APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. Ward:
You have our approval, in accordance with the attached conditions, to shade 0.01 acre of non-vegetated wetlands in order to
replace an existing covered platform on your property in Bertie County, as described in your application received by the Division of Water
Quality on July 8, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality
Certification Number 3400, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows
you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge,
Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional
conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work,included in the 401
Certification has been completed;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

damaged in previous storms with a 3 -slip boathouse at the same location.

Project setting
The project site is located off US 17 adjacent to the Chowan River Bridge at 109 Eden Lane
in the Black Rock Subdivision near Merry Hill in Bettie County, North Carolina. The property is
bordered on upstream side by wooded wetlands that have been logged some time in the last several
years and on the downstream side by a developed and bulkheaded lot with a residence.
The site is an approximately 25' bluffthat transitions down to a retaining wall and bulkhead
with a narrow sandy beach. The existing site consists of a dwelling on a landscaped lot and a
concrete access down the bluff terminating at the landward end of the existing pier. The area is
vegetated with lawn grass, hardwood trees, and various landscape shrubs adjacent the dwelling.
Offset to the upstream side of the property is an existing 6' wide by ±1 32' long pier, with a
12' by 12' hexagon shaped platform at the waterward end. Two ±4' by ±30' access piers project at
right angles behind the platform giving access to a boathouse on the upstream side and a covered
structure on the downstream side. The existing boathouse is a ±14' wide by ±20' long structure
(drip line) with a±2.5' wide catwalk around the perimeter of the boathouse. An existing f10' by
±10' sailboat ramp is attached to the upstream side of the boathouse. The existing structure is
covered and is ±20' by f20' . This previously permitted covered platform has been damaged in prior
storms and the decking no longer exists.
The Chowan River at this site is classified as B -NSW by the Environmental Management
Commission at the project site. The Chowan River at the project site is joint waters but is not open
to shell fishing.
Project description
The applicant proposes to replace the existing ±20' by f20' covered structure with a f22' by
±22' (drip line) boathouse. The boathouse will include a ±12' by ±20' slip for one boat and a f8' by
±22' double slip for two jet skis. An approximately 2' by 22' catwalk will provide access to the
three slips. A ±4' by ±16' section of the existing access pier will be replaced. The ±484 ft2 of the
proposed boathouse added to the ±280 ft2 of the existing boathouse will bring the total to ±764 ft2 of
covered area. The number of slips will increase form the existing 2 to a total of 5.
Anticipated impacts
The project as proposed will not result in any additional shading of the river bottom from the
construction of the second boathouse. The project as proposed will result in localized turbidity as a
result of the construction activities.

Please find attached an application to repair and convert an existing covered
platform to a covered boathouse. The covered boathouse will be used for private,
seasonal access to the water for the owner's two jet skis and jet boat. All work will be on
a previously permitted structure on the Chowan River that has suffered storm damage.
Construction steps will be as follows:
1. Remove existing roof structure and support pilings with barge-mounted crane.
2. Drive replacement piling and set replacement roof timbers with barge-mounted
crane.
3. Complete repairs to existing access pier, install new timbers for boat access pier.
4. No excavation or fill is necessary for any portion of the work.
5. All materials to be CCA treated piling.
Subject to DENR review/approval, Waff Contracting will be doing the repair and new
work for Mr. Ward. Please give me a call if you need additional information or have any
questions regarding the permit and cannot get up with Mr. Ward.

Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
