PROJECT SUMMARY: The applicant proposes to construct a separate fixed pier for fishing and crabbing. Willard S. Buffkin Jr. Page 2 9. PROJECT DESCRIPTION The project site is located at 229 Gazebo Court, in the Inlet Point Subdivision, off Carolina Beach Rd. (US Hwy 421), adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW), in New Hanover County. The 1.10 acre property consists of Lots 35 and 36. The property borders the south side of the entrance channel of the Inlet Point Community Boat Basin and the Atlantic Intracoastal Waterway (AIWW) to the east. This property is part of an area that was used as a spoil disposal site for the excavation and expansion of the adjacent channel and boat basin, and has been utilized as a dredge spoils site in subsequent maintenance projects. Currently, the applicant maintains a single family residence on Lot 35. Lot 36 is maintained as a lawn. Both lots are bulkheaded and a retaining wall was installed along the length of the south side of the property to stabilize the higher elevation of the applicant's property (approx. 12' MSL) to that of the adjacent property to the south (approx.6' MSL). Vegetation waterward of the bulkhead, adjacent to the eastern shoreline of the property, consists of Salt Meadow Grass (Spartina patens) and small shrubs: Wax Myrtle (Mybca cerifera), Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharus halimifolia). Waterward, there is a border of coastal wetlands, approximately 130 feet wide, which is predominately Smooth Cordgrass (Spartina alterniflora), but becomes intermixed with high coastal marsh species at the transition to highground. Species include: Black Needle Rush (Juncus roemarianus), Sea Lavender (Limonium, spp.), and Saltwort ( alicornia, spp.), Spike Grass (Distichlis spicata), and Sea- Oxeye (Borrichia frutescens). The Inlet Point basin and channel are closed to shellfish harvest, however, outside of the closure area, the adjacent waters are open for shellfish harvest. The applicants property is included in the closure. This area of Myrtle Grove Sound is a designated primary nursery area (PNA), by the NC Division of Marine Fisheries. In the project area, the waters of the AIWW are classified as SA, by the NC Division of Water Quality CAMA Major Permit #16-01 was issued to Mr. Buffkin on February 19, 2001, for the construction of a 16'x 16' fixed pier, extending into the Atlantic Intracoastal Waterway from the property's eastern shoreline. The applicant has not initiated construction activities associated with the fixed fishing pier, however, he has completed the work that was approved under a minor modification (included the installation of sister pilings to reinforce the existing bulkhead). The applicant is now requesting approval, through a major modification, to construct/enlarge the originally permitted fixed fishing/crabbing pier off the eastern side of the property. The applicant wishes to expand the authorized fixed docking platform, or "T-Head", from the original permit dimensions of 16'x 16' to approximately 28'x 40'. The access portion of the pier would measure 6 feet in width and would extend approximately 277 feet into the sound. At the waterward end of the pier, the applicant is proposing the 28'x 40'T- head platform. The platform would include a roof, handrails and benches. No boat slips would be associated with this structure. Additionally, the total square footage for the expansion project is within the allowable limits for the property. 10. ANTICIPATED IMPACTS The proposed fixed pier would result in the shading of approximately 620 sq. ft. of mixed high marsh vegetation and approximately 160 sg. ft. of Smooth Cordgrass (Spartina alterniflora). The remaining pier and T-head platform would incorporate approximately 2,002 sq. ft. of Public Trust Area. The project would not extend more than 1/4 the width of the water body and would not exceed the established pier length along the same shoreline or encroach into the required setback from the federal channel. Buffldn Jr. Page 2 9. PROJECT DESCRIPTION The project site is located at 229 Gazebo Court, in the Inlet Point Subdivision, off Carolina Beach Rd. (US Hwy 421), adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW), in New Hanover County. The 1.10 acre property consists of Lots 35 and 36. The property borders the south side of the entrance channel of the Inlet Point Community Boat Basin and the Atlantic Intracoastal Waterway (AIWW) to'the east. This property is part of an area that was used as a spoil disposal site for the excavation and expansion of the adjacent channel and boat basin, and has been utilized as a dredge spoils site in subsequent maintenance projects. Currently, the applicant maintains a single family residence on Lot 35. Lot 36 is maintained as a lawn. Both lots are bulkheaded and a retaining wall was installed along the length of the south side of the property to stabilize the higher elevation of the applicant's property (approx. 12' MSL) to that of the adjacent property to the south (approx.6' MSL). Vegetation waterward of the bulkhead, adjacent to the eastern shoreline of the property, consists of Salt Meadow Grass (Spartinapatens) and small shrubs: Wax Myrtle (Mydca cerifera), Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharus halimifolia). Waterward, there is a border of coastal wetlands, approximately 130 feet wide, which is predominately Smooth Cordgrass (Spartina alterniflora), but becomes intermixed with high coastal marsh species at the transition to highground. Species include: Black Needle Rush (Juncus roemarianus), Sea Lavender (Limonium, spp.), and Saltwort alicomia, spp.), Spike Grass (Distichlis spicata), and Sea- Oxeye (Borrichia frutescens). The Inlet Point basin and channel are closed to shellfish harvest, however, outside of the closure area, the adjacent waters are open for shellfish harvest. The applicants property is included in the closure. This area of Myrtle Grove Sound is a designated primary nursery area (PNA), by the NC Division of Marine Fisheries. In the project area, the waters of the AIWW are classified as SA, by the N( Division of Water Quality CAMA Major Permit #16-01 was issued to Mr. Buffkin on February 19, 2001, for the construction of a 16' x 16' fixed pier, extending into the Atlantic Intracoastal Waterway from the property's eastern shoreline. The applicant has not initiated construction activities associated with the fixed fishing pier; however, he has completed the work that was approved under a minor modification (included the installation of sister pilings to reinforce the existing bulkhead). The applicant is now requesting approval, through a major modification, to construct/enlarge the originally permitted fixed fishing/crabbing pier off the eastern side of the property. The applicant wishes to expand the authorized fixed docking platform, or "T-Head", from the original permit dimensions of 16'x 16' to approximately 28'x 40'. The access portion of the pier would measure 6 feet in width and would extend approximately 277 feet into the sound. At the waterward end of the pier, the applicant is proposing the 28'x 40'T- head platform. The platform would include a roof, handrails and benches. No boat slips would be associated with this structure. Additionally, the total square footage for the expansion project is within the allowable limits for the property. 10. ANTICIPATED IMPACTS The proposed fixed pier would result in the shading approximately 620 sq. ft. of mixed high marsh vegetation and approximately 160 sg. ft. of Smooth Cordgrass (Spar ta alterniflora). The remaining pier and T-head platform would incorporate approximately 2,002 sq. ft. of Pub Trust Area. The project would not extend more than 1/4 the width of the water body and would not exceed the es 'ished pier length along the same shoreline or encroach into the required setback from the federal channel.
