I understand that the pond must not be larger than the associated cropland irrigation needs, that soil can be placed in the wetlands if no high land area is available and that the soil should be in discontinuous piles and not spread. I further understand that a berm cannot be associated with the pond and that therefore water cannot be impounded. As discussed, Mr. Boseman plans to haul as much of the spoil as possible from the site and use it on non-wetland areas. Any fill associated with the haul will be removed and the area left at pre-construction contours. I have attached a map of the proposed site and calculations of the needed pond size. Mr. Boseman plans to construct the pond 1650 feet long and approximately 80 feet wide and 10 to 12 feet deep. I have discussed the site plans with John Domey and he has determined that it is also exempt from 401 permit requirements and does not need their approval as long as we are more than 50 feet from all streams on USGS Topographic Maps and the soil survey maps.
