After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at http:Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast 'Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General !Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. PROJECT SUMMARY: The applicant proposes to replace an existing 2a8-slip marina with a 222-slip marina in the same footprint. Cypress Landing Marina Weyerhaeuser Real Estate Company Project Setting The project site is located off SR 1123 at the Cypress Landing Development on Chocowinity Bay near Chocowinity, in Beaufort County, North Carolina. Weyerhaeuser Real Estate developed the Cypress Landing Subdivision that included an 18-hole golf course and a marina on Chocowinity Bay under CAMA Major permit No. 181-89 issued on 11 September 1989. The marina was permitted by CAMA Major Permit No. 181-89 and it allowed for the construction of 302 slips using a floating dock construction. The marina was constructed as a 224- slip facility incorporating ±330,600 ft2 of open water with 5 finger pier complexes attached to land by one access point. The permit was modified by letter of Refinement on 14 March 2000 to add 4 slips bringing the total number of slips to 228. It is important to note that when the original permit was issued, Weyerhaeuser through restrictive covenants attached to each deed, relinquished any and all riparian rights of the homeowners with waterfront property. Upstream (west) of the marina is a portion of Cypress Landing with cluster homes know as Cypress Ridge (with an established Home Owners Association) and the shoreline in this area has been left undisturbed. Downstream (east) of the marina are developed properties in the Cypress Landing Subdivision with retaining walls landward of the wetlands. The marina property is dominated by lawn grass with mixed hardwoods, pines, and ornamental shrubs. Structures on the site include a community building with a marina office, a swimming pool, and a paved parking area. Chocowinity Bay is classified as SB by the Environmental Management Commission. Chocowinity Bay at the project site is a Public Trust Area and is not open to shell fishing. Project description The applicant proposes to replace the existing 228-slip marina with a 222-slip marina in the same footprint. The reduction in slips is a result of redesigning the existing slips on each of the 5 finger pier complexes. The only enlargement from the existing structure is a proposal to widen the gangway-landing platform which is currently 8' wide to a width of ± 19.5' for a distance of ± 108' in an effort to reduce congestion at the single point of access from the land. The applicant proposes to work on no more than 3 of the 5 finger pier complexes at any one time so that at least 2 of the slip structures are always open for use. As was the case when the marina was originally built, Whichard's Beach will be used as the staging area for removal of the existing docks and the construction of the new floating docks. The existing pilings, hardware and electrical service will be reconditioned and reused. Anticipated impacts The project as proposed will result in localized turbidity as a result of the construction activities. No additional usurpation of the Public Trust Area is proposed beyond the ±330,600 ft2 of Chocowinity Bay that is currently within the marina complex footprint. David W. Much of this information is not applicable to this permit request to conduct work specifically at th4 marina (including replacement of floating docks and associated utilities only). The following provide clarification on some of this Information and are keyed to the related items on the application form. 3.d. This project involves the replacement of an existing floating dock system at the Cypress Landing development in Chocowinity, Beaufort County, INC. The existing floating dock system is composed of a western red cedar, glue lamin ted structural deck and plastic, foam insert filled flotation units. The floating docks are anchored in place with steel pipe piles. The existing floating docks are in an advanced state of deterioration due to moisture intrusion. It has been determined that he degradation of the structural components of the docks from this collection of moisture dictates full replacement dock longevity. of the system, in order to ensure personal and vessel safety, as well as The Applicant proposes to remove the existing floating dock syste , dispose of it off- site, salvage all functional utility elements (existing power edestals, wiring, transformers, marine sewage pumpout, etc.), replace the docks with new floating dock system, and reinstall the utilities. Existing steel pipe piles will be re- sed in conjunction with additional steel anchor piles as necessary. It is envisioned at this time that the replacement dock system will be a standard, treated timber frame and !deck product, with galvanized steel hardware and stainless steel fasteners. Decking will be IPE hardwood. Flotation will be industry-standard high-density polyethylene 6-sided tubs, completely filled with expanded polystyrene foam. Specifically, physical construction is anticipated to proceed In the