Dear Mr. Storie:
Division of Water Quality (Division) personnel have reviewed and approved your application for
renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit.
This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and
the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
In consideration of the additional data you submitted during the comment period, the Division
has eliminated the limits for chromium and lead. In accordance with Division policy, the monitoring
frequency for these parameters has been reduced to twice monthly. Unfortunately, the data for
cadmium continues to indicate the reasonable potential for Burnsville to exceed North Carolina water
quality standards. The limits and monitoring for cadmium remain as they were in the draft permit. It
is strongly suggested that Burnsville use a consistent detection level when monitoring for toxicants,
and that this level be in compliance with the minimum detection levels established by the Division of
Water Quality's Laboratory Section. Please call Roy Byrd of the Laboratory Section at (919) 733-3908
if you have any questions about this.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-67I4). Unless
* such demand is made, this decision shall be final and binding -
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

Southwest of Burnsville
Yancey County
to receiving waters designated as the Cane River in the French Broad River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions
set forth in Parts 1, II, III and IV hereof.
This permit shall become effective February 1, 2003.
This permit and authorization to discharge shall expire at midnight on September 30, 2005.

Notes:
1. The monthly average BOD5 and Total Suspended Solids concentrations shall not exceed 15% of the
respective influent value (85% removal).
2. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
3. This limit shall become effective one year from the permit effective date - February 1, 2004,
4. Whole effluent toxicity shall be determined by chronic toxicity (Ceriodaphnia) Pass/Fail at 6%.

A. (2.) CHRONIC TOXICITY PASS/FAIL PERNIIT LINUT
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 60/0.
The permit holder shall perform at a minimum, quarter[monitoring using test procedures outlined in
the "North Carolina Ceriodaphnta Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions or "North Carolina Phase II Chronic Whole Effluent ToxicityTest Procedure"
(Revised- February 1998) or subsequent versions. The tests will be performed during the months of
March, June, September and December. Effluent sampling for this testing shall be performed at the
NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below
the permit limit, then rnultfple-concentration testing shall be performed at a minimurn, in each of the
two following months as described in "North Carolina Phase 11 Chronic Whole Effluent Toxicity 1'est
Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geornetric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods, exposure regimes, and further statistical methods are
specified in the "North Carolina Phase 11 Chronic Whole Effluent Toxicity Test Procedure" (Revised -
February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter
code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form Al`-3
(origihal) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by Iaboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the inontli/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to
the Environmental Sciences Branch at the address cited above.
Should the Permittee fail to monitor during a month in which toxicity monitoring is required, monitoring
will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this perrrrit may be re-
opened and modified to include alternate monftoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following t1ic month of the initial monitoring.

CHANGES TO DRAFT PERMIT:
During the comment period, Burnsville submitted additional sampling data for cadmium,
chromium and lead. In consideration of the new data, I ran a reasonable potential analysis on
data from July 2000 (instead of July 1999) onward, including the newly submitted data. The
new analysis showed no reasonable potential for Burnsville to discharge chromium and lead,
though both should still be monitored on a 2/monthly basis. Reasonable potential continues to be
demonstrated for cadmium, so the weekly monitoring and daily maximum limit of 2µgIL will
remain in place.
Additionally, since this facility does not currently have or need an ammonia limit (based on
IWC), the "ammonia footnote" will be removed from the permit.

We are submitting some concerns for the draft permit for Burnsville WWiP number
NC0020290.
We have collected ten data points for cadmium, chromium, and lead. We found
no detectable cadmium or chromium in any of the samples. We found only one
sample that had any lead and there was only half the amount or the permitted
limit. We feel that with the low amount detected on these samples, that having
those limits may not be necessary. We feel that it would be more prudent to
monitor than limit those parameters.
An ammonia reopener condition has been added to this permit. We feel that a
monthly average ammonia limit would be more reasonable than a weekly
average ammonia limit. We feel that a weekly average ammonia limit could be
a hardship on the permittee.

