However, additional information is required before the review may be completed. Please address the items on the attached pages no later than the close of business on April 20, 2020. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items in Sections A through C, or failure to provide the additional information on or before the above requested date may result in your application being returned as incomplete. Please reference the subject application number when providing the requested information. Application (NDSR 09-19): 1. It is unclear who the Permittee of this system is. The application states the Permittee is "ADE 794, LLC dba Patriot Place MHP." List the Applicant as either ADE, 794, LLC or Patriot Place, LLC. a) If the Permittee is Patriot Place, LLC, provide a current lease agreement. The provided lease agreement states the lease term is "the period of time commencing on the 17t1i of November, 2017 and ending 365 days from the commencement date." Therefore, this lease term has expired. 2. The signature authority listed on the application is Douglas Smith. Please fill out the "Title" for Douglas Smith in relation to the Permittee. [15 A NCAC 02T .0106(b)] B. Certificate of Public Convenience and Necessity: 1. The wastewater treatment facility is a privately -owned public utility. The North Carolina Utilities Commission regulates anyone furnishing water to the public for compensation or operating a public sewerage system for compensation, except the following: a. Operations with less than 15 residential customers; b. Municipal or County systems; c. Sanitary districts; d. Mobile home parks where water/wastewater is included in rent; e. Homeowners Associations; and £ Nonprofit and consumer -owned corporations. Either state this wastewater treatment and irrigation facility falls under one of the above exemptions, or provide a Certificate of Public Convenience and Necessity. [15A NCAC 02T .0115(a)] Mr. Douglas Smith March 20, 2020 Page 3 of 3 C. Permit: 1. The setback for wastewater irrigation systems to property lines listed in previous permits of 150 feet is incorrect. The setback for coastal wastewater irrigation systems permitted or modified from October 1, 1987 to January 31, 1993 is 200 feet from property lines.
