CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 16%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August, November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fait results and THP313 for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Baxter Corporation's NPDES permit has expired and they have requested renewal of their permit. The Division of Water Quality's NPDES Unit issues the permits for individually permitted facilities in North Carolina, and determines the conditions that must be achieved prior to discharge. This fact sheet summarizes the rationale used to determine permit limits and conditions. Fact Sheet Li'I:)ES ftei�c:xw<-d This permit was last issued on May 1, 1995, according to the NPDES permit and central files. The NPDES permit expired on April 30, 2000. The permit holder, Baxter Healthcare Corp., has requested continued coverage of NPDES Permit NC0006564. Baxter Healthcare submitted the application (Standard Form C) for renewal of the NPDES permit and is complete (see Appendix A). The permit application was received on October 5, 1999, 208 days prior to expiration. The source of the wastewater is non -contact cooling water, boiler feed water, process water, and sanitary wastewater'. Wastewater is treated using the following treatment units: • Equalization with Neutralization • Nutrient addition Aeration • Clarification with sludge recycle • Aerobic digestion • Upflow sand filtration • UV disinfection After treatment, wastewater is discharged through outfall 001 into the North Fork Catawba River, which is classified B-Trout Waters," in the Catawba River Basin. Currently, the facility is permitted to discharge under the following conditions': • Flow - 1.2 MGD (compliance based on a monthly average) • BOD5 - 883 lb/day (compliance based on a monthly average) • BOD5-13241bs/day (compliance based on a daily maximum) • COD -1691 lbs/day (compliance based on a monthly average) • COD - 2537 lbs/day (compliance based on a daily maximum) • TSS -1472 lbs/day (compliance based on a monthly average) • TSS - 2208 lbs/day (compliance based on a daily maximum) • Fecal coliform - 200/ 100ml (compliance based on a monthly average) • Fecal coliform - 400/100m1 (compliance based on a daily maximum) • Total residual chlorine - 28.0 µg/L (compliance based on a daily maximum) • pH-6-9 Water needs for the facility include 125, 000 gpd of non -contact cooling water, 209,000 gpd of boilerfeed water (152,000 gpd of which is used for sterilizer steam), 862,000 gpd of process water, and 96,OOOgpd of sanitary wastewater. The 152,000 gpd of water used for sterilizer steam is considered contact cooling water. In 1995, the Division of Water Quality issued an Authorization to Construct that permitted the construction of a new outfall into the North Fork Catawba River 3.2 miles upstream of the confluence with Armstrong Creek. Prior to 1996, Baxter Healthcare and Americian Threads discharged through outfalls constructed at the same location in the North Fork Catawba River (0.2 miles downstream of the confluence with Armstrong Creek). Current Stream Conditions Currently, Baxter Healthcare discharges into the North Fork Catawba River, 3.2 miles upstream of the confluence with Armstrong Creek. American Threads, the only other discharger in the area, discharges into the North Fork Catawba River, 0.2 miles downstream of the confluence with Armstrong Creek. In relation to outfall 001, there is one upstream and one downstream benthic macorinvertebrate monitoring site. The upstream monitoring station was rated as excellent in 1997, an upgrade from the 1991 rating of good. The downstream location was rated as good in 1997, downgraded from the 1991 and 1992 excellent ratingsz. In 1994, DWQ modeled the North Fork Catawba River from Baxter Corporation's outfall to Lake James. The model included the interactions of Baxter's discharge with American Threads. The North Fork Catawba River changes classification 0.2 miles upstream of American Threads discharge, at the confluence of Armstong Creek and North Fork Catawba River. The upstream classification is B -Tr and the downstream classification is C. The model indicated that dissolved oxygen concentrations from the outfall to the confluence with Armstrong Creek did not fall below the state standard of 6.0 mg/L for trout waters. The lowest predicted value in this reach did not fall below 7.0 mg/L, therefore it is not recommended that an additional monitoring station be added to the permit. Technology Based Effluent Limit Development BOD,, COD and TSS are based on effluent guidelines (40 CFR 439 Subpart D) and have been recalculated to reflect the most current data available (See attached calculations). The results of these calculations are less stringent than the limits in the current permit. Current Division procedure dictates that the more stringent of the limits be placed in the permit. Since the facility has no plans to expand production in the foreseeable future (per the facility) and is meeting the current permit limits, it is recommended that the current limits remain unchanged. An oil & grease limit has been added to the permit. The wastewater from the extruders is considered contact cooling water and is limited per 40 CFR 463 Subpart A - Plastic Molding and Forming Point Source Category. An oil and grease