Sullins, Deputy D Division of Water Quality November 17, 2003 DWQ# 03-0969 Wake County Mr. Roy Mashburn 101 Keybridge Drive Morrisville, NC, 27560 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Mashburn: You have our approval, in accordance with the attached conditions, to place fill in 197 linear feet of intermittent streams and 0.15 acre of wetlands to construct the proposed Kit Creek Road Extension Project in Cary, Wake County, as described in your application received by the Division of Water Quality on July 24, 2003, and in additional correspondence received September 24 and October 6, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3404, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed'regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland and/or stream fills for this project (now or in the future) exceed one acre or 150 linear feet of perennial streams, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification, as well as the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 2. The culverts required for this project shall be installed in such a manner that downstream profiles are not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including the pattern and profile) are to be maintained above and below locations of each culvert. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-installed correctly. The establishment of native, woody vegetation and other soft stream bank stabilization techniques must be used where practicable instead of rip rap or other bank hardening methods; If rip-rap is necessary, it shall not be placed in the stream bed, unless specifically approved by the Division of Water Quality. 3. Heavy equipment shall be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream; 4. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 6. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, Mail Service Center 6714, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. This letter is in response to your letter dated September 4, 2003 (copy attached), which requested additional information for the proposed Kit Creek Parkway Extension. On Friday October 3, 2003 I met with Mr. Steve Mitchell on site to determine if the stream being impacted is perennial or intermittent and to present the Town of Cary's thoroughfare plan along with other information supporting the proposed placement and need of the Kit Creek Parkway Extension. The following restates your questions as shown on your letter and then provides our response. 1. Please provide a discussion of the criteria you used to determine. that the stream you propose to impact is intermittent, and how you arrived at your decision. During the past three years I have seen this feature many times in several different seasons and have, never seen any water in it. We did however check for invertebrates in the stream channel and were unable to find any. The channel does not contain many large rocks, leaf packs, or other areas suitable for invertebrate larvae and has never been observed to contain water so is not very hospitable for aquatic life. As I stated above on October 3, 2003 Mr. Steve Mitchell and I evaluated the stream. Mr. Mitchell determined that the stream was intermittent. 2. Please investigate whether the proposed crossing can be placed at a location where the impacts will be reduced. This proposed major thoroughfare is an extension of Kitt Creek Parkway west of the intersection of NC 55/ Kitt Creek Parkway. This proposed major thoroughfare was approved by the Town Council when it adopted its NW Land use & Transportation Plan in the fall of 2002. The approved plan for Village at the Park Development requires that the developer build this major link in the transportation system with the first phase of his development. The intersection of NC 55/Kitt Creek Parkway was recently constructed in RTP and is signalized. This project will align with this intersection. We are enclosing a copy of the approved maps for your information. This information is presented to assist you in your review of this project. We also request written concurrence from the North Carolina Division of Water Quality that the project complies with the 401 Water Quality Certifications associated with Nationwide Permit 14. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. The project proposes impacts resulting from the construction of a road extension to Kit Creek Road (SR 1639) as part of the Town of Cary Thoroughfare Plan. The proposed road extension is located approximately %i mile south of the Durham/Wake county border, between Alston Avenue (SR 1630) and NC Highway 55 in Wake County, North Carolina. The site is currently a wooded, undeveloped tract. The areas immediately adjacent to the project site are proposed for development as The Village at the Park P.U.D. The road extension is proposed as part of the Town of Cary Thoroughfare Plan and will bisect The Village at the Park by connecting N.C. Highway 55 and Alston Avenue. Please refer to the attached USGS map, which displays the location of the proposed project. The applicant requested a detailed wetland delineation and buffer evaluation on the property prior to site plan development in order to avoid jurisdictional wetlands and waters and riparian buffers to the maximum extent practicable. S&EC performed a detailed wetland delineation on the property in 2000. Ms. Amanda Jones, of the USACE, approved the wetland survey map on July 9, 2002 (AID # 200221159). Pursuant to this permit, approval for Section 401 Certification (DWQ# 03-0626) for that project was received on May 22, 2003. A 404 approval was received in July. The proposed roadway will impact approximately 0.154 acres of jurisdictional wetlands and 197 linear feet of intermittent stream channel. These impacts are elaborated upon within the attached PCN form and are sh6wn on the attached impact maps. The proposed road (Kit Creek Extension) is required in the Town of Cary Thoroughfare Plan. The Kit Creek Road extension will also provide an alternate route from Alston Avenue to N.C. Highway 55. Since this road extension is part of the Town of Cary Thoroughfare Plan, S&EC believes that this project constitutes a separate and complete project, independent of the adjacent proposed subdivision. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The proposed road is required to connect to an existing portion of Kit Creek Parkway and is an integral part of a Thoroughfare Plan. Because the applicant has minimized impacts to the maximum extent practicable, S&EC believes further compensatory mitigation should not be required by the USAGE, however if mitigation is required payment to the NC-Wetland Restoration Program is proposed. NC-DWQ's current policy requires written concurrence for stream impacts of greater or equal to 150 linear feet of stream length per project in non-buffered river basins. We request written concurrence that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 14. NC-DWQ's current policy does not require mitigation for wetland impacts below 1 acre or perennial stream channel impacts less than 150 linear feet per project. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The applicant requested a delineation of the wetlands and waters on property prior to site plan development in order to avoid impacts to jurisdictional areas to the maximum extent practicable. However, an unnamed tributary to Kit Creek separates the Alston Avenue from Highway 55, making it necessary to construct the road extension over the channel in order to adhere to the Town of Cary Thoroughfare Plan. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration Page 5 of 8 in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stn-ngide.html. Provide a brief description of the proposed mitigation plan.
