Dear Mr. Garvin:
On October 1, 2004, the Winston-Salem Regional Office (WSRO) of the North Carolina Division of Water
Quality (DWQ) received your letter requesting an extension of the above referenced deadline. Having reviewed
the authorization to use General Water Quality Certification Number 3402 (DWQ# 03-0986), issued to you by
DWQ on October 16, 2003, and the comments and recommendations of the North Carolina Wildlife Resources
Commission, the Division of Water Quality hereby grants you an extension of the deadline for prohibition to
instream work and land disturbance within the 25-foot wide buffer zone along Dutch Creek. The deadline for
this prohibition to take effect is extended from October 15, 2004 to October 31, 2004. All instream work and
land disturbance within the 25-foot wide buffer zone must be completed or cease by the end of October 31,
2004 and may not resume until April 16, 2005. Please note that no additional extensions of this deadline will be
granted for this project.
This letter completes the review of your request by the Division of Water Quality under Section 401 of the

APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Garvin:
You have our approval, in accordance with the attached conditions, to place permanent fill in 40 linear feet of
intermittent stream, 40 linear feet of perennial stream, and 0.091 acre of wetlands in order to construct the
Garvin Subdivision in Watauga County, as described in your application received by the Division of Water
Quality (DWQ) on July 31, 2003 and in additional correspondence received on August 29, 2003. After
reviewing your application, we have determined that this fill is covered by General Water Quality Certification
Number 3402 which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetiands. This Certification
allows you to use Nationwide Permit Number 39 when it is issued by the U.S. Army Corps of Engineers. In
addition, you should get any other federal, state or local permits before you proceed with your project including
(but not limited to) those required by Sediment and Erosion Control, Non-Discharge, and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless
otherwise specified in the General Certification.
This approval is valid only for the purpose and design that you have described in your application. If you
change your project, you must notify us in writing, and you may be required to send us a new application for a
new certification. If the property is sold, the new owner must be given a copy of the Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in
the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certifications, as well as
the additional conditions listed below:
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional
wetlands and waters or areas within 50 feet of all streams and ponds on the property. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permits (whichever is later). A sample deed notification format can be downloaded from the
401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands.
2. The culverts required for this project shall be installed per condition No. 9 in General Certification 3402
and in such a manner that the original stream profiles are not altered (i.e. the depth of the channel must
not be reduced by a widening of the streambed). Existing stream dimensions, including the pattern and
profile, are to be maintained above and below the location of each culvert. The culverts shall be
designed and installed to allow for aquatic life movement as well as to prevent head cutting of the
streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-
established or, if the pipes are installed in a perched manner, the pipes shall be removed and re-
installed correctly. The Applicant must submit a plan and receive written approval from this Office to

address any head cutting that will occur as a result of this project (e.g., use of cross vanes downstream
of the culvert).
3. Use of native vegetation and other soft stream bank stabilization techniques must be used where
practicable instead of riprap or other bank hardening methods. If riprap is necessary, it shall not be
placed in the streambed unless specifically approved in writing by the Division of Water Quality.
4. Concrete shall not be allowed to come in contact with any surface waters until it has completely cured.
5. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout
spawning season of October 15th through April 15th in order to protect the egg and fry stages of trout.
6. Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. This certificate should be sent to the 401/Wetlands Unit of the NC Division of Water Quality
at the address listed on the form. Along with the Certificate of Completion form, please send
photographs upstream and downstream of each culvert site in order to document correct installation.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition
which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final
and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

Site visit conducted on 09/12/200:3_ Project is a proposed residential subdivision containing lots
averaging 1 to 2 acres and located in a small, narrow, heavily wooded valley with moderate slope.
This valley is drained by an unnamed tributary of Dutch Creek. Project size is approximately 43
acres. Access into the site will be provided by a frees pan bridge across Dutch Creek, which is
designated trout waters. Channel and banks of Dutch Creek will not be impacted. All imposed
jmpacts are associated with the access road into the site. County subdivision standards limiting
maximum road grade to 15% necessitate a road switchback through a portion of a small wetland
connected to the unnamed tributary. The presence of large bedrock outcrops, the trout buffer along
Dutch Creek, and the small wetland areas along the unnamed tributary, limit road design options.
Applicant has made an acceptable effort to minimize impacts. App licant imposes . protect
unimpacted wetland areas, streams, and stream buffers by deed restriction. Impacts will consist of
one 40 If crossing of the unnamed tributary along its perennial reach, 40 If of 18" p*p*ng

The Division of Water Quality has reviewed your Pre-construction Notification application for the discharge of fill material
into 0.091 acres of wetlands and 80 linear feet of stream impacts. At present, insufficient evidence is available to conclude
that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, we
are placing this project on hold as incomplete until we receive this additional information. We are requesting (by copy of this
letter) that the U. S. Army Corps of Engineers place your project on administrative hold.
1. In order to confirm that all impacts are properly addressed, please provide a plan that shows lot configurations and
show how the respective lots will be accessed.
2. If additional impacts are needed to construct this project, please modify your Pre-construction Notification
Application (PCN) and submit an up-dated PCN with your response to this additional information request.
3. Please depict the 25-foot trout buffer on your subdivision plans.

M. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

VI. Proposed Impacts to Waters of the United States/Waters of the State

wetlands, open water, and stream channels associated with the project. The applicant must also

and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream

included at the applicant's discretion. If this proposed impact is strictly for wetland or stream
mitigation, list and describe the impact in Section VIII below. If additional space is needed for

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The proposed work and associated impacts are intended to allow for development of a large
lot (1-2 ac) residential subdivision with minimal impacts to streams and wetlands. All proposed
impacts are associated with the main road through the property. The site is basically long and
narrow as it extends up the valley of a small unnamed tributary to Dutch Creek (UT Dutch
Creek). To meet maximum slope requirements (15%) in county subdivision road standards the
proposed road must switch back thru wetland. A substantial rock cliff extends across much of
the valley near the upper end of wetland A (see site sketch). This rock outcrop combined with the
trout buffer along UT Dutch Creek significantly limited road design options in this area resulting
in unavoidable impacts to Wetland A and the small intermittent channel that connects it to UT
Dutch Creek. All un-impacted wetlands, streams and associated buffers on the site will be

permanently protected through deed restrictions. In addition to the impacts described above, two
crossings of perennial streams are proposed. The first crossing will involve a bridge that will
span Dutch Creek at the project entrance, there will be no impacts associated with this crossing
(see detail . The bridge will cross perpendicular to Dutch Creek spanning the entire channel and
channel banks. The bridge abutments will be set back from the banks a sufficient distance to
allow passage of the 25 year storm without significantly changing natural stream homology or
constricting flood flow passage. The second crossing will be a 81"X 59" arch culvert across UT
Dutch Creek, a perennial tributary flowing thru the property. This crossing will cause
approximately 40 linear feet of impact to UT Dutch Creek. This crossing is unavoidable as it
occurs in a location where the stream crosses over the valley allowing no feasible alternative
road alignment. There are no mapped FEMA floodplain areas on the site. The only impacts to
trout buffers on the project will be at the two crossing locations and will be limited to the
roadway footprint approximately 40 feet each, see section 2Q.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,

Wetlands Report
The proposed Garvin Subdivision is located in the Valle Crucis community of Watauga County, NC. The
project site is approximately 43 acres. It borders Dutch Creek to the west and extends upslope to the
Hanging Rock Ridge to the east (see Location Map).
A site investigation was performed in late May/early June 2003 for the purpose of identifying all
jurisdictional waters present on the property. A total of four specific areas were found and a description of
each follows:
1. Dutch Creek: Flows parallel to Dutch Creek Road along the western boundary of the site. This is a
perennial class B trout stream. Average bankfull width of the stream on the site is 25 feet. The total length
of this stream on the site is approximately 220 linear feet.
2. UT Dutch Creek: This is a small perennial stream that flows from southeast to northwest almost the
entire length of the site. This stream has an average bankfull width of 12 feet. Total length of this stream on
the site is approximately 2150 linear feet. For some of this length, primarily in the upper part of the
property, the stream bends off the site for a few hundred feet.
3. Wetland/Intermittent Channel `A': This wetland begins at a spring just above a large rock outcrop in
approximately the middle of the site. It extends over the rock cli$ widening below then gradually
becoming narrower and eventually becomes an intermittent stream before merging with UT Dutch Creek.
The total length of this system is approximately 400 feet. The upper 300 feet we have classified as
wetlands, the lower 100 feet we have classified as an intermittent stream. The Area of wetlands is
approximately 0.34 acres, stream length is approximately 100 linear feet. Data sheets for the wetland area
and a DWQ stream evaluation form for the intermittent channel are included in this package.
4. Ephemeral Channel `SP': This channel flows generally south to north through the middle portion of the
site roughly parallel to UT Dutch Creek and Wetland `A'. This channel is approximately 800 feet long but
we have never seen water in more than 150 feet. Using the NC DWQ Stream Classification Form (see
attachgd) this channel scored only 7.5 points. Based on this, we classified this channel as non jurisdictional
ephemeral.