allocation was given for the extruder wastewater flow and sanitary wastewater. The process wastewater covered under 40 CFR 439 does not provide an allocation. The sanitary oil & grease allocation is based on BPJ concentration limits of 30 mg/L monthly average and 60 mg/L daily maximum. The results of the calculations for oil & grease are 31.5 lb/day - monthly average and 63.0 lb/day - daily maximum. Toxicity Testing Current Requirement: Quarterly Chronic Toxicity @ 16% FEB, MAY, AUG, SEP Recommended Requirement: Quarterly Chronic Toxicity @ 16% FEB, MAY, AUG, NOV Compliance Summary: (see Appendix B) During the previous four years, the facility has been in compliance with only one violation of the toxicity limit in May 1996 (see Appendix B). July 29,1996 - NOV issued for May 1996 violation of the toxicity limit. Instream Monitoring The facility is required to conduct self -monitoring of the North Fork Catawba River at one location upstream of the discharge and one location downstream of the discharge 6. The instream self -monitoring includes: BOD,, fecal coliform, temperature, conductivity, and dissolved oxygen. Reviewing the in -stream data for the time period May 1999 through August 2000, there have been no violations of the 5.0 mg/L standard for dissolved oxygen at the monitoring site. There was one occurrence when the downstream dissolved oxygen concentration dropped below 6.0 mg/L. The downstream monitoring station is located on NCSR 1552, just upstream of Lake James. N 6't. However, there is no self -monitoring in the reach between the discharge and Armstrong Creek. Model results were evaluated. The model predicts DO concentrations will not drop below 7 mg/L in this reach. Based on the model results there is no need for a second downstream monitoring station between Armstrong Creek and the discharge. Proposed Changes After reviewing the water quality of the receiving stream, characteristics of the wastewater, and the compliance history for the facility, the following recommendations are made: • The permit should be reissued. • Influent monitoring for BOD and COD. Federal Guidelines stipulate BOD and COD removal efficiencies. The influent values for BOD and COD are needed in determining permit limits for BOD, COD and TSS. It is recommended that the facility be required to conduct influent monitoring so that treatment efficiencies can be monitored and so that the information needed to calculate permit limits is available. BOD5, COD and TSS are based on effluent guidelines and have been recalculated to reflect the most current data available (See attached calculations). The results of the calculations were less stringent than the limits in the current permit. Current Division procedure dictates that limits can not be less stringent than the previous permit. Since the facility has no plans to expand production in the foreseeable future (per the facility) and is meeting the current permit limits, it is recommended that the current limits remain unchanged. Fact SY'ieet _ 1: • Monitoring frequencies have been modified to reflect the requirements of 2B .0500 rules for grade III facilities, with a SIC between 2800 and 2899. • An oil & grease limit has been added to the permit. The wastewater from the extruders is considered contact cooling water and is limited per 40 CFR 463 Subpart A — Plastic Molding and Forming Point Source Category. Therefore, a oil & grease limit has been placed in the permit per the guidelines. • It is recommended that in -stream BOD5 monitoring be removed from the permit. Instream BOD values indicate that the average value for the period 1/98 through 10/00 1.27 mg/L upstream and 1.35 mg/L downstream. The majority of samples taken over this time period were reported as <2.0 mg/L. Less than values were treated as 1/2 the detection limit. Additionally, the latest wasteload allocation does not recommend inclusion of instream BOD monitoring and modeling has no plans to run a field -calibrated model for this reach. In the NPDES Renewal Fact Sheet under Instream Monitoring, last paragraph it states; 7t is recommended that an additional monitoring location be required at a location upstream of Armstrong Creek.' All of this is very confusing. The regional office recommends that the existing monitoring station downstream at NCSR 1552 (at Lake James) be abandoned and that a new downstream monitoring station be established at NCSR 1560. NCSR 1560 is upstream of the confluence of the North Fork and Armstrong Creek. Therefore, we believe the following should read, under; A. (1.) According to the information available it is speculated, that the reason no in -stream monitoring is required for Coats America is because their loading is insignificant when compared to Baxter Healthcare. The model developed for Baxter Healthcare and Coats America indicates that the DO sag occurs at the endpoint for the model. However, the model may not accurately depict the actual situation at this site. The model inputs for runoff in reach 3 should be investigated. In reviewing the stream flows for reach 3, it was noted that the stream flows remain constant throughout the entire 5 mile reach. This may result in the prediction of the DO sag occurring further downstream than is actually the case. Remodeling and/or relocation of the downstream monitoring point may be appropriate.