BACKGROUND
The Town of Burnsville operates a 0.8-MGD facility discharging to the Cane River in the French
Broad River Basin. This facility serves the population of Burnsville, NC (2824 at time of
application) and industrial flow from Glen Raven Mills. The Town has a partial pretreatment
program through DWQ's Pretreatment Program.
The Town has a history of compliance problems, but is undertaking a new effort to upgrade the
treatment plant in order to meet permitted limits. The first phase of this, involving solids
handling, is complete. Treatment is also aided by the departure of OMC-Burnsville, which
contributed high chlorine and foam to the wastestream.
The most recent permit was issued December 23, 1996 and expired on January 1, 2002. The
Town submitted North Carolina's Standard Form A on August 12, 2001. The facility was
classified a Grade III Biological Water Pollution Control Treatment System by the Technical
Assistance and Certification Unit in October 2000.
Instream Monitoring and Verification of Existing Conditions and DMR Data Review
This facility discharges to the Cane River (classified C-Trout), which is located within subbasin
04-03-07 in the French Broad River. The Division reviewed three years of daily Discharge
Monitoring Reports (DMRs) for conventional parameters, metals and toxicants. Conventional

As evidenced by the data, Burnsville has experienced periodic difficulties meeting TSS, BOD
and fecal limits (see Correspondence). Ammonia, oil and grease and nutrients are within a

reasonable range for a facility of this size with no nutrient removal. Most total residual -chlorine
data were below 10 ug/L, such that this does not appear to be of concern at this facility.
Instream mercury data for Burnsville were also reviewed. These indicate that the facility has
little impact on the receiving stream with regard to mercury.
Correspondence
The Asheville Regional Office (ARO) has conducted six compliance evaluation inspections since
1997. Inspections from 2001 onward describe the facility as in compliance and commend the
efforts of the treatment plant staff. Inspections prior to 2001 indicate that the facility was in non-
compliance, and several Notices of Violation (NOVs) were issued in association with these
inspections. Since 1997, the facility has been issued three Notices of Deficiency (NODS) and 16
NOVs (with civil penalties assessed with seven of these). The NODs were associated with the
pretreatment program and late submittal of DMRs. The NOVs were issued for the following

After a general compliance review in 2000, the Division placed the Town of Burnsville under
sewer moratorium until compliance improvements were noted. Chronic problems with TSS,
BOD and fecal coliform were cited. The sewer moratorium was lifted in late 2001.
An ATC for sludge handling improvements was issued in November 2000; the Division has
since received notice that these improvements have been completed. It is anticipated that the
Town will now undertake a second series of treatment plant improvements.
PERMITTING STRATEGY
Waste Load Allocation (WLA)
The previous and current effluent limits for this permit were based on guidelines and water
quality standards. The Division has judged previous parameters and limits to be appropriate for
renewal with some exceptions (see Reasonable Potential Analysis). Ammonia toxicity was not
recalculated since the facility performs a quarterly Whole Effluent Toxicity (WET) test and
consistently achieves effluent ammonia values of less than 0.1 mg/L.
Reasonable Potential Analysis (RPA) '
The Division conducted EPA -recommended analyses to determine the reasonable potential for
toxicants to be discharged by this facility, based on three (3) years of DMR data (July 1999 —
July 2002). Calculations included parameters listed in the previous permit and pre-treatment
documents to include: cadmium (Cd), chromium (Cr), cyanide (Cn), lead (Pb), mercury (Hg),
nickel (Ni), silver (Ag), copper (Cu), zinc (Zn), and oil and grease (O & G).

Results suggest reasonable potential for the facility to discharge cadmium, chromium, copper,
lead and silver above applicable water quality standards/action level. Copper and silver are
action level parameters, and since Burnsville does not have chronic toxicity problems, these
parameters need not be limited but will be monitored on a twice -monthly basis. Cadmium,,
chromium and lead will be limited and monitored on a weekly basis. The results indicate no
reasonable potential for the facility to discharge cyanide, mercury, nickel, and zinc. Cyanide
and mercury were so rarely detected that they may be monitored on a quarterly basis. Instream
mercury monitoring will be eliminated, as most samples were recorded as non -detects. Nickel
and zinc will continue to be monitored on a monthly basis.
Other Changes
There are two additional changes of note. The first is some additional language relating to
ammonia. This states that the Division may reopen the permit to include weekly average limits.
The Division is in the process of determining weekly average ammonia criteria which will used
in permitting all future municipal and industrial facilities throughout the state. Finally, there has
been a change to the total residual chlorine limit, based upon criterion of 28 µg/L for trout
streams. This limit has been implemented as a daily max, with a one year compliance schedule.
SUMMARY OF PROPOSED CHANGES
In keeping with Division policies, the following will be incorporated into the permit:
• Imposition of chromium and lead limits with weekly monitoring
• Removal of mercury and cyanide limits — quarterly monitoring only.
• Elimination of instream mercury monitoring.
• Copper and silver monitoring on a twice -monthly (instead of monthly) basis
due to finding of reasonable potential.
• Change of total residual chlorine limit to 28µg/L.
New Weekly Average and Daily Maximum limits are derived from the latest NC/EPA policies
considering'/2 FAVs and allowable concentrations based on reasonable potential.

