According to our rules [15A NCAC 2H .0507 (A)], if final action is not taken within 60 days, the Certification is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for your plans to impact waters as described in your August 14, 2003 application materials. However, if additional impact occurs or your development plans change, this waiver is no longer valid and a 401 Water Quality Certification will be required. PROJECT SUMMARY: The applicant proposes to construct 182 linear feet of vinyl bulkhead a maximum distance of 36' waterward of NWL and an average distance of 30' waterward. RICHARD C. MILLER FIELD INVESTIGATION REPORT PAGE #2 SITE DECRIPTION: The applicant owns two contiguous residential lots at 137/139 Sandy Lane in Aydlett, Currituck County, adjacent the Currituck Sound. To access the property, turn east off'US Highway 158 onto Aydlett Road (SR 1140) and travel 2 miles to the Aydlett Road/Narrow Shore Road intersection. Then turn left (east) onto O'Neal Lane (SR 1159) and then north onto Sandy Lane. The site is located another 300' north on the east side of Sandy Lane. Elevation of the property ranges V-7' above mean sea level. Vegetation noted on the lot includes trees such as peach, pear, pine, and wild cherry, various ornamental shrubs, and established lawn grasses. Review of 1995 and 2000 aerial photos indicates the project area during that time was 8/10 acre in area with a depth of 200' and a width of 182' measured along the bulkhead. Those photos confirm the applicant's statements regarding the location and length of the original wood bulkhead. A single-family residence and a detached garage are the only structural improvements found on the property. Wooden bulkheads in good condition protect the shorelines of the single-family lots located north and south of Mr. Miller's property. A 20' segment of bulkhead and several old pilings are the only visible remains of Mr. Miller's 182' wooden bulkhead depicted in the 1995 aerial photo. The applicant has stated that the bulk of the bulkhead and associated tiebacks and backfill were lost in August 1998 during Hurricane "Bonnie". Since the 20' section of bulkhead lacks tiebacks and backfill it functions only as a breakwater. The old 1995 bulkhead alignment now lies 24-36' waterward of Normal Water Level. A wooden groin located at the common property line on the south side of the applicant's property projects 36' waterward of the neighboring bulkhead. Along the northern one-half of the property the 4'-7' high erosion escarpment lies 2'-6' landward of NWL. Broken concrete has been placed against the 5'-8' tall scarp located along the shoreline of the southern portion of the property. The applicant's residence is located within the southernmost 1/3 of the lot and 50' from the top of the escarpment. The erosion rate is approximately 2' per year based upon my observations during the past year. No wetlands were noted at the base of the escarpment. The presence of submerged aquatic vegetation was not noted within the project area. The bottom is sandy and its contour along the old alignment ranges 30"-40" below NWL. The waters of Currituck Sound in the vicinity of the project are classified as SC (fish propagation) by the North Carolina Environmental Management Commission. These waters are classified as Joint Fishing Waters by the NC Marine Fisheries Commission and NC Wildlife Resources Commission and as Estuarine and Public Trust by the NC Coastal Resources Commission. MILLER FIELD INVESTIGATION REPORT PAGE #3 PROJECT DESCRIPTION: The applicant proposes to: • Construct 182 linear feet of vinyl bulkhead along the original bulkhead alignment a maximum distance of 36' waterward of NWL and an average distance of 30'. The north end of the proposed bulkhead would tie into the existing bulkhead on the neighboring property to the north. • Extend the existing groin on the south side an additional 30' waterward to tie into the southern end of the new vinyl bulkhead. • Place 1,213 cubic yards of sand with an average depth of 6' within the 5,460 square foot area located landward of the proposed bulkhead. ANTICIPATED IMPACTS: The construction of the bulkhead and the placement of material as backfill will eliminate 5,460 square feet of shallow water habitat. Submitted by: M. The proposed bulkhead will be approximately 145 feet in length to replace a bulkhead that was destroyed during hurricane " Bonnie " on 8/27/98. The proposed alignment could not be approved under a general permit due to the project exceeding an average of 2 feet and a maximum of 5 feet waterard of NWL. The alignment for the 145 foot bulkhead is being requested in order to meet the cornors of the adjectent riparian owners bulkhead bulkhead for structual support of both our bulkheads. The adjacent property owners wish for this alignment in order to protect thier property. There are no wetlands in this project per the CAMA field representative. All but 18" of project to be filled was lost due to the hurricane on 8/27/98.Your prompt and speedy consideration of this application will be appreciated, especially since hurricane season is approaching. I would think that these are probably necessary due to the limited size of the living spaces ( <1500 sq ft). I am ok with how it is, given where it is, but if we want to be hard, make them remove the offending deck and porch to avoid Z 1 impacts.
