DWQ # 03-0295, RRO #02-085 *r In response to your request, on March 10, 2003 1 visited the location of the stream origin as determined by Steve Mitchell with our Raleigh Regional Office as required under 15A NCAC 213 ..0259(3)(a). Based on this field visit, I believe hat the origin of the stream is accurately depicted on the map provided by Steve Mitchell (i.e. under or near the existing :ul-de-sac) as shown on the Hunter's Park Subdivision map prepared by Joyner, Keeny and Associates dated April 18, '.002. The county soil survey clearly shows one channel at the uppermost end of the drainageway through this property ind I also observed a remnant channel at the sewer manhole which is in direct alignment with the location of the stream :hannel shown on the above mentioned map. As you know, the cul-de-sac and grading for the adjacent lots makes it -npossible to evaluate the channel itself since it has been obliterated. However based on the remnant channel, the :hannel as shown on the county soil survey, the drainageway shown on the USGS topographic map, the depiction of the hannel on historic aerial photographs and general topography in the area, I believe that the channel had it origin as letermined by Mr. Mitchell. In addition, it is clear that sheet (diffuse) flow is not being achieved as required from the sediment basin which is )cated nearest to the cul-de-sac road. You will need to address this issue in order to be in compliance with the Tar- 'amlico River buffer rules. Finally it is likely that stormwater from the remainder of the watershed (for instance from the partment complex) will not achieve sheet (diffuse) flow in the near future once development of this area is complete. In rder to resolve the violation at the cul-de-sac, you would need to restore the stream channel and adjacent stream buffer s well as deal with issues related to the impact to this area which were done with written approval. The upland field area etween the two stream channels may be a suitable site for this mitigation in addition to the re-establishment of the tream on-site. Finally, another option would be a variance. DWQ would likely not oppose a variance application which would retain the ul-de-sac.and adjacent lots if the stormwater from the entire local watershed is collected and adequately treated,for utrient removal. We believe that this could be accomplished by directing stormwater to flow in non-erosive velocities to ie drainageway in which the wetlands and stream channel are located. Small, low elevation berms across this 'ainageway could be utilized to increase the retention time for the stormwater and thereby remove nutrients from the ormwater runoff. If this decision is unacceptable to you, you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this letter. Leo Green, III Green Engineering Post Office Box 609 Wilson, NC 27893 Dear Mr. Green: Re: Division of Water Quality Comments on Hunter Hill Subdivision Stormwater management proposal Nash County DWQ# 02-0295; NBR 02-085 DWQ staff have reviewed the supplemental information provided by Leo Green, II on May 8, 2003 which purports to show that the stream channel in question is not located at the Hunter Hill subdivision and therefore should not be subject to the Tar-Pamlico River buffer rules. However based on our review of the information that was submitted as well as previously submitted maps, we believe that the stream in question is indeed the channel shown on the County Soil Survey but was relocated onto the site of the lots and cul-de-sac road in question in order to construct the now-removed pond. Therefore the stream on the lots and cul-de-sac is subject to the Tar-Pamlico buffer rules. As stated in our March 15, 2003 letter, you have the right to appeal this decision to the NC Office of Administrative Hearings within 60 days of your receipt of our March 15, 2003 letter. We have the following issues that will need to be addressed before we can decide whether to support a request for a Major Variance from the Tar-Pamlico buffer rules for this project. 1. Hardship: Please provide documentation as required in 15A NCAC 2B.0259 (9) (a} to demonstrate the hardship that the buffer rules have on this project. 2. Site Plan: Please provide a map, which depicts the exact location of the stream origin from the original DWQ stream determination with respect to the subdivision plan for this development. This plan will then clearly show which lots are affected by this rule. 3. Engineering/design issues: a. We believe that three (3) small dams will be needed rather than the two (2) proposed dams in order to provide nutrient removal over the entire area. If feasible after construction of the dams, any newly-planted trees that are impacted by the dams will need to be replanted. b. Buffers - We suggest that an undisturbed, wooded buffer be established on both sides of the treatment area to the 130 foot contour on the north and an equal distance on the south. These buffers will help improve the water quality functions of this area. C. Permitting - Please confirm with the US Army Corps of Engineers that a Corps of Engineers Section 404 Permit would be obtainable for these structures. d. Please provide a plan to replant any of the newly planted trees that would be damaged by the small dams or the periodic flooding. e. It appears that the applicant has proposed two (quasi-) dry detention impoundments as nitrogen removing BMPs. In regards to nitrogen removal, we have allowed similar structures, but only to address very small percentages of larger projects that were proposing traditional BMPs such as extended detention or pocket wetlands for most of the project. The nutrient removal capabilities of such impoundments are unknown. Also, the location of the existing buffers, stream and/or wetlands relative to the impoundments is not clear. The condition of the existing vegetation and drainage area to the impoundments is not indicated. Additionally, based on our March 15, 2003 letter, we seem to have recommended these impoundments. Given all of these uncertainties, I cannot make a good recommendation. In any event, it is not clear why more traditional BMPs could not be used, such as extended detention or pocket wetlands; or conversely, why these impoundments may be preferable.