following manner: Three of the five existing dock trees are expected to remain in service (without utilities) at any time during the replacement process. Boats will be relocated to 'alternate marinas, trailered, or moved to open slips on other docks within the marina as necessary. The utilities (water lines, electric lines, power pedestals, and transformers) will be disconnected, removed from the docks, and moved off-site to be reconditioned for use in the new facility. The existing piles will be vibrated out and moved off site to be reconditioned for reuse. The existing floating docks will be disassembled and disposed of off-site. Concurrently, the contractor will assemble the new docks and float them over from Whichards Beach or other suitable staging location. Replacement piles will be driven and/or vibrated to minimize the potential disturbance of bottom sediments. Finally, new/reconditioned utilities will be installed on the docks. No additional slips will be added and the footprint of the marina will remain substantially the same. The proposed (replacement) dock system will lie entirely within the existing submerged lands easement for the current marina. The total number of existing slips shall be two hundred twenty two (222), which is six (6) less than what currently exists at the facility, Further, the marine sewage pumpout will be refurbished and reinstalled in its present location. The marina will remain a private facility and will allow water access for boater and non- boater Cypress Landing residents. No fueling facilities are existing or proposed for the marina. 4.d. Since this project does not impact any upland soils, soil boring logs for the marina basin, sampled in June 2003, are provided as an attachment. These logs show soil information from four separate underwater locations within the limits of the proposed work area (the marina basin). Soils shown in these logs generally range from silty clays to clayey sands. 4.h. With regard to zoning, officials at the Mid-East Commission have stated that that the entire tract at Cypress Landing is zoned either R1-ETJ or 131. It is our understanding that the 61 designation applies to a small commercial development within the community. Please note that there is to be no such commercial activity at the marina. There will be no fuel or fuel sales, no transient dock space available for lease, and no ships store. The marina Is and will remain for the use of Cypress Landing residents and their guests only. 4.k. Regarding National Register listed or eligible properties, please find attached documentation from the North Carolina Department of Cultural Resources regarding a shipwreck adjacent to the existing marina facility. Correspondence related to Permit #89-191 indicates that the shipwreck, UAU #0017PMR, is mentioned to be potentlally eligible for inclusion on the National Register of Historic Places. Additional protection measures were outlined in Permit #89-191 and related permit modifications. The wreck sits just off the southeast corner of Dock "E" and is currently marked by several 4"x4" vertical timber posts. Access to the site is depth limited and there are no existing or proposed boat slips in the area of the wreck. Further, this area will be off- limits to contractors during dock replacement activities. The proposed marina replacement will not affect the shipwreck in any fashion. Construction drawings will indicate that the contractor shall avoid the wreck area. 4.1. This Item deals with wetlands at the project site. While there are wetlands on the Cypress Landing tract, the replacement of the marina will not involve disturbance or alteration of any wetlands. We have included a reference map and detail drawing from the original CAMA permit application for the entire tract that shows the absence of wetland Impacts for the marina area. Note that the scope of work for the proposed marina replacement project does not include replacement of the fixed timber access pier that connects to the upland or the gangway that leads from the access pier to the floating docks. These items will be reused In the proposed facility, with only minor structural improvements as necessary. Existing Dock Removal With regards to the removal of the existing docks at the facility, we are examining a few options. The Owner, Weyerhaeuser Real Estate Company, has no plZs to re-use the docks. We will likely have the marine contractor who performs dock removal and replacement to either dispose of the docks off-site at a proper waste collection facility or we will allow that contractor to submit a deduct alternate in their work bid to take ownership of the old docks. In either of these scenarios, the contractor Iii be advised to follow all applicable federal, state, and local regulations in the future u e or disposal of these docks. Form Cypress Landing Marina Replacement The following provide clarification on some of the items on form DCM- MP 4 and are keyed to the related items on the application form. a.6.ii. & a.61ii Length and Width of proposed dock There are platforms of varying lengths and widths on the proposed replacement dock system at Cypress Landing. On