This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994, or as subsequently amended. As requested in your application, the Division has applied a dilution factor of 7.3 (established by CORMIX modeling) and further by a safety factor of 0.5 to provide for discharge into High Quality Waters (HQW) of Northeast Creek. Note however that the Division does not apply dilution to TSS (see Effluent Limitations and Monitoring Requirements). The resulting dilution factor (3.65) was also used in the EPA -required Reasonable Potential Analyses (RPA). The RPA considered monthly analytical data submitted by the permittee to establish if each parameter had "reasonable potential" to exceed its respective water quality standard or criteria, if any. The following table summarizes the resultant changes to your previous permit. (2) ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (Quarterly) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of March, June, September, and December. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. (herein -called Weston or the permittee) operates a groundwater remediation system for the former ABC One -Hour Cleaners in Onslow County. Discharge for this facility requires a National Pollutant Discharge Elimination System (NPDES) permit to dispose treated wastewater to the surface waters of the state. The permittee's 5-year NPDES permit expired June 30, 2002 and they have requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and monitoring conditions. This document also contains references to information sources relevant to this permit renewal (superscripted numbers in order of appearance, see References). FACILITY RECORDS REVIEW Facility Description. Weston's groundwater treatment plant (GWTP) is a 0.216 MGD facility discharging to an estuary under tidal conditions (Table 1). This Grade I treatment facility utilizes an equalization tank, dual micron filter bags, dual metal x filters, a low -profile air stripper, dual micron bag filters, pH control with acid/caustic feed, and metered flow instrumentation. The current permit expired June 30, 2002_ The Division received the permittee's request to renew the permit approximately six months prior to expiration as required.' Staff Report. Wilmington Regional Office (WiRO) conducted an annual facility inspection and Mike Williams prepared a Staff Report. The WiRO staff found the facility in good condition and in compliance with the permit recommending that the NPDES Unit renew the permit in accordance with the basin plan. Mike Williams noted that a chlorinated solvent spill from the former ABC One -Hour Cleaners resulted in the subsurface migration of product several blocks beneath HWY 24 and towards Northeast Creek. Contaminants of Concern (COCs) included PCE, TCE, VC, 1,2 DCE in both surface and confined aquifers migrating toward Camp Lejeune residential housing at Tarawa Terrace 1. DISCHARGE AND COMPLIANCE HISTORY Verifying Existing Stream Conditions. This facility discharges to Northeast Creek [Stream Index No. 19-16-(3.5)], a Class SC-HQW-NSW waterbody within the White Oak River Basin.5 Northeast Creek is identified as impaired [DWQ 303(d) list, 2003] due to chlorophyll a from NC Hwy 24 to the downstream side of the mouth of Scales Creek. Priority for remediation is listed as medium. 6 Waste Load Allocation (WLA) and Permit Modification. The Division prepared a WLA for the receiving stream in May 1995 and developed effluent limits and monitoring requirements considering discharge under tidal conditions at 0.216 MGD.' The Division views these limits and monitoring requirements appropriate for renewal except as outlined below (see Permitting Approach Summary). Following compliance issues in 2001 with nickel only, the discharge pipe was extended further into Northeast Creek and the permit was subsequently modified to allow additional mixing/dilution after CORMIX modeling (NC/EPA approved). 8 Data suggests that nickel in excess of water quality standards is naturally occurring in local groundwater. Whole Effluent Toxicity (WET) Testing. The Division reviewed Weston's quarterly Whole Effluent Toxicity records from January 1997 through May 2003 (22 quarterly tests). The treatment system was inactive, i.e., not discharging for seven quarters but passed all testing reported. 