APPROVAL of Neuse River Buffer Rule (15A NCAC 02B.0233) AUTHORIZATION CERTIFICATE
Dear Mr. Allen Keith:
You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to impact
approximately 1,907 ft2 of Zone 1 and 2,255 ft2 of Zone 2 of the protected riparian buffers for the purpose of constructing
the sewer-line out-fall at the subject property as described within your application dated 08/27/03. In addition, you should
obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project
including (but not limited to) Erosion and Sediment Control, Non-discharge , Land Quality regulations.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. For this
approval to be valid, you must follow the conditions listed below.
Conditions:
1. "Plans show , buffer measured from what appears to be an approximated and not surveyed stream location except for
the two impact maps. This approval is only for impacts (labeled as Figure 3 & 4) depicted on the impact maps in your
application.
2. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the
protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC
2B.0233(5).
3. Certificate of Completion
Upon completion of all work approved within this authorization, and any subsequent modifications, the applicant is
required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water
Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
4. Sewer Systems
The project shall comply with 15A NCAC 2H .0219(i)(2)(G) and all other State, Federal and local sewer system
regulations.

Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 1508.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B .0233. If you have
any questions or would like a copy of the buffer rules, please call (919) 733-1786. This letter does not authorize any
impacts to either Waters of the United States or Waters of the State. Please contact the US Army Corps of Engineers
(USACE) or NC Division of Water Quality (DWQ) if any impacts are proposed to either of these waters.

On behalf of The Town of Wake Forest, we hereby request approval for impacts from
two sewer line crossings totaling 4,162 square feet of Neuse River Buffers. A Pre-
construction Notification Application (PCN) is attached, which includes an Agent
Authorization Form.
The proposed project consists of a gravity fed sewer outfall and is located on the north
side of Chalk Road (SR 2054) and the south side of Jones Dairy Road (SR 2053),
approximately 6000 feet northwest of the intersection of Jones Dairy Road and Averette
Road (SR 1946). The approximately 3,550 linear foot project spans from Chalk Road,
east to the proposed Jones Farm Road extension (formerly Basinghall Avenue). An
access easement, 20 feet wide, will be maintained after construction. An additional
construction easement, 10 feet wide, will also be required. The sewer line will serve the
Northampton Subdivision, of which Phase II is currently under construction. Please refer
to the USGS topographic map attached for the location of the project. A detailed
delineation was performed and Mr. Todd Tugwell, of the USAGE, approved the
delineation in July, 2000 (AID # 200021444). On September 7, 2001, Mr. Steve Mitchell
of the NC-DWQ conducted a site visit and determined that the stream features on

property are subject to the buffer rules (a copy of Mr. Mitchell's letter is attached).
Nationwide permits 12 and 14 were granted for the Northampton Subdivision (Action
ID#'s 200021444 & 200221226).
The proposed sewer line will provide sanitary sewer service to the future residential
subdivision as well as properties between Chalk Road and the Northampton Subdivision.
Approximately 4,162 square feet (Zone 1 = 1,907 sq. ft.; Zone 2 = 2,255 sq. ft.) of
riparian buffer will be temporarily impacted during construction. Of this total, 3,009
square feet will result from a perpendicular crossing. The remaining 1,153 square feet
will result from a parallel impact to Zone 2. Parallel alignment within Zone 2 is required
so that the easement will avoid entering the footprint of future buildings (please see
Figure 4). Although the line will cross an intermittent stream, the line will be elevated,
posing no impact to the channel.
The soil survey depicts an additional drainage potentially subject to the Neuse Buffers.
This drainage was evaluated by S&EC and confirmed to not exist by Mr. Steve Mitchell
of the NC-DWQ on September 7, 2001 (see attached letter).
No wetlands or stream channels will be impacted during construction of the sewer line,
therefore, 401 or 404 Certification is not required. The proposed sewer easement will
only require a 30-foot wide corridor (i.e. less than the 40 foot wide allowable corridor
width).

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local landmarks such
as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and
development plans in relation to surrounding properties. Both the vicinity map and site plan must include
a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities
must be included. If possible, the maps and plans should include the appropriate USGS Topographic
Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps

Phase II of the Northampton Subdivision is currently under construction, and additional development is
expected to take place south of the sewer line; however, start of construction is unknown.

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands,
open water, and stream channels associated with the project. The applicant must also provide justification
for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed
herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all
streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are
proposed to these systems. Wetland and stream evaluation and delineation forms should be included as
appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly
for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and financial
viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and
explain why these design options were not feasible. Also discuss how impacts were minimized once the
desired site plan was developed. If applicable, discuss construction techniques to be followed during
construction to reduce impacts.
The applicant plans to route the proposed sewer line in the existing open
space in order to avoid impacting existing vegetation within the buffers The sewer easement
will be routed from Chalks Road eastward to the Northampton Subdivision currently under construction.
The easement will avoid stream channels and buffers except for two areas one of which will cross an
intermittent stream channel at an approximately. perpendicular angle and utilize an aerial crossing to avoid
impacting a stream The second will impact Zone 2 only. The impact from the sewer line will be
temporary and at the completion of theproject all grades will be returned to preconstruction contours.
The intermittent channel will be crossed with an elevated line therefore no channel impacts area

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of
Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands
or greater than or equal to 150 linear feet of total impacts to perennial streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits,
published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure
that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed
impact and function and relative value of the impacted aquatic resource will be considered in determining
acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be
appropriate and practicable include, but are not limited to: reducing the size of the project; establishing
and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and
replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving
similar functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order for
USACE or DWQ to consider the application complete for processing. Any application lacking a required
mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also
choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for
Stream Work in North Carolina, available at littp:Hli2o.enr.state.nc.us/newetlands/strmt:ide.html_.
Provide a brief description of the proposed mitigation plan. The description should provide as much
information as possible, including, but not limited to: site location (attach directions and/or map, if
offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed
(restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed
restrictions, conservation easement, etc.), and a description of the current site conditions and proposed

This letter will serve as confirmation of the buffer determinations made by S & E C at the subject property
referenced by the Raleigh Regional Office as NBRRO 01-221. The features represented on the Wake County
Soils and the USGS Rolesville Quad maps were evaluated on August 24, 2001 to determine their subjectivity
to the Neuse Buffer Rule.
Three stream features are represented on the maps but only the stream indicated on the USGS map (Feature
A) is subject to protection. The two small tributaries (B & C) indicated on the soils map not subject to
protection under the Neuse River Basin: Nutrient Management Strategy; Protection and Maintenance of
Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The Feature A becomes
subject off property to Flag 111, losses subjectivity through the old pond, becomes subject again from Flat;
102 to 100 and from the spillway pool off property.