each proposed main dock tree there is a small platform to support electrical transformers. This is a similar arrangement to what is currently in plac0 at the marina. Dimensions for the transformer platforms are as follows: Dock "A" 3'x14' Dock "B" 3'x15.25' Dock "C" 3'x15' Dock "D" 3'x13.5' Dock "E" 3'x13' Also, we have shown an increase to the dimensions of the gangway-landing platform in an effort to improve safety and decrease congestion in the landing area. ! The dimensions for this platform are approximately 19.5'x108'. This is, in effect, a wid ning of the main access walkway. a.8. Proximity of structure to riparian property lines Per our conversation on August 4, 2003, we have discovered that the existing dock structure actually overlaps the riparian line between the marina facility and the Cypress Ridge HOA. This overlap is approximately 36.5' and impacts only four slips at the end of existing Dock "A". As per your request, we have included an agreement letter between We erhaeuser and the Cypress Ridge HOA stating that this condition is acceptable as it relate to dock replacement. We have also enclosed a copy of the deed for the Cypress! Ridge property. This condition came about as Weyerhaeuser conveyed the property adj cent to the marina to the Cypress Ridge HOA after the existing marina was permitted and the existing submerged lands easement was granted. You will recall that the proposed docks shall.be positioned entirely within the existing submerged land lease easement. The proposed new docks will be 61' inside the riparian property line to the east (Creech). This Easement is appurtenant to and runs with the adjacent riparian or littoral land as described and recorded in Deed Book 11 Page 721, Deed Book 111 Page 710 and Deed Book 906 Page 460 of the Beaufort County Register of Deeds, State of Noah Carolina. - 2. Grantee shall not exclude or prevent the general public from exercising public trust rights, including commercial and recreational fishing, I shell fishing, seine netting, pound netting, and other fishing rights in navigable waters within the easement premises. 3. This Easement confers upon Grantee no additional rights to interfere with the approval, issuance, or renewal of shellfish or water column leases or to interfere with the use or cultivation of existing shellfish leases, water column leases, or shellfish franchises. 4. This Easement is subject to all rights conferred in previous conveyances by the Grantor. 5. This Easement is granted for a term of fifty (50) year beginning on May 6,1996 and terminnating on May 5, 2046, unless earlier revoked. Upon recordation, this Easement will supersede the Interim Marina Easement and Agreeme t recorded in Deed Book 1009, Page 266 of the Beaufort County Registry. 6. Subject to compliance with North Carolina General Statue 146-120), this Easement is eligible for renewal for one (1) additional fifty-year term. 7. This Easement covers those structures allowed by CAMA Permit No. 181-89. Such structures shall be used for the following purpose(s): 1. Provides mooring for vessels belonging to residents of the Cypress Landing Community and others. 2. Enhances the value of Real Estate in the community by providing water access to boaters and non boaters. All terms and conditions of CAMA Permit No. 181-89 are hereby' incorporated and made a parthereof. 8. Subject to compliance with Article 7, Chapter 113A of the North Carolina General Statutes, Grantee shall have the right to repair, rebuild or restore structures located upon the easement premises. 2 9. The exercise-of-the- rights under this Easement shall be contingent upon Grantee obtaining all necessary' permits and authorizations. and complying with all federal, state, municipal and other laws, codes, ordinances, rules and regulations applicable to the easement premises. Grantee shall not make or permit any unlawful use of the easement premises. 10. Based upon easement purchase payment calculation their is no charge for granting of this Easement. The easement purchase payment has been calculated based upon the following information: 1. Footprint of structure: 249,916 square feet 2. Riparian shoreline: 14,351.36 linear feet 3. Riparian credit: 774,973 square feet 11. Grantee shall not exercise any rights granted herein in any areas outside the easement premises without first obtaining a written modification of this Easement in accordance with North Carolina General Statute 146-12(k). 12. Upon transfer of title of the adjacent riparian or littoral property described in Paragraph 1 during the term of this Easement or any renewal thereof, the easement rights conveyed herein shall be transferred automatically to the subsequent owner of the adjacent riparian or littoral property, subject to the limitations hereinafter set forth. In the event the subsequent owner of such property (1) gives written notification to the State Property Office within twelve months of the date of transfer of title of the adjacent riparian or littoral property accompanied by a copy of the instrument of transfer, and (2) remits the easement purchase payment as provided in North Carolina General Statute 146-12(1), such subsequent owner shall be entitled to receive an easement document transferring to such owner the easement rights granted herein for the remainder of the unexpired easement term. Failure to comply with North Carolina General Statute 146-12(1) shall result in termination of this Easement. 