Subject: Modification of NPDES Permit NCO020621
Boone Wastewater Treatment Plant
Watauga County
On December 30, 2000, a final NPDES permit was issued for your facility. On April 26, 2001, your
facility made a request that a clarification be made to the effluent limits page regarding the permit limit for cyanide.
A cyanide footnote has been added to the effluent limits page stating that a value of less than 10 µg/L will be
considered zero for compliance purposes. Additionally, you should consider adherence to the quantitation level of
10 µg/L for cyanide as fulfilling the intent of Part II Section D. (4) of the NPDES permit for utilization of the most
sensitive laboratory methods possible.
Please find enclosed the revised permit pages. The revised pages should be inserted into your permit.
The old pages may then be discarded. All other terms and conditions contained in the original permit remain
unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements
to obtain other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.

1. The monthly average effluent BODs and total suspended residue concentrations shall not exceed 15% of the
respective influent value (85% removal required).
2. Whole Effluent Toxicity shall be measured using the Chronic Toxicity (Ceriodaphnia) P/F at 44%. Samples
shall be taken quarterly during March, June, September, and December.
3. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
4. The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/L.
5. The Division of Water Quality shall consider all cyanide concentrations reported below 10 ug/L to be "zero"
for permit -compliance purposes only
There shall be no discharge of floating solids or visible foam in other than trace amounts.

Division of Water Quality (Division) received correspondence from your facility requesting that a new effluent
limits page be issued due to the fact that the issued permit contains the word "draft" in the header. Please find
enclosed the revised permit pages. The revised pages should be inserted into your permit. The old pages may then
be discarded. All other terms and conditions contained in the original permit remain unchanged and in fuEl effect.
This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 arnd the

We have a couple of items concerning the revised NPDES permit that took effect on
April 1, 2001,
We have devised a schedule for pulling additional weekly samples for selenium and
cyanide should they be needed to offset daily maximum violations. We are uncertain,
however if we are required under the regulations to analyze these additional samples even
when they are not needed. We would appreciate any information you might have on this
issue.
Also, the Effluent Limitations and Monitoring Requirements page in our permit still has
the word "DRAFT" printed on it. Since this is the final permit, we request that a new
replacement page without this designation be issued.