9 Notices of Violation (NOVs) and Penalty Assessment. Weston received two NOVs (April and May 2002 for WET testing) during the compliance period. WET testing "no report" violations appear in BIMS but were responded to by the permittee and did not warrant penalty assessment. DMR Instream and Effluent Data Review. The Division reviewed 29 months of DMRs (January 2002 through May 2003). Weston's DMRs appear regular, thorough, and complete including months reported as "no discharge." Discharge during 10 months of 2002 averaged 0.041 MGD or about 19 % of permitted capacity. No discharge occurred during 2001 or during 2003 to date. Instream monitoring (tidal conditions) is not required for this discharge. Effluent Total Residual Chlorine (TRC). Remediation of parameters of concern does not require disinfection; TRC is not used or monitored. No changes recommended. DRAFT Faci Sheet Permit Renewal Approach Toxicant Chronic and Acute Impacts -Pollutants of Concern (POCs). To establish POCs, the Division reviewed the permit application, discharge monitoring reports (2002 through May 2003), and the Basin Plan. 5 The Division used the standard Reasonable Potential Analysis (RPA) to calculate a maximum predicted concentration for each POC. Each maximum was then compared to the POC's saltwater Chronic Standard (Table 2) and also to its Final Acute Value ('/2 FAV) for saltwater (Table 3). If by the above method, a POC showed reasonable potential to exceed its'/2 FAV, the Division included a permit limit as a Daily Maximum (for acute toxicity), or if it exceeded its chronic standard, the Division added a Weekly Average (chronic toxicity) limit to the permit. It follows then, that if a given POC did not show reasonable potential, monitoring only is required and any existing limit was removed from the permit. Findings are summarized below (see Renewal Summary, Table 4). Dilution Applied to POCs. Considering dilution supported by CORMIX modeling, S the Division recommended a dilution factor of 7.3 for nickel. This factor was further multiplied by a safety factor of 0.5 in deference to discharge into high quality water (HQW). For this renewal therefore, the Division will extend this dilution factor (3.65) to other POCs relative to saltwater criteria (Table 2). Note however that the Division does not apply dilution to TSS (see Effluent Limitations and Monitoring Requirements). Table 2. Weston, Inc. Other Special Items: See evaluation PART IV - EVALUATION AND RECOMMENDATIONS A spill of cleaning solvents occurred at ABC One Hour Cleaners resulted in the migration of product several blocks beneath NC Highway 24 and toward Northeast Creek. Tetrachloroethene, Trichloroethene, Vinyl Chloride and 1,2- Dichloroethene were detected in both the surficial and confined aquifers migrating toward Camp LeJeune residential housing at Tarawa Terrace I. Several recovery wells were constructed to remove product from the groundwater. The treatment system has had difficulty in the past meeting nickel, TSS and Toxicity. Iron is also prevalent in the groundwater and has caused increased difficulty in small micron filtration. The Division recently modified the permit to allow an increased nickel limit upon the facility's completion of an outfall extension to provide greater dilution. The recent inspection indicated that a 10-foot stainless steel outf all extension was constructed further out into Northeast Creek. Turbid effluent was first detected on initial discharge and followed by a clear tanic appearance. The test results accompanying the permit renewal application may not be indicative of actual effluent quality produced by the system. The system has been shut down for the past 18 months and was restarted at the time sampling was performed. It is recommended that a permit be drafted and placed at public notice. If no significant adverse comments are received, it is recommended that NPDES permit NCO084395 be reissued to ABC One Hour Cleaners, in accordance with the basin - wide permitting strategy. Weston, Inc. has enclosed a permit renewal application for the discharge from the ABC Cleaners groundwater remediation system in Jacksonville. We have also enclosed a USGS map indicating the discharge location, and the laboratory results for the last sample collected before the system was shut down in April 2000. No sludge was or will be generated at the treatment facility. As you know, a permit modification was recently issued that reflects the mixing that occurs in the stream near the outfall when extended 10 feet into Northeast Creek. WESTON plans to install the pipe extension next month. In the meantime, WESTON requests that the discharge limits for all of the monitored parameters be increased by the same factor (3.65) by which the nickel discharge limit was increased.
