Proposed Impacts 1 1935 Dearmon Drive Maintenance Project October 30, 2003 ' Nationwide Permit No. 13 Project No. 2003-0470 Executive Summary ' The 1935 Dearmon Drive Maintenance Project is located in Charlotte North Carolina approximately '/2 mile north of the Central Avenue - Morningside Drive intersection (Attachment A - Figures 1 and 2). The project is located within a residential area that is experiencing severe bank erosion and loss of property during storm events. The purpose of this project is to stabilize the on-site channel to prevent further bank erosion. Carolina Wetland Services, Inc. (CWS) has been contracted by Charlotte Storm ' Water Services (CSWS) to provide permitting services for this project. The results of the on-site field investigation conducted by CWS indicate that there is one jurisdictional stream channel (Stream A) located within the project limits (Attachment A - Figure 3). CSWS is requesting written verification of the jurisdictional determination of Perennial Stream A (Attachment B). On behalf of CSWS, CWS is submitting a Pre-Construction Notification ' application with attachments pursuant to Nationwide Permit No. 13 and Water Quality Certification No. 3353 (Attachment C). CSWS believes that this project is self-mitigating given the water quality improvements that will result from construction of the project. 1935 Dearmon Drive Maintenance Project October 30, 2003 Nationwide Permit No. 13 Project No. 2003-0470 I I I I I Existing Conditions The 1935 Dean-non Drive Maintenance Project is located in Charlotte, North Carolina, approximately '/2 mile north of the Central Avenue - Morningside Drive intersection (Attachment A - Figures 1 and 2). The project is located within a residential area that is experiencing severe bank erosion and loss of property during storm events. The purpose of this project is to stabilize the on-site channel and prevent further bank erosion. Carolina Wetland Services, Inc. (CWS) has been contracted by Charlotte Storm Water Services (CSWS) to provide permitting services for this project. Current Land Use The project area is mainly comprised of single-family residences with maintained lawns. Dominant vegetation within the project area includes red elm (Ulmus rubra), box elder (Ater negundo), mimosa (Albizia julibrissin), Chinese privet (Ligustrum sinense), Kentucky bluegrass (Festuca arundinacea), jewel flower (Impatiens capensis), and porcelainberry (Ampelopsis brevipedunculata). According to the Soil Survey of Mecklenburg County' (Attachment A -- Figure 2), soils within the project area largely consist of Monocan soils and Arents (MS). This map unit contains approximately 50-60% Monocan soils and 30 to 40% Arents soil. Arents soil consists of areas that have been filled to reduce flooding. The Monocan soil component is listed as having inclusions of hydric soils in Mecklenburg County.' Jurisdictional Delineation On September 24, 2003, CWS's Isaac Hinson investigated on-site jurisdictional waters of the U.S.' using the U.S. Army Corps of Engineers (USACE) - Routine On-Site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manual." No wetland areas were identified within the project limits. A Routine On-Site Data Form representative of on-site non-jurisdictional upland areas has been included as Attachment D. Jurisdictional waters of the U.S. were classified according to recent North Carolina Division of Water Quality (NCDWQ)' and USACE guidance. An NCDWQ Stream Classification Form and USACE Stream Quality Assessment Worksheet representative of Stream A have been included as Attachment E. United States Department of Agriculture (USDA), 1980. "Jurisdictional waters of the U.S." includes essentially all surface waters such as: all navigable waters and their tributaries, all interstate waters and their tributaries, all wetlands adjacent to these waters, and all impoundments of these waters. 4 Environmental Laboratory, 1987. Version 2.0. 2 I 1935 Dearmon Drive Maintenance Project October 30, 2003 Nationwide Permit No. 13 Project No. 2003-0470 The results of the on-site field investigation indicate that there is one jurisdictional stream channel (Stream A) located within the project limits (Attachment A - Figure 3). Stream A is an unnamed tributary to Briar Creek, which is part of the Catawba River basin (HU# 03050103°) and is classified as "Class C" waters by the NCDWQ. CSWS is requesting written verification of the jurisdictional determination of Stream A (Attachment B). Stream A generally flows south along the eastern property line of 1935 Dearmon Drive for approximately 200 linear feet (Attachment A - Figure 3). Stream A was evaluated to be Perennial and exhibits a ten to twelve-foot average ordinary high water width, strong flow, and a moderate presence of fish and crayfish (Attachment E - SCP1). This stream channel appears as a blueline on USGS topographic mapping and as a brownline on the NRCS Soil Survey of Mecklenburg County (Attachment A - Figures 1 and 2). Stream A scored 38 out of a possible 71 points on the NCDWQ Stream Classification Form and 52 out of a possible 100 points on the USACE Stream Quality Assessment Worksheet. Photographs of Stream A have been included as Attachment F - Photographs A and B. Agency Correspondence Cultural Resources A letter was forwarded to the State Historic Preservation Office (SHPO) on September 30, 2003, to determine the presence of any areas of architectural, historic, or archaeological significance that would be affected by the project. To date, no response has been received from SHPO. Protected Species A letter was forwarded to the North Carolina Natural Heritage Program (NCNHP) on September 30, 2003 to determine the presence of any federally-listed or candidate endangered or threatened species or critical habitat located within the project area. In a letter dated October 2, 2003, NCNHP responds that "The NCNHP does not have records for rare species, high quality natural communities, or significant natural heritage areas near the 1935 Dearmon Drive [Maintenance] Project" (Attachment G). The purpose of this project is to stabilize the on-site channel to prevent further bank erosion. Avoidance and Minimization Impacts to on-site jurisdictional waters of the U.S. have been reduced to the maximum extent practicable. The project design has limited the placement of hard structures (i.e., gabions) to those areas directly adjacent to the residence at 1935 Dearmon Drive. Modifying the channel to a more stable dimension and/or using alternate stabilization techniques is impractical due tothe close proximity of the existing residential structure and the steepness of the surrounding slopes. Soft stabilization techniques will be used in lieu of rip rap where possible. Proposed Impacts to jurisdictional Waters Proposed impacts will consist of installing approximately 120 bank feet of gabions and 40 bank feet of soft stabilization along the banks of Stream A (Attachment H - Figure 4). Gabions will be used to permanently protect residences while preventing further channel erosion. The eroded area behind the proposed gabion wall will be backfilled to its previous elevation. Soft stabilization (i.e., erosion control matting with coir fiber rolls at toe of slope) will be used to tie the gabion wall into the existing channel. On behalf of CSWS, CWS is submitting a Pre-Construction Notification application with attachments pursuant to Nationwide Permit No. 13 and Water Quality Certification No. 3353 (Attachment C). Compensatory Mitigation This project is intended to stabilize the existing channel, thereby reducing erosion and subsequent sedimentation of the stream channel.
