8. PROJECT SUMMARY: The applicant proposes to construct a new pier section (5'x 30') at the terminal end
of the existing pier and extend the floating dock, two boat lifts and tie pilings approximately 30' waterward of
their existing location.

9. PROJECT DESCRIPTION:
The applicant's property is located at 8005 Bald Eagle Lane, in Wilmington, New Hanover County. The
project area is adjacent to the Atlantic Intracoastal Waterway (AIWW) and is located in an area locally known
as Porter's Neck. The pier is situated along the eastern shoreline of the Eagle Point subdivision (later referred
to as the subdivision) between two residences (lots 4 and 5). The entire tract, including each lot within the
subdivision, is approximately 3.73 acres in size. The pier is located on a'/z acre parcel that is common to all
residence within the Eagle Point subdivision. The community parcel has approximately 50' of frontage along
the AIWW.
To get to the site: take NC Hwy 17 north from Wilmington. Turn right onto Porter's Neck Road and go to stop
sign. Take a right and the Eagle Point subdivision will be on the left, approximately 1/2 mile from Porter's Neck
Road.
The high ground portion of the property contains six single-family residences. The elevation at the site varies
from approximately 7 feet to 21 feet above normal high water. Vegetation at the site consists primarily of live
oaks, lawn grasses and ornamental landscaping. There is a broad band of coastal wetlands, primarily Salt
Marsh Cordgrass (SpartinaAltern j2ora), located along the eastern shoreline that extends easterly from the high
ground portion of the lot approximately 160 feet towards the floating dock.
Currently, Eagle Point subdivision consists of seven (7), privately owned, residential lots. Out of the seven (7)
existing lots, six (6) have been developed and contain single family dwellings. Two of the lots within the
subdivision (lot five (5) and six (6)) currently maintain an existing wooden bulkhead. The subdivision also
contains a centrally located common area, which is situated at the southern end of Bald Eagle Lane. Tile
common area extends from the center of the subdivision down to the AIWW between lots four (4) and five (5).
From there, the common area becomes a small peninsula that extends approximately 30 feet waterward of the
adjacent properties. The entire section of the common area that borders the marsh contains rip rap
(approximately 100 feet). The community pier begins at the terminal end of the common area and extends
roughly 220 feet in an easterly direction towards the AIWW. A 10' x 16' gazebo is located at the eastern most
end of the pier and an 8'x 16' floating dock attaches to the gazebo from the east. A 6'x 152' section of floating
dock runs parallel to the AIWW and connects to the 8' x 16' floatings dock from the south. From the main
floating dock, there are four (4) 4' x 16' finger docks that extend outward towards the AIWW. The entire
docking system provides mooring/dockage for up to eight (8) vessels. Of the eight (8) existing slips, two (2)
contain boatlifts. Currently, there are sixteen (16) tie pilings located waterward of the existing docks that
provide guidance for vessel dockage.
The Division of Water Quality has classified the waters of the AIWW, in the vicinity of the subject site as "SA-
ORW". The areas adjacent the subject property are NOT designated as Primary Nursery Areas (PNA) by the
Division of Marine Fisheries, however they are OPEN to the harvesting of shellfish.
PROPOSED PROJECT The applicant is proposing to construct a new 5 foot X 30 foot section of pier on
the eastern side of the existing gazebo and extend the existing floating dock and associated structures
waterward approximately 30 feet. The applicant is proposing the relocation of the floating docks in order to
achieve greater water depths at low tide. The applicant would also relocate the two (2) existing boat lifts and
associated tie pilings approximately 30 feet waterward. The configuration of the floating docks, boat lifts and
pilings would remain the same. The overall length of the pier, floating docks and pilings would extend roughly
292 feet from normal high water (NHW) and would incorporate approximately 2,222 feet of estuarine and
public trust waters.

10. ANTICIPATED IMPACTS
The proposed fixed pier would result in the shading of approximately 800 sq. ft. of Smooth Cordgrass
(Spartina alterniflora). The pier addition and relocation of the floating docks would incorporate approximately
1,422 sq. ft. of Estuarine and Public Trust Waters. The project would not extend more than 1/4 the width of
the water body and would not exceed the established pier length along the same shoreline or encroach into the
required setback from the federal channel. Minor increases in turbidity can be expected during pile placement.

other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

• A Stormwater Certification, if one is necessary
