due to requirements of the local municipality to have a walking path connection in this area if no road
crossing is proposed. The proposed culvert will be countersunk beneath the greenway crossing to maintain the upstream and downstream hydrologic

Impacts 5 through 6 are permanent impacts to Buffer Zone 2 along a portion of the stream buffer for delineation feature B is required for
grading associated with the proposed road crossing, sewer line, and lot development.

E. Impact Justification and Mitigation
Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning,
including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts
proposed are necessary in order for the project's goals to be realized.
The proposed sewer line was designed at a minimal slope while staying as consistent as possible with natural grade. A portion of the sewer line was
designed as an aerial crossing to both avoid permanent stream/wetland impacts and allow for appropriate slopes. Further, the proposed sewer line
was placed in a way to minimize wetland and stream impacts to the maximum extent practicable and was adjusted to limit stream buffer impacts to only
portions of Buffer Zone 2.
Only one road crossing is proposed for connecting the northern and southern portions of the proposed development, avoiding additional crossing
impacts down-stream. Further, the crossing was designed to use headwalls to minimize the amount of grading required. A culvert will be installed
beneath the crossing to maintain the hydrologic connection of the wetland up and down-slope.
Impacts associated with the development's 10-ft wide greenway trail system and the 30-ft public greenway easement (required by the local
municipality) were designed around the delineation in order to minimize the amount of crossing, and place all unavoidable impacts in upslope and
narrow areas, reducing impact amounts.
Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with
the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013)
and local codes. All work will take place during dry conditions and can be facilitated from high, non-jurisdictional, stable ground. The contractor shall
install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and clearing only as necessary to install
devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case
less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is
required and will be kept by the owner's representative.
Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best
Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken
to prevent oil, tar, trash, debris and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back
fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore,
stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project
construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of
disturbance within jurisdictional waters.

A USFWS IPaC Report and NCNHP Natural Heritage Database Report were utilized for review of potential protected species in the vicinity of the
project Site. Species identified by IPaC as potentially occurring in the vicinity of the site include the red-cockaded woodpecker, the Neuse River
waterdog, the Carolina madtom, the Atlantic pigtoe, the dwarf wedgemussel, the yellow lance, and Michaux's sumac. Further, Swift Creek, which
borders the site to the south-southwest, is identified as a proposed Critical Habitat area for the Atlantic pigtoe.
No occurrences of the aforementioned protected species were observed during site inspection. Due to the maintained nature of open areas on-site
and the absence of forested areas of an appropriate age and size, it is the opinion of Timmons Group that the proposed project may affect, but is not
likely to adversely affect the red-cockaded woodpecker and Michaux's sumac.
The NCNHP report indicates known occurrences of the dwarf wedgemussel, yellow lance, and Atlantic pigtoe within Swift Creek. However, the
proposed project will avoid impacts to Swift Creek, with only minor impacts (8-sq ft) to Zone 2 of its associated buffer. The project will have minimal
impact to streams and wetlands on-site. Further, a recent aquatics survey performed on the adjoining property to the west found no occurrences of
protected aquatic species. Therefore, it is the opinion of Timmons that the proposed project may affect, but is not likely to adversely affect aquatic
protected species.

According to FEMA Flood Insurance Rate Maps 3720162900J, 2720161900J, and 3720161800 (issued May 2, 2006), the majority of the site and
associated jurisdictional impacts are located within Zone X, areas located outside of the 100-year floodplain.
The south-southwestern edge of the site is located within a portion of Zone AE, portions of the 100-year floodplain with base-flood elevations (bfe)
between 218 and 220-ft above mean sea level. Portions of the regulatory floodway are located within this along the property boundary.
Impacts to jurisdictional features within this area are limited to those associated with the proposed 30-ft wide public greenway easement required by
the local municipality. This easement was designed around the jurisdictional feature delineation in order to avoid and minimize impacts to the maximum
extent practicable.
