Dear Sir or Madam:
Please find enclosed an application fee of $200.00, a permit application ( seven copies) for a
Nationwide Permit No. 39, and related maps for a proposed pond site on the property of Rockfish
Meadows, Inc. (formerly owned by Mr. Robert B. Herring) Rose Hill, NC. Rockfish Meadows,
Inc., which is a Christian Camp, is planning to construct a dam across a small draw to impound
water for a small recreational pond to be used by the camp and for a reservoir if needed for fire
protection. The total impact on wetlands will be 0.495 acres. As you can see from the topo, there is
no stream running through this area. The headwaters for the branch is within the proposed pond site
and becomes larger as it meanders to the northeast toward Rockfish Creek. There is approximately
10 acres of property, which will contribute runoff into this pond. If there is a need for additional
information please let me know.

M. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Pond is located at the head of a draw. Erosion control devices will be constructed to keep
sediment from leaving the site (i.e. sediment control fences constructed using wire and fabric on
metal T-post placed at 8 feet on center and rock check dams in ditch)
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o. enr. state. nc. us/ncwetlands/strmgiide. html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Conservation easement of 5.0 acres+ will be set aside for mitigation. This easement will
be 75 feet wide and runs parallel and adjacent to the run of Rockfish Creek. This easement
will be granted to the Duplin County oil and Water Conservation (See attached description
and ma.)
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wr_p/index.htm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the
following information:

(Easement to be granted to the Duplin County Soil and Water Authority)
Located in Rockfish Township, Duplin County, North Carolina and beginning at an existing iron
pipe on the western bank of the Rockfish Creek. Said point is in the southern line of that property
conveyed to Robert B. Herring in Deed Book 744 at Page 158 and Deed Book 744 at Page 160 and
also at the eastern end of that line agreement between Robert Ward and Robert B. Herring. Said
point is located North 34 degrees 14 minutes 35 seconds West - 276.40 feet, North 02 degrees 39
minutes 30 seconds West - 397.04 feet to a iron pipe in the centerline of SR No. 1126, North 86

more or less as computed by the coordinate method and a part of that property conveyed to Robert
B. Herring in Deed Book 744 at Page 158 and Deed Book 744 at Page 160. All bearings are in
angular relation to magnetic north (1987) and all distances are horizontal field measurements. The
purpose of this description is to place a conservation easement over a parcel of land 75 foot in width
and that lies adjacent to the western side of Rockfish Creek and extends northward from the southern
line of the Robert B. Herring property to the run of Beaver Dam Creek. This property described by
Robert H. Goslee & Associates, PA during June 2003.
Together with a 10 foot wide pedestrian easement for access to and from the above described
conservation easement. Said access easement runs parallel to and north of the following described
line:
Beginning at a point in the western right of way line of Huffman Road and at the northwest corner of
that property conveyed to Daniel Shields in Deed Book 1150 at Page 576, Duplin County Registry
that is located North 34 degrees 14 minutes 35 seconds West - 276.40 feet, North 02 degrees '39
minutes 30 seconds West - 397.04 feet, and North 06 degrees 26 minutes 34 seconds West - 468.85
feet from an point in the intersection of the centerline of Huffman and the centerline of Ward Road.
Running thence, with the property line of Daniel Shields, North 82 degrees 21 minutes 02 seconds
East -148.15 feet to a point; thence, North 59 degrees 46 minutes 40 seconds East 146.45 feet to
a point; thence, South 81 degrees 54 minutes 42 seconds West - 342.88 feet to a,point; thence,
South 18 degrees 59 minutes 28 seconds East - 334.25 feet to an point in the old agreed property
line between Robert Ward and Robert B. Herring and at the southeast corner of the Daniel Shields
property; thence, with the agreed line between Robert Ward and Robert B. Herring, North degrees
29 minutes 40 seconds East - 298.12 feet to a point; thence, North 76 degrees 29 minutes 40
seconds East -1396.45 feet to a point at the southwest corner of the above described conservation
easement.