One of the Town's main industries, OMC (Outboard Marine Corporation) has been closed for
two years. The property was purchased by Bombardier. They also purchased the OMC site
in Spruce Pine. The company is using the manufacturing site at Spruce Pine (Mitchell
County), however the Burnsville site is only being used for administrative offices. There is no
industrial discharge or pretreatment program requirements for two years now. NPDES
permit requirements for metals monitoring, mercury and cyanide particularly, should be
evaluated to determine if monitoring and limits are still necessary. The only industrial
discharge the Town has is Glen Raven Mills (hosiery mill).

PART IV - EVALUATION AND RECOMMENDATIONS
Since the completion of the Phase I improvements, the Town's VVVVTP has been meeting effluent
limits as assigned in the current NPDES permit with the occasional exception for cadmium.
The ARO recommends that the permit be issued after evaluating NPDES requirements for metals
monitoring and limits, particularly for mercury and cyanide, to determine if monitoring and limits are
still necessary. (See Part III, Number 2 above).

appeared to be operating in compliance with effluent permit
limits_ The portable sludge press was being operated by Environ-
mental Specialties, Inc..at the time and appeared to be doing a
good job of removing excess MLSS.
Mr. Jadd Brewer and the operators appear to be doing an
excellent job of operating the plant and documenting detailed
daily records. You, they and the Towns staff are to be commend-
ed for all the hard work performed to maintain the system in com-
pliance in light of previous operating problems and compliance
difficulties.

The wastewater coming into the treatment 'Plant doesn't
appear to be exhibiting industrial characteristics,. such as
excessive foaming and strong chlorine odors, that had been
noticed in the past.. Now that OMC is closed, it confirms past
suspicions that the strong chlorine odors and excessive foaming
were probably coming from OMC.
PRETREATMENT PROGRAM: A pretreatment audit inspection has been
scheduled for April 3, 2001 by the Raleigh central office
pretreatment staff. Mr. Keyes McGee will be conducting this
year's inspection and will be contacting you regarding a
convenient time, if this date is suitable to you.
WATER TREATMENT RLANT WASTEWATER DISCHARGE: Mr. Jadd Brewer and
I visited the Water Plant and looked down into the backwash
holding tank with a flashlight. The water level was several feet
below the standpipe. The interior of the standpipe was rusted
and did not appear to be in service. It is unclear at what level
and by what means the holding tank discharges backwash water. A
valve located several feet from the outside of the tank looked
like it may be used to discharge this water. The water plant
operator on duty stated that he did not know anything about the
backwash wastewater or discharge.
Mr. Brewer and I checked the discharge pipe located off of
Pensacola Road, to verify that there was no discharge of backwash
water. We both would like to know how this backwash water
discharges and how samples are collected of the backwash water.
As you know, Mr. Brewer signs as the ORC and he is concerned
about this matter.
NPDES_PERMIT_RENEWAL: The Water Plants discharge permit
expires 12-31-01.. Please be sure to send in a renewal request at
least 180 days prior to expiration.
DISTRIBUTION AND MARKETING OF COMPOSTED SLUDGE PROGRAM: The
sludge program.appears to be very well operated and managed. I
discussed the new permit with the operators and checked the log
book which documents the times and temperatures. Mr. Johnny
McCurry appears to be doing an excellent job of windrowing and
producing an excellent quality of compost product.

The following facilities have permits that expire on 10-31-01 and on 12/31/01 and have
been assigned to you for renewal.
1 have attached some of the latest inspection letters which contains comments regarding
renewal. However, I misinformed those facilities, whose permits expire 10-31-01, of the
deadline. For some reason, I was misinformed or I miscalculated and thought that the
deadline was March 31 st, instead of May 4th. SORRY!!! I guess that you will start
getting these requests sooner than anticipated.
As you probably know, disinfection will be required for the Town of Hot Springs during
this next permit cycle. We would like to stagger in the fecal limits after they have had
time to budget, get an A to C, install, operate and test the effectiveness of the new system.