13. It is expressly understood and agreed between the parties hereto that if the Grantee shall neglect to do and perform any matter or thing herein agreed to be done and performed by him, and shall remain in default thereof for a period of 60 days after written notice from Grantor to Grantee calling attention to such default, Grantor, with the approval of the Governor and Council of State, may declare this Easement revoked. Said notice shall be given by certified mail to the Grantee at the address set forth in Paragraph 15 (a) of this Easement. Revocation of this Easement shall entitle Grantee to seek administrative review in accordance with the provisions of Article 3, Chapter 150B of the North Carolina General Statutes. 14. Nothing contained herein shall be construed to prohibit Grantee from granting other persons rights of use of portions of the structures on the easement premises for periods not to exceed the term of this Easement. Price, Jr., Director After consulting with personnel from your company, we recommend the following design modifications and procedures for the Cypress Landing marina site, prior to and during. construction, to minimize impacts on Underwater Archaeology Unit (UAU) shipwreck #0017PMR. 1. Three boat slips as shown on the enclosed site plan (Robert M. Chiles, P.E., 8/31/94) will be eliminated from the east side of the pier adjacent to the shipwreck. No boats will be permitted to moor on the east side of the pier from the shore to the jet ski finger pier. 2., The north side- of the first finger pier, which is widened for that purpose, will be restricted to jet ski crafts only (see site plan). 3. Two weeks prior to marina construction activities, members of our UAU will be contacted so they can visit the site and place temporary stakes to mark the shipwreck. Absolutely no construction activities will take ,place within the staked area. 4. As indicated on the site plan, four shallow water buoys will be permanently placed to restrict all water craft from the immediate shipwreck site =e purchase of the buoys will be the responsibility of Weyerhaeuser. UAU members will install them after the pier system is in place. 5. By copy of this letter and additional documentation, Dr. Larry Babits, Maritime History and Nautical Archaeology Program, East Carolina University, is being notified of the shipwreck and the proposed marina. We hope that in the future an ECU-sponsored project will conduct historical research and archaeological documentation of the Cypress Landing shipwreck. We request that Weyerhaeuser support these efforts by allowing landward access to the site, temporary storage space, security, and whatever other assistance the company deems appropriate. The above comments are made pursuant to Section 106 of th? National Historic Preservation Act of 1966 and the Advisory Council on Histori Preservation's Regulations for Compliance with Section 106, codified at 36 PFR Part 800. In addition, the area is protected by North Carolina General Statulte 121-22 to 28, Article 3, Salvage of abandoned shipwrecks and other underwater archaeological materials on all bottoms from low water to one marine league seaward, and bottoms of other navigable waters. This law is supported by the Abandoned Shipwreck Act of 19> 7 (P.L. 100-298) which recognizes that states have jurisdiction over a broad range of living and nonliving resources in state waters and submerged lands, including certain abandoned shipwrecks, which have been .deserted and to which the owner has relinquished ownership rights with no retention. Terry Moore, CAMA4gent, and Ed Mitchell, Weyerhaeuser Heal Estate Company, were also pr6,sent during the site visit. The p i9 centerboard sailing vessel - lying uperpendicular-to tt ershoreline.-The to8geth r1-with-large amounts of brick rubble formed a point of land on the eastern extremity of the proposed marina. The arsa was historically used during the middle to Iota nineteenth century as a brick manufacturing site and the shipwreck appears to coincide with that period. Because of its suspected age and its unique construction features, which Include natural oak frames and a very narrow hull design, thei shipwreck designated VAV 90017PMR is considered potentially eligible for inclusion on the National Register of Historic Places. An underwater archaeological investigation by Tidewater Atlantic Research, Inc., conducted In 1988 failed to locate the shipwreck. This may b6 due to the fact that the shipwreck site is located on the eastern margin of the roposed marina and may have been considered outside the area of Impact at the time of the survey. However, site preparations, which included the removal of old pier pilings and the snagging bnd clearing of debris protruding Into the wat6r column, extended outside the archaeologically cleared area and into the'Immediate. vicinity of the shipwreck site.
